HomeMy WebLinkAbout2708 1 r ft.'"n INN tyt9 1 RESOLUTION NO. 2 7 0 8 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, 3 WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK OF THE CITY OF AUBURN, TO EXECUTE A CONTRACT BETWEEN THE CITY OF AUBURN 4 AND DOMESTIC ABUSE WOMEN'S NETWORK (DAWN) RELATING TO FUNDS RECEIVED FROM A PORTION OF THE KING COUNTY PROPOSITION 2 SALES 5 TAX MONEY TO PROVIDE DOMESTIC VIOLENCE COMMUNITY ADVOCACY SERVICES FOR 1996 6 7 WHEREAS, the CITY has approved the expenditure of a - 8 portion of the King County Proposition 2 sales tax money for 9 domestic violence community advocacy services; and 10 WHEREAS, the CITY desires to award these funds to DAWN to 11 perform advocacy services pursuant to certain terms and 12 conditions; 13 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, 14 WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH 15 RESOLVES THAT: 16 Section 1. The Mayor and City Clerk of the City of 17 Auburn, Washington, are authorized to execute a Contract 18 between the City of Auburn and Domestic Abuse Women' s Network 19 (DAWN) to provide advocacy services for 1996 as outlined in 20 said Contract A copy of said Contract is designated Exhibit 21 "A" , is attached hereto, and incorporated by reference herein 22 23 24 25 26 Resolution No. 2708 January 9, 1996 Pagel • 1 Section 2. Reynolds, 23 City Attorney 24 25 26 Resolution No. 2708 January 9 1996 Page 2 1 C O N T R A C T 2 3 THIS CONTRACT made and entered into this 5----#1 day of 4 , 1996 by and between the CITY OF AUBURN, a 5 municipal corporation of the State of Washington, hereinafter 6 referred to as the "CITY", and DOMESTIC ABUSE WOMEN'S NETWORK, 7 P.O. Box 1521, Kent, WA 98032 , hereinafter referred to as 8 "DAWN". 9 WHEREAS, the CITY has approved by Council Resolution the 10 expenditure of a portion of the King County Proposition 2 11 sales tax money for domestic violence community advocacy 12 services; and 13 WHEREAS, the CITY desires to award these funds to DAWN to 14 perform such services pursuant to certain terms and conditions 15 as described in this Contract; 16 NOW, THEREFORE, IN CONSIDERATION of the mutual benefits 17 and conditions hereinafter contained, the parties hereto agree 18 as follows: 19 1. PURPOSE 20 The purpose of this Contract is to provide funds from a 21 portion of the King County Proposition 2 sales tax money to 22 provide domestic violence community advocacy services to those 23 24 25 26 Resolution No. 2708 DAWN-Advocate Exhibit"A" (dawn-a96) January 9, 1996 Page 1 1 persons residing within the jurisdictional boundaries of the 2 CITY. 3 2. SCOPE OF SERVICES 4 The parties agree and understand that DAWN agrees to 5 provide community based advocacy for victims of domestic 6 violence, including children suffering from domestic violence. 7 A DAWN will hire and train one or more community 8 advocates to serve the CITY community. 9 B DAWN will provide outreach and services to the 10 Auburn community. Such outreach and services will include: 11 a Public information activities aimed at 12 informing the general public of the services 13 available through DAWN. 14 b Working with the general public to enhance the 15 understanding of domestic violence as a 16 reprehensible social and criminal act. 17 c Conduct outreach to unserved and underserved 18 special populations, thereby allowing access 19 for victims who would not otherwise seek 20 assistance. 21 22 23 24 25 26 Resolution No. 2708 DAWN-Advocate Exhibit"A" (dawn-a96) January 9 1996 Page 2 1 d. Conduct outreach in a culturally relevant 2 manner consistent with the social norms of the 3 population being served. 4 e. Establish contacts with other community 5 organizations 6 f Post information on domestic violence in 7 hospitals, community clinics and with other 8 organizations providing resources to the 9 potential client population. 10 C DAWN will provide immediate intervention and ongoing 11 advocacy to victims of domestic violence. 12 a Top priority will be given to victims in the 13 most immediate danger. 14 b Priority will be given to victims referred 15 from, or those referred to, the 16 Law/Safety/Justice system 17 D Services will be provided in such a way that the 18 rights and needs of the victims, which include children, 19 are addressed 20 a The first priority will be the safety of the 21 victims of domestic violence. 22 23 24 25 26 Resolution No. 2708 DAWN-Advocate Exhibit "A" (dawn-a96) January 9, 1996 Page 3 1 b. Services will be delivered in a manner 2 sensitive to the needs of the individual but 3 without prejudice based upon race, color, 4 national origin, ancestry, income or social 5 circumstance. 6 c. Services will be delivered in such a manner as 7 to clearly communicate to victims that help is 8 continually available and accessible. 9 d. Upon initial contact, conduct a structured risk 10 assessment to assist victims in understanding 11 their current situation and to develop a safety 12 plan 13 e. Educate victims regarding community services 14 and resources available and if they choose to 15 leave the situation/home where the abuse 16 occurs. 17 f Provide information about obtaining safe and 18 affordable temporary housing. 19 g Assist victims in securing necessary language 20 interpretation services 21 22 23 24 25 26 Resolution No. 2708 DAWN-Advocate Exhibit"A" (dawn-a96) January 9 1996 Page 4 1 h. Assist victims to obtain services which meet 2 special physical or emotional needs, including 3 services for the disabled 4 i. Provide ongoing problem solving, advocacy 5 personal support and consultation to include 6 being available to the victim for emergency 7 situations. 8 j Assist victims in conducting a comprehensive 9 needs assessment to determine long-term 10 choices, regardless of whether the victim 11 leaves home. 12 E DAWN will coordinate with the local community 13 support systems to assist victims of domestic violence 14 Advocates will 15 a. Assist and educate the victim how to access 16 other systems such as health care, counseling, 17 food banks safe or affordable housing, 18 childcare. 19 b. Referrals to CPS if necessary. 20 c. Child care referrals 21 d Referrals to support groups 22 23 24 25 26 Resolution No. 2708 DAWN-Advocate Exhibit"A" (dawn-a96) January 9, 1996 Page 5 1 e. Work with the victim, children and educational 2 system to arrange for appropriate and safe 3 school setting 4 f. Facilitate support groups in such cases where 5 those groups are not readily available. 6 F. DAWN will coordinate with the local criminal justice 7 system to assist victims of domestic violence. Advocates 8 will 9 a. Record injuries, witnesses and other potential 10 evidence 11 b Provide oral and written instructions regarding 12 the use of criminal and civil legal action 13 c Explain the time frame for actions, notify of 14 court dates. 15 d. Explain the consequences of using the court 16 system and the powers of the court. 17 e. Explain preparation for and follow-up required 18 for court proceedings 19 f Maintain ongoing contact with the Auburn police 20 department. 21 g. Ongoing contact with legal advocate to include 22 coordinating services for victims. 23 24 25 26 Resolution No. 2708 DAWN-Advocate Exhibit"A" (dawn-a96) January 9, 1996 Page 6 1 h. Establish relationships with court related 2 personnel relevant to the cases of domestic 3 violence victims. 4 G. DAWN will assist in the coordination of local 5 domestic violence response systems and the development of 6 protocols for the handling of domestic violence cases. 7 Advocates will: 8 a Develop protocols with the CITY Police 9 Department for domestic violence cases. 10 b Establish referral protocol with the Auburn 11 Municipal Court 12 c Establish referral protocol with local 13 hospitals and other health related services 14 d. Facilitate and coordinate training for CITY 15 police officers 16 H. DAWN will work with the Regional Planning team to 17 develop a regional approach to domestic violence with specific 18 attention to 19 a Regional Training & Protocol Development; 20 b. Management Information System (MIS) and Data 21 gathering; 22 c. Evaluation 23 24 25 26 Resolution No. 2708 DAWN-Advocate Exhibit"A" (dawn-a96) January 9, 1996 Page 7 1 G. Advocacy services will be provided to any victim of 2 domestic violence, including children, who is a resident of 3 the CITY of Auburn in the geographic area served by the City's 4 Municipal Court. 5 3. TERM 6 The term of this Contract shall commence on January 1, 7 1996 and will expire on December 31, 1996. 8 4. COMPENSATION 9 As full and total payment for the services provided under 10 the terms of this Contract, the CITY agrees to pay DAWN the 11 total amount of THIRTY-SIX THOUSAND ONE HUNDRED DOLLARS 12 ($36, 100) . DAWN will submit a statement to the CITY quarterly 13 describing services that it has rendered under the terms of 14 this Contract and the CITY will pay an amount equal to one- 15 quarter of the total amount by the twenty-eighth day of the 16 month following the end of the quarter However, the final 17 statement of services rendered will be submitted on or before 18 December 15, 1996 19 5. INDEMNIFICATION 20 DAWN agrees to defend, indemnify, and hold harmless the 21 CITY, its elected and appointed officials, employees and 22 agents from and against any and all claims, demands and/or 23 24 25 26 Resolution No. 2708 DAWN-Advocate Exhibit"A" (dawn-a96) January 9 1996 Page 8 1 causes of action of any kind or character whatsoever arising 2 out of or relating to services provided by DAWN, its 3 employees, volunteers or agents concerning any and all claims 4 5 by any persons for alleged injury or damage to persons or property to the extent caused by the negligent acts, errors or 6 property to the extent caused by the negligent acts, errors or 7 omissions of DAWN, its employees volunteers or agents or 8 representatives In the event that any suit or claim for 9 damages based upon such claim, action, loss or damage is 10 brought against the CITY, DAWN shall defend the same as its 11 sole costs and expense; provided that the CITY retains the 12 right to participate in said suit if any principle of 13 governmental or public law is involved; and if final judgment 14 be rendered against the CITY and/or its officers, elected 15 officials, agents and employees or any of them or jointly 16 against the CITY and DAWN and their respective officers, 17 agents, volunteers, employees or any of them, DAWN shall fully 18 satisfy the same and shall reimburse the CITY any costs and 19 expense which the CITY has incurred as a result of such claim 20 or suit The provisions of this section shall survive the 21 expiration or termination of this Contract 22 23 24 25 26 Resolution No. 2708 DAWN-Advocate Exhibit "A" (dawn-a96) January 9 1996 Page 9 1 6. INDEPENDENT CONTRACTOR/ASSIGNMENT 2 The parties agree and understand that DAWN is an 3 independent contractor and not the agent or employee of the 4 CITY and that no liability shall attach to the CITY by reason 5 of entering into this Contract except as provided herein. The 6 services required under this Contract may not be assigned or 7 subcontracted by DAWN without the prior written consent of the 8 CITY. 9 7. INSURANCE 10 DAWN shall procure and maintain for the duration of this 11 Contract insurance against claims for injuries to persons or 12 property which may arise from or in connection with services 13 provided by DAWN, its agents, employees or volunteers under 14 this Contract. DAWN agrees to provide comprehensive general 15 liability insurance and shall maintain liability limits of not 16 less than ONE MILLION DOLLARS ($1, 000, 000) combined single 17 limit coverage per occurrence for bodily injury, personal 18 injury and property damage. DAWN shall also provide and 19 maintain professional liability coverage including errors and 20 omissions coverage in the minimum liability amount of ONE 21 MILLION DOLLARS ($1, 000, 000) combined single limit per 22 occurrence for bodily injury, personal, injury and property 23 24 25 26 Resolution No. 2708 DAWN-Advocate Exhibit"A" (dawn-a96) January 9 1996 Page 10 1 damage Any deductibles or self insured retentions in either 2 policies must be declared to and approved by the CITY At the 3 option of the CITY either: The insurer shall reduce or 4 eliminate such deductibles or self insured retentions as 5 respects the CITY, its officials and employees; or DAWN shall 6 procure a bond guaranteeing payment of losses and related 7 investigations, claim administration and defense expenses. 8 The policies are to contain or be endorsed to contain the 9 following provisions 10 1. GENERAL LIABILITY COVERAGE: 11 (a) The CITY, its elected and appointed officials, 12 employees and agents are to be covered as insureds 13 as respects: Liability arising out of services and 14 activities performed by or on behalf of DAWN, its 15 employees, agents and volunteers. The coverage 16 shall contain no special limitations on the scope of 17 protection afforded to the CITY, its elected and 18 appointed officials, employees or agents 19 2 . GENERAL LIABILITY AND PROFESSIONAL LIABILITY 20 COVERAGES: 21 (a) DAWN' s insurance coverage shall be primary 22 insurance as respects the CITY, its officials, 23 24 25 26 Resolution No. 2708 DAWN-Advocate Exhibit"A" (dawn-a96) January 9, 1996 Page 11 1 employees and agents Any insurance or self 2 insurance maintained by the CITY, its officials, 3 employees or agents shall be in excess of DAWN's 4 insurance and shall not contribute with it. 5 (b) Any failure to comply with reporting provisions 6 of the policy shall not affect coverage provided to 7 the CITY, its officials, employees or agents. 8 (c) Coverage shall state that DAWN's insurance 9 shall apply separately to each insured against whom 10 claim is brought or suit is brought except with 11 respect to the limits to the insurer' s liability. 12 (d) Each insurance policy required by this clause 13 shall be endorsed to state that coverage shall not 14 be suspended, voided, cancelled, reduced in 15 coverage, or in limits except after thirty (30) days 16 prior written notice by certified mail return 17 receipt requested has been given to the CITY DAWN 18 agrees to provide copies of the Certificates of 19 Insurance to the CITY at the time that this Contract 20 takes effect. 21 (e) DAWN shall furnish the CITY with Certificates 22 of Insurance and with original endorsements 23 24 25 26 Resolution No. 2708 DAWN-Advocate Exhibit"A" (dawn-a96) January 9 1996 Page 12 1 affecting coverage required by this clause. The 2 certificate and endorsements for each insurance 3 policy are to be signed by a person authorized by 4 that insurer to bind coverage on its behalf. The 5 CITY reserves the right to require complete, 6 certified copies of all required insurance policies 7 at any time. 8 (f) DAWN shall include all volunteers, employees 9 and agents under its policies or shall furnish 10 separate certificates and endorsements for each. 11 All coverages for volunteers shall be subject to all 12 the requirements stated herein 13 8. NONDISCRIMINATION 14 DAWN may not discriminate under any services or programs 15 to which this Contact may apply directly or through 16 contractual or other arrangements on the grounds of race, 17 color, creed, religion, national origin, sex, age, or the 18 presence of any sensory, mental or physical handicap. 19 9. BOOKS AND RECORDS 20 DAWN agrees to maintain separate accounts and records in 21 accordance with State Auditor's procedures, including 22 personnel, property, financial and programmatic records which 23 24 25 26 Resolution No. 2708 DAWN-Advocate Exhibit"A" (dawn-a96) January 9 1996 Page 13 1 sufficiently reflect direct and indirect costs and services 2 performed under this Contract. DAWN agrees to maintain all 3 books and records relating to this Contract for a period of 4 three (3) years following the date that this Contract is 5 expired or otherwise terminated The parties agree that the 6 CITY OF AUBURN may inspect such documents upon good cause at 7 any reasonable time within the three (3) year period. 8 10. TERMINATION OF AGREEMENT 9 This Contract may be terminated by either party upon ten 10 (10) days written notice should the other party fail 11 substantially to perform in accordance with its terms through 12 no fault of the other 13 11. GENERAL PROVISIONS 14 11. 1 In addition to the quarterly reports required 15 by this Contract, DAWN agrees to submit a report to the CITY 16 no later than January 31, 1996 describing the progress and 17 activities performed for the year 1996 under its Scope of 18 Services. The report shall include data regarding the type and 19 level of services provided to CITY residents as well as the 20 number of persons served who reside within the jurisdictional 21 boundaries of the CITY. 22 23 24 25 26 Resolution No. 2708 DAWN-Advocate Exhibit"A" (dawn-a96) January 9, 1996 Page 14 1 11.2 This Contract shall be governed by the laws, 2 regulations and ordinances of the CITY, the State of 3 Washington and County of King and where applicable, Federal 4 laws. 5 11. 3 The CITY and DAWN respectively bind themselves, 6 their successors, volunteers, assigns and legal 7 representatives to the other party to this Contract and with 8 respect to all covenants to this Contract. 9 11 4 This Contract represents the entire and 10 integrated Contract between the CITY and DAWN and supersedes 11 all prior negotiations This Contract may be amended only by 12 written instrument signed by both the CITY and DAWN. 13 11. 5 Should it become necessary to enforce any term 14 or obligation of this Contract, then all costs of enforcement 15 including attorneys fees and expenses and court costs shall be 16 paid to the substantially prevailing party 17 11 6 DAWN agrees to comply will all local, state and 18 federal laws applicable to its performance under this 19 Contract. 20 21 22 23 24 25 26 Resolution No. 2708 DAWN-Advocate Exhibit"A" (dawn-a96) January 9, 1996 Page 15 1 2 CITY OF AUBURN 3 I 5 CHARLES A.
