A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
3 WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO
AN AGREEMENT BETWEEN THE CITY OF AUBURN AND AUBURN COMMUNITY
4 SUPPERS FOR 1996

THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A
6
REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES THAT
7
Section 1. The Mayor and City Clerk of the City of
8
Auburn are herewith authorized to enter into an Agreement
9
between the City of Auburn and AUBURN COMMUNITY SUPPERS, a
10
local non-profit charitable organization, to provide meals for
11
the needy, lonely, poor and infirm for 1996. A copy of said
12
Agreement is attached hereto and denominated Exhibit "A" .
13
Section 2 . The Mayor is hereby authorized to implement
14
such administrative procedures as may be necessary to carry
15
out the directives of this legislation.

3 //,,THIS AGREEMENT is made and entered into this 526 day of
4 fYL/(1242// , 1996, by and between the CITY OF AUBURN,
5 WASHINGTON, a municipal corporation of the State of Washington
6 hereinafter referred to as "CITY" whose address is 25 W. Main
7 St. , Auburn, WA 98001, and AUBURN COMMUNITY SUPPERS, a local
8 non-profit charitable organization hereinafter referred to as
9 "AUBURN SUPPERS" whose address is First Methodist Church, 100
10 "N" Street S.E. , Auburn, Washington, WITNESSETH:
11 WHEREAS, AUBURN SUPPERS has provided free wholesome meals
12 for the needy, lonely, poor and infirm once a week and has
13 filled a real need within the Auburn community; and
14 WHEREAS, AUBURN SUPPERS has a fine staff of volunteers
15 and several merchants have responded by donating perishable
16 food as well as government surplus meats and commodities; and
17 WHEREAS, AUBURN SUPPERS is in severe financial need to
18 continue the aforementioned civic program;
19 NOW, THEREFORE, for and in consideration of the benefits
20 to be derived by the parties hereto and the citizens of the
21 City of Auburn, and in consideration of the promises,
22 covenants, terms and conditions contained, the parties agree
23 as follows

1 PURPOSE
2
The purpose of this Agreement is to provide a
3
contribution by the CITY to AUBURN SUPPERS for their
4
provision of free wholesome meals once a week to the
5
needy, lonely, and infirm.
6
2 . SCOPE OF SERVICE
7
AUBURN SUPPERS shall provide once a week wholesome meals
8
to the needy, lonely, poor and infirm at no cost to the
9
recipients
10
3 COMPENSATION AND TERM OF AGREEMENT
11
The CITY shall contribute to AUBURN SUPPERS the sum of
12
TWO HUNDRED DOLLARS ($200. 00) per month commencing
13
January 1, 1996, payable on the first of each month
14
through December 31, 1996 However, the final statement
15
of services rendered will be submitted on or before
16
December 15, 1996
17
4 . STATUS REPORT
18
AUBURN SUPPERS shall at the request of the Auburn Finance
19
Director account to the CITY for the utilization of said
20
funds by billing the City monthly by invoice indicating
21
the number of meals' served, to whom meals were served and
22
the cost thereof.

5 NONDISCRIMINATION
2
AUBURN SUPPERS shall provide meals without discrimination
3
on account of race, color, creed, religion, national
4
origin, sex, age, or the presence of any sensory, mental
5
or physical handicap
6
6. TERMINATION OF AGREEMENT
7
This contract may be terminated by either party hereto by
8
giving thirty (30) days written notice of intent to
9
terminate to the other party
10
7 INDEMNIFICATION/HOLD HARMLESS
11
AUBURN SUPPERS agrees to defend, indemnify and hold
12
harmless the CITY, its elected and appointed officials,
13
employees and agents from and against any and all claims,
14
demands and/or causes of action of any kind or character
15
whatsoever arising out of or relating to AUBURN SUPPERS,
16
its employees, subcontractor or agents for any and all
17
claims by any persons for alleged personal injury, death
18
or damage to their persons or property to the extent
19
caused by the negligent acts, errors or omissions of
20
AUBURN SUPPERS its employees, agents, subcontractors, or
21
representatives. In the event that any suit of claim for
22
damages based upon such claim, action, loss or damages is
23

brought against the CITY, AUBURN SUPPERS shall defend the
2
same at its sole cost and expense; provided that the CITY
3
retains the right to participate in said suit if any
4
principle of governmental or public law is involved; and
5
if final judgment be rendered against the CITY and/or its
6
officers, agents and/or employees or any of them or
7
jointly against the CITY and AUBURN SUPPERS and their
8
respective officers, agents, subcontractors, employees or
9
any of them, AUBURN SUPPERS agrees to fully satisfy the
10
same and AUBURN SUPPERS shall reimburse the CITY for any
11
cost and expense which the CITY has incurred as a result
12
of such claim or suit. The provisions of this section
13
shall survive the expiration or termination of this
14
Agreement.

Your voice mail message on February 6 directed that I file the adopted social service
agency contracts with you. As you are aware, the City Council adopted the below listed
Resolutions on February 5, 1996 A copy of each resolution is provided along with the
original contracts that have been executed by the City of Auburn.
1 ) Resolution No. 2700
Authorizes an Agreement with Auburn Christian Action Program Day Care
(ACAP) for child care services
2.) Resolution No. 2701
Authorizes an Agreement with Auburn Christian Action Program Day Care
(ACAP) for parenting classes.
3 ) Resolution No. 2702
Authorizes an Agreement for services with the Auburn Food Bank to purchase
and provide food to Auburn Residents during 1996
4 ) Resolution No. 2703
Authorizes an Agreement with Auburn Youth Resources for support services for
youth and families in the Auburn Community for 1996

Authorizes an Agreement with Children's Home Society to provide child care
services through the families first program for 1996

advocacy services for 1996

Authorizes an Agreement with King County Sexual Assault Resource Center to
provide counseling services to rape and other sexual assault victims within the
Auburn area during 1996
11 ) Resolution No. 2710
Authorizes an Agreement with Valley Cities Counseling and Consultation to
provide mental health services for Auburn resident during 1996.
12.) Resolution No. 2711
On February 6, 1996 Al Hicks obtained the original.
All agreements require a notarized signature from the appropriate social services
agency official. Additionally a certificate of insurance naming the City of Auburn as an
additional insured is required to be on file with the original agreement that requests it.
Other provisions such as reports should be filed appropriately
