3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, APPROVING THE PRELIMINARY PLAT OF A 2-LOT
4 SUBDIVISION LOCATED ON THE WEST SIDE OF "A" STREET SE, IN THE
4200 BLOCK, WITHIN THE CITY OF AUBURN, WASHINGTON
5
6 WHEREAS, Application No PLT0004-95, dated July 6, 1995,
7 has been submitted to the City of Auburn, Washington by
8 EVERETT BOTTEMILLER, requesting approval of a Preliminary Plat
9 for a 2-lot subdivision located on the West side of "A" Street
10 SE in the 4200 block, within the City of Auburn; and
11 WHEREAS, said request above referred to was referred to
12 the Hearing Examiner for study and public hearing thereon; and
13 WHEREAS, pursuant to staff review, the Hearing Examiner
14 conducted a public hearing to consider said petition in the
15 Council Chambers of the Auburn City Hall on September 19,
16 1995, at 7 00 p m , at the conclusion of which the Hearing
17 Examiner recommended approval of the Preliminary Plat, based
18 upon the following Findings of Fact and Conclusions, to-wit

FINDINGS OF FACT

21 1 The owner/applicant, Everett Bottemiller, requests
preliminary plat approval of a two lot plat The subject
22 project is located on the west side of "A" Street SE and
southerly of 41st Street SE The parcel is 76, 929 square
23 feet in area and is zoned C-3 , Heavy Commercial
24 2 The plat is part of a four lot short plat approved in
1993 Further subdivision of the plat cannot occur

1 within five years of the short plat unless a
preliminary/final plat is processed and approved within
2 five years of the short plat The short plat was
approved in 1993

3 . The proposed lot 3A contains a veterinary clinic and lot
4 3B is vacant. The plat itself fronts on --A" Street SE
which is a designated arterial That street is built to
5 arterial standards

CONCLUSIONS OF LAW

8 1 Staff has concluded that the preliminary plat may be
approved It is consistent with the criteria set forth
9 in the Land Division Ordinance at Section 17. 06 070.
Specifically, adequate provisions have been made for the
10 public health, safety, and welfare since all public
facilities such as streets, sewer, water and storm
11 drainage are available and adequate to serve the plat
This is a commercial plat so there is no impact on parks
12 or schools
13 2 . The conformance of the proposed subdivision to the
general purposes of the Comprehensive Plan has been
14 established in that the Comprehensive Plan map indicates
that this area is appropriate for commercial uses and
15 therefore the proposal is consistent.
16 3 . The plat as proposed is consistent with all applicable
regulations of the City

4 The plat conforms with the general purposes of the Land
18 Division Ordinance
19 5 The plat complies with the Zoning Ordinance
20 6 The potential environmental impacts have been mitigated
in that a Determination of Non-Significance was issued.

23 For each of the above stated reasons, the recommendation
24 of the Hearing Examiner to the Auburn City Council on the
25

application is conditional approval, subject to the following

for a Preliminary Plat.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
4
WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH
5
RESOLVES THAT

Section 1. The above cited Hearing Examiner 's Findings
7
and Conclusions are herewith approved and incorporated in this
8
Resolution.

Section 2 . The Preliminary Plat of a 2-lot subdivision
10
located on the west side of "A" Street SE in the 4200 block,
11
and legally described as follows, is hereby approved:

Lot 3 of City of Auburn Short Plat No
13 SPL0002-93 , according to the Short Plat
recorded under King County Recording No
14 9304081114 .
15 Section 3. The Mayor is hereby authorized to implement
16 such administrative procedures as may be necessary to carry
17 out the directives of this legislation
