3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, KING
COUNTY, WASHINGTON, REPEALING RESOLUTION NO 457, PASSED MARCH
4 15, 1971 TO COMPLY WITH THE HEARING EXAMINER' S DECISION ON
APPROVAL OF THE M A SEGALE, INC SURFACE MINING PERMIT TO
5 ALLOW FOR THE CONTINUED MINING ON A 254-ACRE SITE EAST OF
6 KERSEY WAY AND SOUTHERLY OF THE WHITE RIVER
7 WHEREAS, M A SEGALE, INC requested a surface mining
8 permit to allow for the continued mining on a 254-acre site
9
that lies east of Kersey Way and southerly of the White River,
10
Application MIN0003-90 and
11
12 WHEREAS, the above came on for public hearing May 7,
13 1997; and
14 WHEREAS, Hearing Examiner Diane L VanDerbeek decision of
15
May 15 , 1997 required the City to void Resolution No 457 upon
16
approval of the Ordinance that adopts the mining permit ; and
17
18 WHEREAS, the City Council has approved the Ordinance to
19 adopt the Surface Mining Permit
20 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
21
WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH
22
23 RESOLVES AS FOLLOWS

1 Section 1 . City of Auburn Resolution No 457, passed and

adopted by the City Council on March 15 , 1971, is herewith
3
repealed in its entirety

5 Section 2 . The Mayor is hereby authorized to implement
6 such administrative procedures as may be necessary to carry
out the directives of this legislation
8
