3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
4 WASHINGTON, AUTHORIZING THE MAYOR AND THE CITY CLERK TO
RELINQUISH A CITY OF AUBURN STREET IMPROVEMENT CONDITION
5 CREATED BY THE PLAT OF AUBURN 400 CORPORATE PARK, DIVISION 1

7 WHEREAS, the Plat of Auburn 400 Corporate Park, Division
8 1, filed for record October 19, 1984 , created a public street
9 improvement condition (Item 10) burdening the owners,
10
successors and assigns of Lots 34 and 35 of said plat ; and
11
WHEREAS, said street improvement condition lies within a
12
13 60 foot wide public utilities easement created by reservation
14 in street vacation Ordinance No 2017 dated April 17, 1967
15 said easement subsequently released and vacated by Ordinance
16
No 4306 dated September 19 , 1988 ; and
17
WHEREAS, the City of Auburn has determined the intent
18
19 and purpose of said condition is no longer required and is in
20 excess of City needs
21 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
22
WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH

RESOLVES AS FOLLOWS

1 Bection 1 ._ The Mayor and the City Clerk of the City of

Auburn are herewith authorized to relinquish a City of Auburn

public street improvement condition created by the Plat of
4
5 Auburn 400 Corporate Park, Division 1 as shown on Exhibit "A"
6 and to be executed by Exhibit "B" attached hereto, for the
7 purposes in excess of City needs
8
,section 2 . The Mayor is hereby authorized to implement
9
10 such administrative procedure as may be necessary to carry out
11 the directives of this legislation

WHEREAS the City has determined pursuant to Auburn City Council Resolution No.
that the public street improvement condition described in item 10 of said plat is in
excess of City needs and should be relinquished.
NOW, THEREFORE, the City hereby.
1 Relinquishes, releases and forever abandons any and all interest in the condition created
for public street improvements under item 10 of the plat of Auburn 400 Corporate Park,
Division 1, according to the plat thereof recorded in volume 128 of plats, pages 97 - 99,
in King County, Washington.
