A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
3 WASHINGTON, AMENDING RESOLUTION NO 2587, SECTION 5 TO CLARIFY
THE TYPE OF BARRICADING DURING CONSTRUCTION AND AFTER
4 COMPLETION OF CONSTRUCTION AS A REQUIRED CONDITION APPROVING
THE PRELIMINARY PLAT OF THE 176 LOT SINGLE-FAMILY SUBDIVISION
5 KNOWN AS "RIVERWALK" LOCATED SOUTH OF HOWARD ROAD, NORTH OF
GAME FARM PARK, WITHIN THE CITY OF AUBURN, WASHINGTON

7 WHEREAS, Section 5 of Resolution No 2587 requires
8 additional language to clarify the type of barricades during
9 and after completion of construction, and
10 WHEREAS, Section 5 as it exists in Resolution No. 2587 is
11 confusing in its application during construction and after
12 construction; and
13 WHEREAS, Ordinance No 4725 approved the surface mining
14 permit to allow excavation to accommodate the construction of
15 the single-family residential subdivision has been changed to
16 clarify the provisions for the barricade, and
17 WHEREAS, clarification of Section 5 is consistent with
18 the rulings of the Hearing Examiner and the City Council
19 provides ease of interpretation, and
20 WHEREAS, clarification of Section 5 is consistent with
21 the comprehensive plan, and
22 WHEREAS, modifications to Section 5 do not materially
23 change the conditions as set forth in Section 5.

2 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH

RESOLVES THAT:

Section 1. Section 5 of Resolution No 2587 be amended
5
to read as follows:

The two stub streets, that abut the plat on its east
7 boundary, shall be barricaded during construction of
subdivision No construction traffic shall be allowed
8 onto these streets, except for emergency vehicles
Subsequent to construction the access to the two stub
9 streets shall remain locked and barricaded and shall be
for emergency vehicles only The applicant shall
10 construct that form of access for emergencies as approved
by the City Construction entrances shall be limited to
11 either Howard Road or 29th Street, and shall be signed as
being construction entrances for this project
12
Section 2. The remaining provisions of Resolution No.
13
2587, not amended above, shall be in force and effect
14
Section 3 If any provision of Resolution No 2587 or
15
this Resolution is determined to be invalid or unenforceable
16
for any reason the remaining provision shall remain in force
17
and effect of this Resolution and Resolution No. 2587 .
18
Section 4. The Mayor is hereby authorized to implement
19
such administrative procedures as may be necessary to carry
20
21 out the directives of this legislation
