3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AUTHORIZING THE MAYOR OF THE CITY OF AUBURN TO
4 TERMINATE THAT CERTAIN STREET IMPROVEMENT DELAY AGREEMENT
BETWEEN THE CITY OF AUBURN AND THE OWNER OF LOT 3 AND THE
5 SOUTH 143 08 FEET OF LOT 2 OF CITY OF AUBURN SHORT PLAT NO
32-79 AS DESCRIBED IN STREET IMPROVEMENT DELAY AGREEMENT
6 RECORDED UNDER KING COUNTY AUDITOR' S FILE NO 8409131033

WHEREAS, the owner had requested permission to delay the
8
placement of street improvements while in the process of
9
developing their property as described above; and
10
WHEREAS, the City of Auburn authorized the owner to defer
11
the construction of the required street improvements until a
12
Local Improvement District (L I D ) has been initiated by the
13
City and or other property owners adjacent to or benefiting
14
the property; and
15
WHEREAS, City officials have verified that the required
16
street improvements are now in place and meet City street
17
standards; and
18
WHEREAS, as a result of the completed street improvement
19
requirements, the aforesaid Street Improvement Delay Agreement
20
is no longer required; and
21
WHEREAS, the City of Auburn confirms all the conditions
22
have been met for Street Improvement Delay Agreement as

1 recorded under King County Auditor ' s File No 8409131033 and
2 is hereby terminated Exhibit "A" attached hereto and
3 incorporated herein sets forth location of the property
4 described in said Street Improvement Delay Agreement
5 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
6 WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH
7 RESOLVES AS FOLLOWS
8 Section 1. The Mayor of the City of Auburn is hereby
9 authorized to execute the termination of the aforesaid Street
10 Improvement Delay Agreement
11 section 2 . The Mayor is hereby authorized to implement
12 such administrative procedures as may be necessary to carry
13 out the directives of this legislation

SUBJECT Resolution No. 2684 - Recording
DATE. March 18, 1996
The Council adopted Resolution No 2684 on December 4, 1995. The resolution
authorized termination of a street improvement delay agreement recorded under
King County Auditor's file number 8409131033. The resolution, much like the
other documents already transmitted to you, cannot be recorded to terminate the
street improvement delay agreement because it does not have the original
owners name.
A new resolution that includes the property owner name and the recording
number 8409131033 should be drafted for Council approval.

This Agreement entered into on the date hereinafter set forth by and between
Walter L. & Moneen Lang, their heirs, sucessors, and assigns hereinafter
referred to as "Owner" and the City of Auburn, Washington, hereinafter referred

WHEREAS, Owner is in the process of developing their property on West Valley
Highway (2800 block) legally described as follows

Lot 3 and the South 143 08 feet of Lot 2 of City of Auburn Short Plat
C7 No 32-79, as recorded under King County AF 08003130699; LESS any
portion thereof lying westerly of the East marginal line of West Valley
Highway (aka S.S Hwy 5-M) situated in the SW 1/4 of ISec,l; Twp. 21 N ,
R. 4 E, WM. in King County, Washington
WHEREAS, Owner has requested permission to delay the placement of street
improvements to serve the aforesaid legally described property and the request
was approved by the City Engineer of the Auburn Public Works Department on the 16th
day of May, 1984
WHEREAS, Owner agrees to install the required street improvements consisting
of pavement, sidewalk, curb and gutter, street lights and storm drainage.
All improvements to be constructed to City of Auburn specifications
NOW, THEREFORE, in consideration of the mutual benefits to be derived herein,
a delay is hereby authorized that will allow the Owner to defer the construction
of the required street improvements until the City deems it necessary to construct
said street along West Valley Highway adjacent to the above legally described parcel
Owner also agrees to sign petitions and participate in the Local Improvement District
for any or all of the street improvements listed above, if initiated by City or
property owners adjacent to or benefitting the property

It is further agreed by the Owner, their respective successors or assigns, and
all other subsequent Owners, their respective successors or assigns, that should it be
necessary for City to enforce any of the hereinabove provisions of this Agreement,
the Owners, their successors and assigns, hereby covenant and agree to pay City all
reasonable attorney fees and costs incurred by City to enforce the provisions of
this Agreement
An executed copy of this Agreement shall be recorded among the land records
of the King County Auditor
