3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO
4 AN AGREEMENT BETWEEN THE CITY OF AUBURN AND AUBURN COMMUNITY
SUPPERS FOR 1997

6 THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A
7 REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES THAT
8 Section 1. The Mayor and City Clerk of the City of
9
Auburn are herewith authorized to enter into an Agreement
10
11 between the City of Auburn and AUBURN COMMUNITY SUPPERS, a
12 local non-profit charitable organization, to provide meals for
13 the needy, lonely, poor and infirm for 1997 A copy of said
14 Agreement is attached hereto and denominated Exhibit "A"
15
Section 2 . The Mayor is hereby authorized to implement
16
17 such administrative procedures as may be necessary to carry
18 out the directives of this legislation

THIS AGREEMENT is made and entered into this /y

,774. , 1997, by and between the CITY OF AUBURN,

WASHINGTON, a municipal corporation of the State of Washington
6
hereinafter referred to as "CITY" whose address is 25 W Main
7
St , Auburn, WA 98001, and AUBURN COMMUNITY SUPPERS, a local
8
non-profit charitable organization hereinafter referred to as
9
"AUBURN SUPPERS" whose address is First Methodist Church, 100
10
"N" Street S E , Auburn, Washington, WITNESSETH
11
WHEREAS, AUBURN SUPPERS has provided free wholesome meals
12
for the needy, lonely, poor and infirm once a week and has
13
filled a real need within the Auburn community; and
14
WHEREAS, AUBURN SUPPERS has a fine staff of volunteers
15
and several merchants have responded by donating perishable
16
food as well as government surplus meats and commodities; and
17
WHEREAS, AUBURN SUPPERS is in severe financial need to
18
continue the aforementioned civic program;
19
NOW, THEREFORE, for and in consideration of the benefits
20
to be derived by the parties hereto and the citizens of the
21
City of Auburn, and in consideration of the promises,
22
covenants, terms and conditions contained, the parties agree
23
as follows

2 1 PURPOSE
3 The purpose of this Agreement is to provide a
4 contribution by the CITY to AUBURN SUPPERS for their
5 provision of free wholesome meals once a week to the
6 needy, lonely, and infirm
2 SCOPE OF SERVICE
8 AUBURN SUPPERS shall provide once a week wholesome meals
9 to the needy, lonely, poor and infirm at no cost to the
10 recipients
11 3 COMPENSATION AND TERM OF AGREEMENT
12 The CITY shall contribute to AUBURN SUPPERS the sum of
13 TWO HUNDRED DOLLARS ($200 00) per month commencing
14 January 1, 1997, payable on the first of each month
15 through December 31, 1997 However, the final statement
16 of services rendered will be submitted on or before
17 December 15, 1997
18 4 STATUS REPORT
19 AUBURN SUPPERS shall at the request of the Auburn Finance
20 Director account to the CITY for the utilization of said
21 funds by billing the City monthly by invoice indicating
22 the number of meals served, to whom meals were served and
23 the cost thereof

2 5 NONDISCRIMINATION
3 AUBURN SUPPERS shall provide meals without discrimination
4 on account of race, color, creed, religion, national
5 origin, sex, age, or the presence of any sensory, mental
6 or physical handicap
6 TERMINATION OF AGREEMENT
8 This contract may be terminated by either party hereto by
9 giving thirty (30) days written notice of intent to
10 terminate to the other party
11 7 INDEMNIFICATION/HOLD HARMLESS
12 AUBURN SUPPERS agrees to defend, indemnify and hold
13 harmless the CITY, its elected and appointed officials,
14 employees and agents from and against any and all claims,
15 demands and/or causes of action of any kind or character
16 whatsoever arising out of or relating to AUBURN SUPPERS,
17 its employees, subcontractor or agents for any and all
18 claims by any persons for alleged personal injury, death
19 or damage to their persons or property to the extent
20 caused by the negligent acts, errors or omissions of
21 AUBURN SUPPERS its employees, agents, subcontractors, or
22 representatives In the event that any suit of claim for
23 damages based upon such claim, action, loss or damages is
24 brought against the CITY, AUBURN SUPPERS shall defend the
25 same at its sole cost and expense; provided that the CITY
26

2 retains the right to participate in said suit if any
3 principle of governmental or public law is involved; and
4 if final judgment be rendered against the CITY and/or its
5 officers, agents and/or employees or any of them or
6 jointly against the CITY and AUBURN SUPPERS and their
7 respective officers, agents, subcontractors, employees or
8 any of them, AUBURN SUPPERS agrees to fully satisfy the
9 same and AUBURN SUPPERS shall reimburse the CITY for any
10 cost and expense which the CITY has incurred as a result
11 of such claim or suit The provisions of this section
12 shall survive the expiration or termination of this
13 Agreement

Per your request, the below listed social service agency contracts are transmitted to
you. As you are aware, the City Council adopted the below listed Resolutions on
February 18, 1997 A copy of each resolution is provided along with the original
contracts that have been executed by the City of Auburn.
1) Resolution No. 2802
Authorizes an Agreement with Auburn Christian Action Program Day Care
(ACAP) for parenting classes during 1997
2) Resolution No 2803
Authorizes an Agreement with Auburn Christian Action Program Day Care
(ACAP) for child care services during 1997
3) Resolution No. 2804
Authorizes an Agreement with Auburn Community Suppers to provide meals for
the needy during 1997
4) Resolution No. 2805
Authorizes an Agreement with Auburn Youth Resources for support services for
youth and families in the Auburn Community for 1997
5) Resolution No. 2806
Authorizes an Agreement with Children's Home Society to provide child care
services through the families first program for 1997
6) Resolution No. 2807
Authorizes an Agreement for Services with Community Health Centers of South
King County to provide health services to Auburn residents during 1997
7) Resolution No. 2810
Authorizes an Agreement for Services with the Auburn Food Bank to purchase
and provide food to Auburn residents during 1997

Authorizes an Agreement with King County Sexual Assault Resource Center to
providing counseling services to rape and other sexual assault victims in the
Auburn area during 1997

Authorizes an Agreement with Valley Cities Counseling and Consultation to
provide mental health services for Auburn residents during 1997
10) Resolution No. 2813
Authorizes an Agreement for Services with Washington Women's Employment
and Education to provide employment training services to Auburn residents
participating in the Auburn Healthy Families Program during 1997
All agreements require a notarized signature from the appropriate social services
agency official. Additionally, a certificate of insurance naming the City of Auburn as an
additional insured is required to be on file with the original agreement that requests it.
Other provisions such as reports should be filed appropriately
