A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
3 WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK OF THE CITY
OF AUBURN TO TERMINATE THOSE SIDEWALK CONSTRUCTION DELAY
4 AGREEMENTS BETWEEN THE CITY OF AUBURN AND THOSE CERTAIN
PROPERTY OWNERS OF VARIOUS LOCATIONS WITHIN THE CORPORATE
5 LIMITS OF THE CITY OF AUBURN

WHEREAS, certain property owners of various locations
7
within the corporate limits of the City of Auburn had
8
requested permission to delay the placement of sidewalks; and
9
WHEREAS, the City of Auburn authorized those certain
10
property owners to defer the construction of sidewalks
11
abutting their property until either the formation of a
12
sidewalk L I D (local improvement district) or until curb,
13
gutter and a permanent street surface is constructed; and
14
WHEREAS, as a result of curb, gutter and permanent street
15
construction through various improvement projects including
16
L. I.D ' s (local improvement districts) , development
17
requirements imposed on private developers and certain
18
individual agreements, sidewalks were constructed; and
19
WHEREAS, the sidewalk construction delay agreements
20
between the City of Auburn and those certain property owners
21
of various locations within the corporate limits of the City
22
of Auburn are no longer required; and

WHEREAS, the City of Auburn confirms all conditions for
2
those certain recorded sidewalk construction delay agreements
3
have been met and that said agreements are to be terminated.

See Exhibit "A" attached hereto and incorporated herein for
5
the site addresses and recording numbers of those certain
6
sidewalk construction delay agreements to be terminated under
7
this resolution
8
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL
9
OF THE CITY OF AUBURN, WASHINGTON AS FOLLOWS
10
Section 1. The Mayor and City Clerk of the City of
11
Auburn are hereby authorized to execute the termination of
12
those certain sidewalk construction delay agreements between
13
the City of Auburn and those property owners of various
14
locations within the corporate limits of the City of Auburn
15

16
the site addresses and recording numbers of those certain
17
sidewalk construction delay agreements to be terminated under
18
this resolution
19
Section 2 . The Mayor is hereby authorized to implement
20
such administrative procedures as may be necessary to carry
21
out the directives of this legislation
