3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, KING
COUNTY, WASHINGTON, SETTING FORTH THE CITY' S INTENT TO ANNEX
4 CERTAIN PROPERTY KNOWN AS THE FENSTER PROPERTY FOR MUNICIPAL
PURPOSES

WHEREAS, the City of Auburn has acquired the Fenster
7
property, an approximate 9 acre parcel of property located
8
9 approximately on the east side of the City and contiguous to
10 the City of Auburn; and
11 WHEREAS, the property purchased is to be used for
12
municipal park purposes and therefore is for a municipal
13
14 purpose; and
15 WHEREAS, in accordance with RCW 35A 14 300 the City
16 Council may by majority vote annex such property for a
17 municipal purpose when owned by the City; and
18
WHEREAS, the subject property was acquired by the City on
19
20 February 14 , 1996
21 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
22 WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH

RESOLVES THAT

Section 1 . The City of Auburn intends to annex, for

municipal purposes, that property known as the Fenster
3
4 property which is adjacent to the east City of Auburn City
5 limits, which is legally described in Exhibit "A" attached
6 hereto and incorporated by reference as if set out in full
7
Section 2 . That the Planning Department is hereby
8
instructed to forward notice of intent to annex to the
9
10 Washington State Boundary Review Board for King County
11 Section 3 . The Mayor is hereby authorized to implement
12 such administrative procedures as may be necessary to carry
13
out the directives of this legislation
14

LEGAL DESCRIPTION
That portion of the southeast quarter of the southwest quarter of
Section 17, Township 21 North, Range 5 East, W M , in King County,
Washington which lies northerly of the northerly margin of the
Northern Pacific Railway Company's right-of-way;
EXCEPT that portion described as follows
Commencing at the intersection of Violet Street and River Drive in
East Auburn Garden Tracts, according to the plat thereof recorded in
Volume 18 of Plats, page 98, in King County, Washington;
thence south 0°42 '59" east along the centerline of Violet Street, a
distance of 660 06 feet;
thence north 89°55' 18" east, a distance of 4 50 feet to the TRUE
POINT OF BEGINNING;
thence south 0°36'42" east, a distance of 370 80 feet;
thence south 79°51'42" east, a distance of 226. 87 feet;
thence north 0°36' 42" west, a distance of 410 90 feet;
thence south 89°55' 18" west, a distance of 222 90 feet to the TRUE
POINT OF BEGINNING;
AND EXCEPT that portion described as follows
Beginning at a point on the north line of said southeast quarter of
the southwest quarter, 227 . 40 feet east from the northwest corner
thereof;
thence south 0°36'42" east 410 96 feet to the northerly line of the
Northern Pacific Railway Company's right-of-way;
thence along said northerly line south 79°51'42" east 206 27 feet;
thence north 0°36'42" west 447 49 feet, more or less, to the north
line of said southeast quarter of the southwest quarter;
thence west along said north line 202 98 feet, more or less, to the
place of beginning;
AND EXCEPT that portion of the said southeast quarter of the
southwest quarter described as follows
Beginning at a point on the north line of said southeast quarter of
the southwest quarter, 4 . 5 feet east from the northwest corner
thereof;
thence south 0°36'42" east 370 8 feet, more or less, to the
northerly line of the Northern Pacific Railway Company's
VI right-of-way;

line of said southeast quarter of the southwest quarter;

® TOGETHER WITH an easement for ingress and egress 20 feet wide over
CD and across that portion of the southeast quarter of the southwest
OA quarter of Section 17 , Township 21 North, Range 5 East, W.M. , in
King County, Washington, lying south of the Northern Pacific Railway
Company's right-of-way and northerly of the Auburn-Black Diamond
Road, said 20 foot easement being located 575 feet, more or less,
east of the west line of said southeast quarter of the southwest
quarter.
