HomeMy WebLinkAbout2680 4 11k4 1 RESOLUTION NO. 2 6 8 0 2 A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING 3 THE MAYOR AND CITY CLERK OF THE CITY OF AUBURN, TO EXECUTE A FRANCHISE EXTENSION AGREEMENT BETWEEN THE CITY OF AUBURN AND 4 KING COUNTY TO EXTEND CITY OF AUBURN WATER AND SANITARY SEWER SYSTEM FRANCHISES LOCATED IN KING COUNTY COUNCIL DISTRICT NO 5 9 UNTIL MAY 31, 1996 6 THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A 7 REGULAR MEETING DULY ASSEMBLED, HEREBY RESOLVES THAT: 8 SECTION 1. The Mayor and City Clerk of the City of 9 Auburn, Washington, are hereby authorized to execute a 10 Franchise Extension Agreement between the City of Auburn and 11 King County to extend the City of Auburn 's water and sanitary 12 sewer franchises located in King County Council District No 9 13 until May 31, 1996 A copy of said Agreement is attached 14 hereto, denominated as Exhibit "A" and made a part hereof as 15 though set forth in full herein 16 SECTION 2 . BOOTH MAYOR 25 26 Resolution No 2680 October 23 1995 Page 1 1 2 3 ATTEST: 4 5 'I / ]!r 6 Robin Wohl ueter, City Clerk 7 8 9 APPROVED AS TO FORM: 10 11 I I I / 1 • 12 Michael .3 Reynolds, City Attorney 13 14 15 16 17 18 19 20 21 22 23 24 25 26 Resolution No. 2680 October 23, 1995 Page 2 11926 FRANCHISE EXTENSION AGREEMENT RECITALS WHEREAS, the City of Auburn currently holds water franchise numbers 250, 542, 576, 605 and water and sewer franchise 7543 granted by King County, Washington for the operation of a portion of its water and sewer system in unincorporated King County; and WHEREAS, the referenced City of Auburn's franchises have expired; and WHEREAS, the City of Auburn has requested a renewal of said franchises; and WHEREAS, the City of Auburn and King County, Utilities Technical Review Committee recommend that said franchise be extended until May 31, 1996 to give the City the opportunity to complete and obtain approval of its water comprehensive plan and franchise; and WHEREAS, no objections have been raised to the granting of the requests; and WHEREAS, King County has approved the extension of this franchise until May 31, 1996 through the passage of Ordinance No. // 9 a Lc . subject to the conditions contained in the ordinance and agreement. NOW, THEREFORE, King County, Washington and the City of Auburn, Washington agree as follows: 1. The terms of King County Water Franchise Numbers 250, 542, 576, 605 and Water and Sewer 7543 are hereby approved and extended so that they will now expire on May 31, 1996. 2. All other conditions of King County Water Franchise Numbers 250, 542, 576, 605 and Water and Sewer Franchise 7543 shall remain in full force and effect and are not modified or amended by this agreement or Ordinance No. / 1377_La Page 1 of 2 Rita 2/0) c.
