3 A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON AUTHORIZING
THE MAYOR AND CITY CLERK OF THE CITY OF AUBURN, TO EXECUTE
4 AN INTERLOCAL AGREEMENT FOR LIBRARY SERVICES IN AUBURN
5 BETWEEN THE CITY AND THE KING COUNTY RURAL LIBRARY DISTRICT

WHEREAS, the City of Auburn commissioned a Library Task Force to
7
study the current and future library needs of the community; and is interested in
8
9 supporting the recommendations of the Library Task Force; and
10
11 WHEREAS, the Auburn Library Board recommends to the City Council
12 placing before the voters the issue of annexation; and
13
14 WHEREAS, the City of Auburn is interested in giving citizens the
15 opportunity to vote on annexation to the King County Rural Library District; and
16
WHEREAS, the City of Auburn is interested in financially supporting
17
construction of a new facility with better visibility to citizens and improved public
18
19 access, and
20
21 WHEREAS, library services are a valuable resource in the community
22 and the smooth transition with minimum disruption in service to citizens is
23 desired, and
24
25 WHEREAS, the staff of the Auburn Library will effectively be absorbed
into the King County Rural Library District; and

1 WHEREAS, the pre-design of the new facility shall begin in 1997,

NOW THEREFORE , THE CITY COUNCIL OF THE CITY OF AUBURN,

WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREBY
4
RESOLVES THAT

6 Section 1 City of Auburn funds not to exceed four million dollars be
7 appropriated for the construction of a new library in Les Gove Park.
8
9 Section 2. Councilmanic bonds shall be used as the source to fund
10 the construction of the new library
11
12 Section 3 The old Auburn Library facility will be used for general
community benefit.

Section 4 The Mayor and City Clerk are hereby authorized to execute an
15 interlocal agreement with King County Rural Library District attached as Exhibit 1
16

Agreement for Library Services ; �
Pending Annexation of the City of Auburn
into the'King County Rural Library District
This agreement is dated the 26th day of November , 1996,
and is entered into by and between King County Rural Library District, hereinafter
referred to as DISTRICT, and the City of Auburn, hereinafter called CITY
This agreement is to define the rights and obligations of the parties in the event
annexation of the CITY to the DISTRICT is approved at the special election to be held
in February 1997 or a subsequent election prior to May 31, 1997 If the annexation of
the CITY to the DISTRICT is not approved at such election(s), this Agreement shall be

0) The parties agree as follows:

1 The DISTRICT will not realize any direct tax revenue for provision of library
services within the CITY until the 1998 calendar year The CITY agrees to
fund the Auburn Library, located at 808 9th Street Southeast, Auburn, at
current service levels for the 1997 calendar year
2. The DISTRICT has experience in managing numerous public library
construction projects and will work with CITY staff to develop the program
plan and manage the construction of the new Auburn Library The project
schedule will be jointly determined by the CITY and the DISTRICT It is the
intention of the DISTRICT and CITY to begin pre-design of a new library
facility in 1997 with construction to begin in 1998
3 The CITY will provide the land for the new library and an appropriate number
of additional parking stalls from lands already owned or acquired for this
purpose The CITY shall lease the land for the facility to the DISTRICT for
one dollar annually upon the issuance of a certificate of.occupancy.for..the
new library A map of Les Gove Park showing the locations in the park
acceptable for new construction is included herein as Attachment A.
4 In addition to land, the CITY will provide an amount not to exceed $4 million
for the new facility In addition the CITY will contribute all library equipment,

C.7 furnishings, and the entire collection from the Auburn Library as of
December 31, 1997 valued at $1 6 million. The DISTRICT will contribute a

minimum of $250,000 for the design and construction of the new facility

The District will contribute whatever is necessary to complete a minimum
15,000 square foot facility
5 The DISTRICT will be responsible to develop a minimum 15,000 square foot
resource-level library (but a larger facility is desired), adequate parking for
library patrons, and shall provide all furnishings and materials. The facility
will be designed to be expandable to 22,500+ square feet and all additional
costs for construction will be paid for by the DISTRICT

6 Effective January 1, 1998 the DISTRICT will fund all operations,
maintenance, and other costs of the Auburn Library The CITY will continue
to be responsible for grounds maintenance around the existing Auburn
Library The City of Auburn will pay their fair share of major capital repairs to
operate the existing facility Upon completion of the new library the CITY will
retain ownership of the old library building.
7 Beginning January 1 1998, the CITY will no longer be responsible for the
management of a library, and the staff of the Auburn Library will be absorbed
into the DISTRICT The plan to incorporate Auburn Library staff into the
O District is included herein as Attachment "B"

8 Title to all materials, furnishings, and equipment in the Auburn Library will be
transferred to the DISTRICT January 1, 1998. When the new facility is
completed, the collections should be comparable to other resource branch
collections. The Auburn Library has maintained special language
collections; a genealogical collection, a literacy program; and outreach for
low income, homebound, and elderly populations. The Auburn Library
Board recommends that these programs continue when the DISTRICT
assumes the operation of library services in our community

King County Library System (KCLS) agrees to incorporate the existing regular staff members of
the Auburn Public Library (APL) into existing regular staff of(KCLS), as of the effective date of
annexation, as follows:
• For the purpose of this agreement, existing regular staff member is defined as a current
regular staff member in a regular full or part time position, as classified and employed as of
the date of this agreement.
• KCLS will provide positions with similar hours whenever possible.
• Positions available for the APL staff members may be exclusively in the Public Services
division. Many of the functions previously performed by the APL are performed centrally at
KCLS. The annexation of APL is not expected to lead to staff increases in centrally
performed functions.
• APL staff members will be given first option and first priority when configuring staff
-assignments at the Auburn Branch.
• Temporary staff members of the APL may choose to incorporate into the current substitute
classification of KCLS.
• The City of Auburn agrees to provide payment of any accrued vacation, sick leave,
compensatory time, wellness days and floating holidays available for APL staff members in
C17 accordance with the City of Auburn's Administrative Policies and Procedures.
• APL staff members not provided any level of sick leave cash out from the City of Auburn, at
v1 the effective date of annexations, will be credited with their current sick leave accrual, at the
effective date of annexation, up to a maximum of one year accrual.

Cr) • Any Washington State Public Employee' Retirement System Plan (PERS I), excess
compensation payments due will be prorated to the City of Auburn and KCLS, based upon
Ct Qt proportional years of service APL and KCLS. This component of this agreement will remain
in effect until such time as all APL PERS I eligible staff members have terminated their
employment with KCLS.
• Years of service at APL will be credited as years of service with KCLS at the time of
employment with KCLS. KCLS agrees to waive standard benefit waiting periods.
• Once annexation is approved by the voters, current APL staff will be treated as regular
KCLS staff members in relationship to employment opportunities. For an APL vacancies
created as a result of the employment at KCLS, APL will back fill the position using
temporary staff members on a temporary basis. The provisions in this agreement will not
apply to the temporary placements.
• Once annexation is approved by the voters, KCLS will invite current APL staff to attend
KCLS internal training opportunities, on a space available basis.
As of the effective date of annexation, APL staff members accepting positions with KCLS will
become employees of KCLS. APL staff members will receive the same benefits and be held to
the same expectations as all KCLS staff members. KCLS is not bound by any employment
agreements or personnel policies granted or practiced by the City of Auburn.

RESOLUTION OF THE BOARD OF TRUSTEES OF THE KING COUNTY RURAL LIBRARY
DISTRICT CONCURRING, SUBJECT TO CONDITION, WITH THE ANNEXATION OF
THE CITY OF AUBURN INTO THE KING COUNTY RURAL LIBRARY DISTRICT
WHEREAS, the City of Auburn has passed an ordinance which initiates the process for a special
election to determine whether the Auburn shall be annexed into the King County Rural Library
District, and
WHEREAS, RCW 27.12 provides a process for the annexation of cities and towns into rural
library districts, and
WHEREAS, the Board of Trustees believes that the annexation would be in the best interest of all
involved, and
WHEREAS, the several steps to be taken to meet the boundary changes requirements necessitate
the taking of this action by the Library District.
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE KING COUNTY RURAL
LIBRARY DISTRICT THAT
The Board of Trustees of the King County Rural Library District does hereby concur with the City
of Auburn in its intent to annex to the King County Rural Library District.
