A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
3 WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN
4 ADDENDUM TO THE TECHNICAL SERVICES AGREEMENT BETWEEN THE CITY
OF AUBURN AND H L YOH COMPANY TO PROCURE TEMPORARY STAFF
5 THROUGH THE END OF 1996

7 WHEREAS, the City of Auburn has in effect an agreement
8 with H L YOH COMPANY for procuring temporary employees,
9 which has a six month personnel solicitation waiting period;
10 and
11 WHEREAS, the City will be recruiting project engineer
12 positions; and
13 WHEREAS, the City will be using temporary personnel of H
14 L YOH COMPANY until the City' s recruitment and selection
15 processes have concluded; and
16 WHEREAS, a 90-calendar day personnel solicitation waiting
17 period for the project engineer positions is more economically
18 favorable and provides adequate time to fill open positions;
19 and
20 WHEREAS, the six month personnel solicitation waiting
21 period will continue to apply to all other temporary
22 positions

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,

WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH

RESOLVES THAT

Section 1 . The Mayor and City Clerk of the City of
5
Auburn are herewith authorized to execute an Addendum to the
6
Technical Services Agreement between the City of Auburn and H
7
L YOH COMPANY, to procure temporary staff through the end of
8
1996 A copy of said Addendum is attached hereto and
9
denominated Exhibit "A" and incorporated herein
10
Section 2 . The Mayor is hereby authorized to implement
11
such administrative procedures as may be necessary to carry
12
out the directives of this legislation

TECHNICAL SERVICES AGREEMENT

,L Addendum is entered into this 1�� day of
6 P, 1996 by and between the CITY OF AUBURN, a
7
municipal corporation of the State of Washington, whose
8
9 address is 25 West Main, Auburn, Washington 98001, hereinafter
10 referred to as "CITY" , and H L YOH COMPANY, whose address is
11 130 Andover Park East, Suite 304 , Seattle, WA 98188 ,
12 hereinafter referred to as "YOH"
13
WHEREAS, the CITY and YOH have entered into a Technical
14
15 Services Agreement dated February 5 , 1996 ; and
16 WHEREAS, the parties agree to amend certain provisions of
17 said Agreement; and
18 NOW, THEREFORE, in consideration of the covenants and
19
conditions of this Addendum to the Technical Services
20
21 Agreement, the CITY and YOH agree as follows
22 Section 1 PURPOSE:
23 It is the purpose of this Addendum to reflect certain
24
changes in Paragraph 10 of the Agreement entered into between
25

1 the parties on the 5th day of February, 1996 , a copy of which

is attached hereto as Attachment "1"

Section 2 AMENDED PROVISIONS
4
5 The parties agree to amend Paragraph 10 of the
6 technical services agreement by adding the
underlined language as follows
7
8
10 No contractor may go permanent at client facility
9
without prior written agreement from H L YOH
10
11 COMPANY within six (6) months of consecutive
12 employment If CLIENT wants contractor to go
13 direct before this waiting period, a fee based on
14
the annual salary of said contractor will be
15
assessed at 20% of annual salary- EXCEPT THAT
16
17 no project engineer positions may go permanent at
