7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
8 WASHINGTON, DECLARING ITS INTENTION TO ORDER CONSTRUCTION OF
9 STREET IMPROVEMENTS INCLUDING THE CONSTRUCTION OF THE EAST
10 HALF-STREET, CURB AND GUTTER, SIDEWALK, DRIVEWAYS, WATER,
11 SEWER STUBS FOR FUTURE EXTENSION, STORM DRAINAGE, LIGHTING AND
12 UNDERGROUNDING EXISTING POWER TO "B" STREET N W AND OTHER
13 IMPROVEMENTS RELATED THERETO AND TO CREATE A LOCAL IMPROVEMENT
14 DISTRICT TO BE KNOWN AS LOCAL IMPROVEMENT DISTRICT NO 347 TO
15 ASSESS A PART OF THE COST AND EXPENSE OF CARRYING OUT THOSE
16 IMPROVEMENTS AGAINST THE PROPERTIES SPECIALLY BENEFITED
17 THEREBY, AND NOTIFYING ALL PERSONS WHO DESIRE TO OBJECT TO THE
18 IMPROVEMENTS TO APPEAR AND PRESENT THEIR OBJECTIONS AT A
19 HEARING BEFORE THE CITY COUNCIL TO BE HELD ON APRIL 21, 1997

22 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
23 AUBURN, WASHINGTON, as follows
24 Section 1 It is the intention of the City Council of
25 the City of Auburn, Washington, to order the improvement of
26 the properties within the area described in Exhibit A,
27 attached hereto and by this reference made a part hereof, and
28 the formation of a local improvement district to be known as
29 Local Improvement District No 347 ("LID No 347" or "LID") by
30 making street improvements including the construction of the

1 east half-street, including 24 foot pavement, curb and gutter,
2 sidewalk, driveways, water, sewer stubs for future extension,
3 storm drainage, lighting and undergrounding existing power to
4 "B" Street N W and other improvements related thereto
5 All of the foregoing improvements shall be in accordance
6 with the plans and specifications therefor prepared by the
7 City Engineer and may be modified by the City as long as that
8 modification does not affect the purpose of the improvements
9 Section 2 The total estimated cost and expense of the
10 LID is declared to be $935, 000 and approximately $80, 000 of
11 that cost and expense shall be paid by the City and the
12 balance thereof shall be borne by and assessed against the
13 property specially benefited by the improvements to be
14 included in LID No 347 to be established embracing as nearly
15 as practicable all the property specially benefited by the
16 improvements Actual assessments may vary from estimated
17 assessments as long as they do not exceed a figure equal to
18 the increased true and fair value the improvements add to the
19 property

1 Section 3 The City Clerk is authorized and directed to
2 give notice of the adoption of this resolution and of the
3 date, time and place fixed for the public hearing to each
4 owner or reputed owner of any lot, tract, parcel of land or
5 other property within LID No 347 by mailing such notice at
6 least fifteen days before the date fixed for public hearing to
7 the owner or reputed owner of the property as shown on the
8 rolls of the King County Assessor at the address shown
9 thereon, as required by law
10 This resolution also shall be published in at least two
11 consecutive issues of the official newspaper of the City, the
12 date of the first publication to be at least fifteen days
13 prior to the date fixed for the public hearing
14 Section 4 All persons who may desire to object to the
15 improvements are notified to appear and present those
16 objections at a hearing before the City Council to be held in
17 the Council Chambers in the City Hall in Auburn, Washington,
18 at 7 30 p m on April 21, 1997, which time and place are fixed
19 for hearing all matters relating to the improvements and all

1 objections thereto and for determining the method of payment
2 for the improvements All persons who may desire to object
3 thereto should appear and present their objections at that
4 hearing Any person who may desire to file a written protest
5 with the City Council may do so within 30 days after the date
6 of passage of the ordinance ordering the improvements in the
7 event LID No 347 is formed The written protest should be
8 signed by the property owner and should include the legal
9 description of the property for which the protest is filed and
10 that protest should be delivered to the City Clerk
11 Section 5 The City Engineer is directed to submit to
12 the City Council on or prior to April 21, 1997, all data and
13 information required by law to be submitted
