HomeMy WebLinkAbout2914 1 RESOLUTION NO 2 9 1 4 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, KING COUNTY, WASHINGTON, OPPOSING THE KING COUNTY COUNCIL ADOPTION 4 OF THE TRANSFER OF DEVELOPMENT RIGHTS FINAL RECEIVING AREAS PLAN, DATED 10 NOVEMBER 1997 AS CURRENTLY WRITTEN, DRAFTED BY 5 THE KING COUNTY DEPARTMENT OF NATURAL RESOURCES 6 WHEREAS, the Lea Hill area, an approximately 5 5 square 7 mile area located east of the existing City limits, is within 8 the City of Auburn' s Potential Annexation Area (PAA) ; and, 9 WHEREAS, numerous parcels in the Lea Hill area, 10 illustrated in Figure 2-7 of the Transfer of Development 11 Rights Final Receiving Areas Plan (the PLAN) , have been 12 identified as potential Transfer of Development Rights (TDR) 13 receiving areas; and, 14 WHEREAS, based on the Figures provided as part of the 15 PLAN, the location of receiving areas Countywide does not 16 appear to be equally distributed throughout the unincorporated 17 urban area; the communities in the southern portion of the 18 County appear to have more parcels identified as receiving 19 areas and therefore will likely receive a disproportionate 20 impact from this proposed County program; and, 21 WHEREAS, negative impacts associated with increased 22 development densities (i e increased traffic, demand on 23 recreational services, etc ) within the Lea Hill area will 24 25 26 Resolution No 2914 January 28, 1998 Page 1 1 negatively affect the existing community and the City without 2 proper mitigation measures being put into place; and, 3 WHEREAS, no limit to the number of additional units has 4 been documented within the PLAN for any area; and, potential 5 figures from County staff concerning rural lots eligible for 6 TDR have ranged from the thousands to between fifty (50) and 7 one-hundred-and-twenty-five (125) for the entire Lea Hill 8 community; and, 9 WHEREAS, no provisions have been made to deal with Cities 10 annexing parcels participating in the TDR program, and the 11 guarantee that these parcels will be permitted to develop with 12 the transferred density and concurrently increased mitigation 13 obligations; and, 14 WHEREAS, many of the potential receiving parcels within 15 the Lea Hill area are not suitable for TDR due to existing 16 development , steep slopes, wetlands, etc ; and, 17 WHEREAS, City concerns regarding the PLAN, conveyed to 18 County staff, resulted in no changes to the program; and, 19 WHEREAS, adoption of the PLAN by the King County Council 20 without incorporating suggested revisions or conducting 21 additional analysis could result in adverse impacts on the 22 residents of Auburn and the Lea Hill area 23 24 25 26 Resolution No 2914 January 28, 1998 Page 2 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, 2 WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH 3 RESOLVES THAT 4 Section 1. The City Council opposes adoption of the 5 Transfer of Development Rights Final Receiving Areas Plan by 6 the County Council, as currently written 7 Section 2 . That, prior to adoption, the PLAN be revised, 8 addressing the following concerns of the City of Auburn 9 a Provide maximum limits for the number of TDR units to 10 be absorbed by each community, such as Lea Hill 11 b Establish requirements that addresses methods for 12 mitigating the impacts from traffic, recreational and 13 service impacts caused by the relocation of these 14 units to the identified receiving areas 15 c Only identify parcels suitable for receiving TDR 16 (revise Figures) 17 d Commence with discussions with cities on inter-local 18 agreement to provide for the long-term management of 19 this program 20 Section 3 . That the Mayor shall authorize the Planning 21 22 and Community Development Department to provide any 23 information available to the City to assist County staff with 24 revisions to the document 25 26 Resolution No 2914 January 28, 1998 Page 3 1 Section 4 .
