KNOW ALL MEN BY THESE PRESENTS that for and in consideration of the sum of
TEN DOLLARS ($10.00), and for the consideration of incorporating the Extension into the City
system, and other good and sufficient consideration, receipt whereof is hereby acknowledged, the
undersigned Grantor TA 40, LLC, does by these presents hereby convey, setover, assign, transfer
and warrant to the City of Auburn, a Municipal Corporation of the State of Washington,
2,563 LF of C900 PVC Force Main and a sanitary sewer lift station which includes
wetwell/drywell, duplex pumps with associated piping and fittings, CMU building with motor
controls and utility room, chemical feed system, generator set and all appurtenances or any other
associated public facility as shown on the public facility extension plans referred to as
FAC06-0035 - AUBURN 40 Sewer Lift Station and Force Main development. Situated within
the following described real property, located in King County:
Said sanitary sewer lift station is located within Tract K of The Plat of Auburn 40 PUD,
Recording Number 20100826001442. Said plat is recorded in Volume 255 of Plats, pages
051-058. Said force main is located within the public right of way of the following streets
within said plat: Beginning from said lift station; thence northerly within `O' Place NE to
42nd Street NE; thence westerly in 42nd Street NE to L Place NE; thence northerly in
`L' Place NE to 43`d Street NE; thence westerly in 43`d Street NE to `I' Street NE; thence
southerly in I Street NE to its termination at sanitary sewer manhole SSMH#209-063.
The said Grantor hereby warrants that it is the sole owner of all the property above conveyed; that
it has full power to convey the same and that it will defend the title of the said Grantee against any
and all persons lawfully making claim thereto, and indemnify the City of Auburn for any costs,
including Attorney fees in defending title.
