A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
4 WASHINGTON, AUTHORIZING THE MAYOR OF THE CITY OF AUBURN TO
5 EXECUTE A PURCHASE AND SALE AGREEMENT WITH THE OWNERS OF REAL
PROPERTY DESIGNATED AS TAX PARCEL NUMBERS 192105-9337 AND
6 192105-9338 RELATING TO THE SOUTH CENTRAL STORM IMPROVEMENT
PROJECT

8 WHEREAS, the City Council of the City of Auburn approved
9
Project No 567 under the 1996 City budget adoption, also
10
11 known as South Central Storm Improvements, which provides for
12 the improvement of storm water facilities ; and
13 WHEREAS, continued local flooding conditions in the
14
vicinity of "R" Street S E and Howard Road, resulting from
15
over burdened existing storm water facilities, creates an
16
17 ongoing concern of flood damage to both public and private
18 property as well as the threat of ground water contamination;
19 and
20
WHEREAS, the purchase of said properties will provide
21
sufficient area necessary to implement flood relief in the "R"
22

1 Street S E and Howard Road area, via infiltration and or
2
underground storm water detention system improvements; and
3
WHEREAS, the owner (s) had granted to the City a right of
4
5 entry onto said properties for the purposes of soil
6 infiltration and suitability testing for storm water
7 management; and
8
WHEREAS, said testing was completed by Hart Crowser
9
Earth and Environmental Technologies) and that such soil tests
10
11 were found acceptable to remedy flood conditions in the area
12 described above, and
13 WHEREAS, the owner (s) asking total sales price including
14
both parcels is in the amount of $55, 000 00 plus normal
15
closing costs ; and
16
17 WHEREAS, the City' s contract appraiser, Clendaniel, Lema
18 & Watts Inc , has completed their valuation for both
19 properties which concludes a combined fair market value of
20
$57 , 500 00 ; and

1 WHEREAS, vicinity maps of said properties are attached

hereto and incorporated by reference in this Resolution as

Exhibit "A" and "A-l"

5 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
6 WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH
7 RESOLVES THAT

Section 1 . The Mayor of the City of Auburn is hereby
9
authorized to execute a purchase and sale agreement for the
10
11 purchase of Tax Parcel Number 192105-9337 and Tax Parcel
12 Number 192105-9338 relating to the South Central Storm
13 Improvement Project The total purchase price including both
14
parcels is based on the owner (s) asking price of $55, 000 00
15
plus normal closing costs
16
17 Section 2 . The Mayor is hereby authorized to implement
18 such administrative procedures as may be necessary to carry
19 out the directives of this legislation
20
