HomeMy WebLinkAbout2792 1 RESOLUTION NO 2_2_9_2 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK OF THE CITY 4 OF AUBURN, TO EXECUTE A CONTRACT BETWEEN THE CITY OF AUBURN AND DOMESTIC ABUSE WOMEN' S NETWORK (DAWN) RELATING TO FUNDS 5 RECEIVED FROM A PORTION OF THE CRIMINAL JUSTICE TWO PERCENT 6 SALES TAX REVENUES RECEIVED BY THE CITY PURSUANT TO RCW 82 14 340 TO PROVIDE DOMESTIC VIOLENCE COMMUNITY ADVOCACY 7 SERVICES FOR 1997 8 9 WHEREAS, the CITY has approved the expenditure of a 10 portion of the Criminal Justice two percent sales tax revenues 11 received by the City y pursuant to RCW 82 14 340 for domestic 12 violence community advocacy services; and 13 WHEREAS, the CITY desires to award these funds to DAWN to 14 15 perform domestic violence community advocacy services pursuant 16 to certain terms and conditions as described in this contract ; 17 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, 18 WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH 19 RESOLVES THAT 20 21 Section 1. and 14 WHEREAS, the CITY desires to award a portion of these 15 funds to DAWN to perform services pursuant to certain terms 16 and conditions as described in this Contract; 17 NOW, THEREFORE, IN CONSIDERATION of the mutual benefits 18 and conditions hereinafter contained, the parties hereto agree 19 as follows 20 1 PURPOSE 21 The purpose of this Contract is to provide a portion of 22 the criminal justice two percent sales tax revenues received 23 by the city pursuant to RCW 82 14 340 to provide domestic 24 violence community advocacy services to domestic violence 25 26 Resolution No.2792 DAWN-Community Advocate Exhibit "A" <daun97ca) July 22, 1997 Page 1 1 2 victims residing within the jurisdictional boundaries of the 3 CITY 4 2 SCOPE OF SERVICES 5 The parties agree and understand that DAWN agrees to 6 provide community advocacy services for victims of domestic 7 violence 8 A DAWN will provide a half-time community advocate (s) 9 to serve CITY residents who are victims of domestic violence 10 DAWN will provide outreach services to the Auburn 11 community Such outreach services will include 12 a Public information activities aimed at 13 informing the general public of the services 14 available through DAWN 15 b Working with the general public to enhance the 16 understanding of domestic violence as a 17 reprehensible social and criminal act 18 c Conduct outreach to unserved and underserved 19 special populations to allow access to victims 20 who would not otherwise seek assistance 21 d Conduct outreach in a culturally relevant 22 manner consistent with the social norms of the 23 population (s) being served 24 25 26 Resolution No.2792 DAWN-Community Advocate Exhibit"A" Cdawn97ca) July 22, 1997 Page 2 1 2 e Ongoing knowledge of and contact with other 3 community resources 4 f Post information on domestic violence in 5 hospitals, community clinics and with other 6 community organizations providing resources to 7 the potential client population 8 DAWN will provide intervention and ongoing advocacy 9 to victims of domestic violence 10 Priority will be given to victims in the most 11 immediate danger 12 D Services will be provided in such a way that the 13 rights and needs of the victims, which include children, 14 are addressed 15 a The first priority will be the safety of the 16 victims of domestic violence 17 Services will be delivered in a manner 16 sensitive to the needs of the individual but 19 without prejudice based upon race, color, sex, 20 religion, nationality, creed, marital status, 21 sexual orientation, age or presence of any 22 sensory, mental or physical handicap 23 24 25 26 Resolution No. 2792 DAWN-Community Advocate Exhibit "A" Cdawn97ca) July 22, 1997 Page 3 1 2 Services will be delivered in such a manner as 3 to clearly communicate to victims that help is 4 continually available and accessible 5 d Upon initial contact, assess the victims 6 current situation, develop an individual safety 7 plan, and make appropriate timely referrals 8 Educate victims on the cycle and dynamics of 9 domestic violence 10 f Provide information about obtaining safe and 11 affordable temporary housing 12 g Assist victims in securing necessary language 13 interpretation services 14 h Assist victims to obtain services which meet 15 special physical or emotional needs, including 16 services for the disabled 17 i Provide ongoing problem solving, advocacy 18 personal support and consultation to include 19 being available to the victim for emergency 20 situations 21 j Assist victims by conducting a comprehensive 22 needs assessment to determine long-term 23 choices, regardless of whether the victim 24 leaves home 25 26 Resolution No. 2792 DAWN-Community Advocate Exhibit"A" (dawn97ca) July 22, 1997 Page 4 1 2 E DAWN will coordinate with the local community 3 support systems to assist victims of domestic violence 4 Advocates will 5 a Assist and educate the victim how to access 6 other systems such as health care, counseling, 7 food banks safe or affordable housing, 8 childcare 9 b Referrals to CPS if necessary 10 c Child care referrals 11 d Referrals to support groups 12 e Work with the victim, children and educational 13 system to arrange for appropriate and safe 14 school setting 15 f Facilitate creation of support groups in cases 16 where those groups are not readily available 17 when funding allows 18 F DAWN will assist in establishing referral protocol 19 with local hospitals and other health related 20 services 21 G DAWN will work with the Regional Planning team to 22 develop a regional approach to domestic violence with specific 23 attention to 24 a Regional Training & Protocol Development ; 25 26 Resolution No. 2792 DAWN-Community Advocate Exhibit "A" (daun97ca) July 22, 1997 Page 5 1 2 b Management Information System (MIS) and Data 3 gathering; 4 Evaluation 5 3 TERM 6 The term of this Contract shall commence on January 1 , 7 1997 and will expire on December 31, 1997 8 4 COMPENSATION 9 As full and total payment for the services provided under 10 the terms of this Contract, the CITY agrees to pay DAWN the 11 total amount of TWENTY THOUSAND ONE HUNDRED DOLLARS ($20 , 100) 12 DAWN will submit a statement with documentation to the CITY 13 describing services and activities that it has rendered under 14 the terms of this Contract together with the source 15 documentation for hours of service delivered and the 16 activities provided and the CITY will pay such amount upon 17 proper submittal However, the final statement of services 18 rendered will be submitted on or before December 15 , 1997 19 5 INDEMNIFICATION 20 DAWN agrees to defend, indemnify, and hold harmless the 21 CITY, its elected and appointed officials, employees and 22 agents from and against any and all claims, demands and/or 23 causes of action of any kind or character whatsoever arising 24 out of or relating to services provided by DAWN, its 25 26 Resolution No.2792 DAWN-Community Advocate Exhibit"A" Cdawn97ca) July 22, 1997 Page 6 1 2 employees, volunteers or agents concerning any and all claims 3 by any persons for alleged injury or damage to persons or 4 property to the extent caused by the negligent acts, errors or 5 property to the extent caused by the negligent acts, errors or 6 omissions of DAWN, its employees volunteers or agents or 7 representatives In the event that any suit or claim for 8 damages based upon such claim, action, loss or damage is 9 brought against the CITY, DAWN shall defend the same as its 10 sole costs and expense; provided that the CITY retains the 11 right to participate in said suit if any principle of 12 governmental or public law is involved; and if final judgment 13 be rendered against the CITY and/or its officers, elected 14 officials, agents and employees or any of them or jointly 15 against the CITY and DAWN and their respective officers, 16 agents, volunteers, employees or any of them, DAWN shall fully 17 satisfy the same and shall reimburse the CITY any costs and 18 expense which the CITY has incurred as a result of such claim 19 or suit The provisions of this section shall survive the 20 expiration or termination of this Contract 21 6 INDEPENDENT CONTRACTOR/ASSIGNMENT 22 The parties agree and understand that DAWN is an 23 independent contractor and not the agent or employee of the 24 CITY and that no liability shall attach to the CITY by reason 25 26 Resolution No. 2792 DAWN-Community Advocate Exhibit"A" (dawn97ca) July 22, 1997 Page 7 1 2 of entering into this Contract except as provided herein The 3 City will not be responsible for withholding or otherwise 4 deducting federal income tax or social security payments, or 5 contributing to the State Industrial Insurance Program, or 6 otherwise assuming the duties of an employer with respect to DAWN and that neither DAWN or any employee of DAWN shall be 8 entitled to any benefits accorded city employees by virtue of 9 any services provided under the contract The services 10 required under this Contract may not be assigned or 11 subcontracted by DAWN without the prior written consent of the 12 CITY 13 7 INSURANC)3 14 DAWN shall procure and maintain for the duration of this 15 Contract insurance against claims for injuries to persons or 16 property which may arise from or in connection with services 17 provided by DAWN, its agents, employees or volunteers under 18 this Contract DAWN agrees to provide comprehensive general 19 liability insurance and shall maintain liability limits of not 20 less than ONE MILLION DOLLARS ($1, 000, 000) combined single 21 limit coverage per occurrence for bodily injury, personal 22 injury and property damage DAWN shall also provide and 23 maintain professional liability coverage including errors and 24 omissions coverage in the minimum liability amount of ONE 25 26 Resolution No.2792 DAWN-Community Advocate Exhibit "A" (daun97ca) July 22, 1997 Page 8 1 2 MILLION DOLLARS ($1, 000, 000) combined single limit per 3 occurrence for bodily injury, personal, injury and property 4 damage Any deductibles or self insured retentions in either 5 policies must be declared to and approved by the CITY At the 6 option of the CITY either The insurer shall reduce or 7 eliminate such deductibles or self insured retentions as 8 respects the CITY, its officials and employees ; or DAWN shall 9 procure a bond guaranteeing payment of losses and related 10 investigations, claim administration and defense expenses 11 The policies are to contain or be endorsed to contain the 12 following provisions 13 1 GENERAL LIABILITY COVERAGE: 14 (a) The CITY, its elected and appointed officials, 15 employees and agents are to be covered as insureds 16 as respects Liability arising out of services and 17 activities performed by or on behalf of DAWN, its 18 employees, agents and volunteers The coverage 19 shall contain no special limitations on the scope of 20 protection afforded to the CITY, its elected and 21 appointed officials, employees or agents 22 2 . GENERAL LIABILITY AND PROFESSIONAL LIABILITY 23 COVERAGES. 24 25 26 Resolution No. 2792 DAWN-Community Advocate Exhibit"A" Cdawn97ca) July 22, 1997 Page 9 1 2 (a) DAWN' s insurance coverage shall be primary 3 insurance as respects the CITY, its officials, 4 employees and agents Any insurance or self 5 insurance maintained by the CITY, its officials, 6 employees or agents shall be in excess of DAWN' s insurance and shall not contribute with it 7 8 (b) Any failure to comply with reporting provisions 9 of the policy shall not affect coverage provided to 10 the CITY, its officials, employees or agents 11 (c) Coverage shall state that DAWN' s insurance 12 shall apply separately to each insured against whom 13 claim is brought or suit is brought except with 14 respect to the limits to the insurer' s liability 15 (d) Each insurance policy required by this clause 16 shall be endorsed to state that coverage shall not 17 be suspended, voided, cancelled, reduced in 18 coverage, or in limits except after thirty (30) days 19 prior written notice by certified mail return 20 receipt requested has been given to the CITY DAWN 21 agrees to provide copies of the Certificates of 22 Insurance to the CITY at the time that this Contract 23 takes effect 24 25 26 Resolution No.2792 DAWN-Community Advocate Exhibit "A" (daun97ca) July 22, 1997 Page 10 1 2 (e) DAWN shall furnish the CITY with Certificates 3 of Insurance and with original endorsements 4 affecting coverage required by this clause The 5 certificate and endorsements for each insurance 6 policy are to be signed by a person authorized by that insurer to bind coverage on its behalf The 7 8 CITY reserves the right to require complete, 9 certified copies of all required insurance policies 10 at any time 11 (f) DAWN shall include all volunteers, employees 12 and agents under its policies or shall furnish 13 separate certificates and endorsements for each 14 All coverages for volunteers shall be subject to all 15 the requirements stated herein 16 8 NONDISCRIMINATION 17 DAWN may not discriminate under any services or programs 18 to which this Contact may apply directly or through 19 contractual or other arrangements on the grounds of race, 20 color, sex, religion, nationality, creed, marital status, 21 sexual orientation, age or presence of any sensory, mental or 22 physical handicap 23 24 25 26 Auditor ' s procedures, including 5 personnel, property, financial and programmatic records which 6 sufficiently reflect direct and indirect costs and services performed under this Contract DAWN agrees to maintain all 7 8 books and records relating to this Contract for a period of g six (6) years following the date that this Contract is expired 10 or otherwise terminated The parties agree that the CITY OF 11 AUBURN may inspect such documents upon good cause at any 12 reasonable time within the six (6) year period 13 10 TERMINATION OF AGREEMENT 14 This Contract may be terminated by either party upon ten 15 (10) days written notice should the other party fail 16 substantially to perform in accordance with its terms through 17 no fault of the other 18 11 GENERAL PROVISIONS 19 11 1 In addition to the reports required by this 20 Contract, DAWN agrees to submit a report to the CITY no later 21 than January 31, 1996 describing the progress and activities 22 performed for the year 1996 under its Scope of Services The 23 report shall include data regarding the type and level of 24 services provided to CITY residents as well as the number of 25 26 Resolution No.2792 laws, 5 regulations and ordinances of the CITY, the State of 6 Washington and County of King and where applicable, Federal laws 8 11 3 The CITY and DAWN respectively bind themselves, g their successors, volunteers, assigns and legal 10 representatives to the other party to this Contract and with 11 respect to all covenants to this Contract 12 11 4 This Contract represents the entire and 13 integrated Contract between the CITY and DAWN and supersedes 14 all prior negotiations This Contract may be amended only by 15 written instrument signed by both the CITY and DAWN 16 11 5 Should it become necessary to enforce any term 17 or obligation of this Contract, then all costs of enforcement 18 including attorneys fees and expenses and court costs shall be 19 paid to the substantially
