SCOPE OF WORK. The consultant shall accomplish the scope of services presented in 'Exhibit A" 3. TERM. Upon receipt from the CITY of written Notice to Proceed, the CONSULTANT shall substantially complete the analysis required for Subbasin groupings V & HV AA, A, B & Z by April 15 1998. The remainder of the scope of services shall be completed by June 30, 1998. The term of this agreement shall extend through December 31, 1999 The CITY may extend the period of the time set forth above for completion of the items of work upon written request from the CONSULTANT for such an extension due to delays which are beyond their control. 3 COMPENSATION. The compensation for these services to be paid to the CONSULTANT shall be on a time- and-material basis. Compensation to CONSULTANT shall be "Direct Job Wages" times a factor of 3 1 plus "Reimbursable Expenses" times a factor of 110 plus "Subconsultant Expenses" times a factor of 115 An estimate of expenditures is included as "Exhibit B " The compensation for these services will not exceed S 190,100. 4 RESPONSIBILITY OF CONSULTANT , cs a9 tee cxhh.M Agreement for Professional Services Februar 9 1998 Page 1 of 9 The CONSULTANT shall be responsible for the professional quality technical accuracy, timely completion and the coordination of all studies, analysis, designs, drawings, specifications, reports and other services performed by the CONSULTANT under this Agreement. The CONSULTANT shall, without additional compensation, correct or revise any errors, omissions or other deficiencies in its plans, designs, drawings, specifications, reports and other services required. The CONSULTANT shall perform its services to conform to generally accepted professional engineering standards and the requirements of the CITY Any approval by the CITY under this Agreement shall not in any way relieve the CONSULTANT of responsibility for the technical accuracy and adequacy of its services. Except as otherwise provided herein, neither the CITY'S review, approval or acceptance of nor payment for any of the services shall be construed to operate as a waiver of any rights under this Agreement or of any cause of action arising out of the performance of this Agreement to the full extent of the law 5 INDEMNIFICATION/HOLD HARMLESS. The CONSULTANT shall indemnify and hold the CITY and its officers and employees harmless from and shall process and defend at its own expense all claims, demands, or suits at law or equity arising in whole or in part from the CONSULTANT's negligence or breach of any of its obligations under this Agreement, provided that nothing herein shall require a CONSULTANT to indemnify the CITY against and hold harmless the CITY from claims, demands or suits based solely upon the conduct of the CITY their agents, officers and employees and provided further that if the claims or suits are caused by or result from the concurrent negligence of(a) the CONSULTANT's agents or employees and (b) the CITY their agents, officers and employees, this indemnity provision with respect to (1) claims or suits based upon such negligence, (2) the costs to the CITY of defending such claims and suits, etc shall be valid and enforceable only to the extent of the CONSULTANT's negligence or the negligence of the CONSULTANT's agents y Agreement for Professional Services February 9 1998 Page 2 of 9 or employees. The provisions of this section shall survive the expiration or termination of this Agreement. 6. INDEPENDENT CONTRACTOR/ASSIGNMENT. The parties agree and understand that the CONSULTANT is an independent contractor and not the agent or employee of the CITY and that no liability shall attach to the CITY by reason of entering into this Agreement except as otherwise provided herein. The parties agree that this Agreement may not be assigned in whole or in part without the written consent of the CITY 7 INSURANCE. CONSULTANT shall procure and maintain for the duration of this Agreement, commercial general liability insurance against claims for injuries to persons or damage to property which may arise from or in conjunction with services provided to the CITY by the CONSULTANT its agents, employees or subcontractors, under this Agreement. The CONSULTANT agrees to provide commercial general liability insurance and shall maintain liability limits of no less then ONE MILLION DOLLARS ($1,000,000) per occurrence and ONE MILLION DOLLARS ($1,000,000) general aggregate. The CONSULTANT shall also provide and maintain professional liability coverage in the minimum liability limits of ONE MILLION DOLLARS ($1,000,000) per claim and ONE MILLION DOLLARS (S1.000,000) aggregate. The general liability coverage shall also provide that the CITY its officers. employees and agents are to be covered as additional insured as respects. Liability arising out of the services or responsibilities performed by or under obligation of the CONSULTANT under the terms of this Agreement. by the CONSULTANT its employees, agents and subcontractors. Both the General liability and professional liability coverage shall provide that the CONSULTANT's insurance coverage shall be primary insurance as respects the CITY its Agreement for Professional Services February 9 1998 Page 3 of 9 officials, employees and agents. Any insurance or self insurance maintained by the CITY, its officials, employees or agents shall be excess to the CONSULTANT's insurance and shall not contribute with it. Each insurance policy required by this section of the Agreement shall be endorsed to state that coverage shall not be suspended, voided, or canceled except when thirty (30) days prior written notice has been given to the CITY by certified mail return receipt requested. All insurance shall be obtained from an insurance company authorized to do business in the State of Washington. The CONSULTANT agrees to provide copies of the certificates of insurance to the CITY specifying the coverage required by this section within 14 days of the execution of this Agreement. The CITY reserves the right to require that complete, certified copies of all required insurance policies be submitted to the CITY at any time. The CITY will pay no progress payments under Section 3 until the CONSULTANT has fully complied with this section. 8 NONDISCRIMINATION. The CONSULTANT may not discriminate regarding any services or activities to which this Agreement may apply directly or through contractual, hiring, or other arrangements on the grounds of race, color creed, religion, national origin, sex, age, or where there is the presence of any sensory, mental or physical handicap. 9 OWNERSHIP OF RECORDS AND DOCUMENTS., The CONSULTANT agrees that any and all drawings, computer discs, documents, records, books, specifications, reports, estimates, summaries and such other information and materials as the CONSULTANT may have accumulated prepared or obtained as part of providing services under the terms of this Agreement by the CONSULTANT shall belong to and shall remain the property of the CITY OF AUBURN In addition, the CONSULTANT agrees to maintain all books and records relating to its operation and concerning this Agreement for a period of six (6) years following the date that this Agreement is expired or otherwise terminated. The CONSULTANT further agrees that the CITY may inspect any and all documents held by the CONSULTANT and relating to this Agreement upon good cause at any reasonable time within the six (6) year period. The CONSULTANT also agrees to provide to the CITY at the CITY'S request, the originals of all drawings, documents, and items specified in this Section and information compiled in providing services to the CITY under the terms of this Agreement. Reuse by the City of any of the drawings, computer discs, documents, records, books, specifications, reports, estimates, summaries and such other information and materials on extensions of this project or any other project without the written permission of the CONSULTANT shall be at the CITY'S sole risk and the CITY agrees to defend, indemnify and hold harmless the CONSULTANT from all claims, damage and expenses including attorney's fees arising out of such unauthorized reuse of the CONSULTANTS drawings, computer discs, documents, records, books, specifications, reports, estimates, summaries and such other information and materials by the CITY, its officials, employees, agents, or others that may obtain the information from the CITY 10 TERMINATION OF AGREEMENT, This Agreement may be terminated by either party upon twenty (20) days written notice to the other party, and based upon any cause. In the event of termination due to the fault of others) than the CONSULTANT, the CONSULTANT shall be paid by the CITY for services performed to the date of termination. Upon receipt of a termination notice under the above paragraph, the CONSULTANT shall (1) promptly discontinue all services affected as directed by the written notice, and (2) deliver to the CITY all data, drawings, specifications, reports, estimates, summaries, and such other information and materials as the CONSULTANT may have accumulated, prepared or obtained in performing this Agreement, whether completed or in process. 11 GENERAL PROVISIONS. Agreement for Professional Ser^ices Februar, 9 1998 Page 5 of 9 11 1 This Agreement shall be governed by the laws, regulations and ordinances of the City of Auburn, the State of Washington, King County, and where applicable, Federal laws. 11.2. All claims, disputes and other matters in question arising out of or relating to, this Agreement or the breach hereof, except with respect to claims which have been waived, will be decided by a court of competent jurisdiction in King County Washington. Pending final decision of a dispute hereunder the CONSULTANT and the CITY shall proceed diligently with the performance of the services and obligations herein. 11.3 The CITY and the CONSULTANT respectively bind themselves, their partners, successors. assigns, and legal representatives to the other party to this Agreement with respect to all covenants to this Agreement. 11 4 This Agreement represents the entire and integrated Agreement between the CITY and the CONSULTANT and supersedes all prior negotiations, representations or agreements either oral or written. This Agreement may be amended only by written instrument signed by both the CITY and the CONSULTANT 11.5 Should it become necessary to enforce any term or obligation of this Agreement, then all costs of enforcement including reasonable attorneys fees and expenses and court costs shall be paid to the substantially prevailing party 11 6. The CONSULTANT agrees to comply with all local, state and federal laws applicable to its performance as of the date of this Agreement. 11 7 If any provision of this agreement is invalid or unenforceable, the remaining provisions shall remain in force and effect. The plan identified flooding problems throughout much of the City and, based on a preliminary analysis, provided alternative solutions for eliminating the flooding problems. Since 1990, there has been many activities affecting the original Drainage Plan recommendations. This has caused Auburn to identify a need to update the 1990 Plan. The needed updates fall into the following categories: 1 Update 1990 basin plans by either - documenting that no changes have occurred in a basin since 1990 affecting the original recommendations - documenting improvements that have already been implemented in some basins - conducting new analysis and providing updated recommendations in basins where new information has come available or development decisions made since 1990. 2. Add completed basin plans from annexation areas into Comprehensive Plan Update (Boeing; Lakeland Hills; municipal airport) 3 Conduct new analysis and provide recommendations in annexation areas not included previously in 1990 Plan (emphasis will be on "basin" tacilites, with refinement to trunk system level-ot-detail). Subbasms A, B, Z, AA, H, and HV have been identified by the City as having the highest priority for the Plan Update. The following scope of services descnbes the tasks and estimated level-of-effort for the initial phase of updating the Auburn Comprehensive Drainage Plan, focusing on the above noted subbasins Other subbasins and potential annexation areas will have a lesser level-ot-effort at this time and will identify more detailed analysis needed for a future phase of work. In addition, future work will include an analysis of funding, in coordination with the City s rate structure consultant, development of a city-wide capital improvement program, and compiling all basin reports into a Comprehensive Drainage Plan Update document. Task 1. Project Administration This task includes project administration between KCM and the City, coordination of subconsultants, and preparation of a project plan and monthly progress reports. ✓ 1 1 Prepare a project plan to provide clear direction to team members at the start of the project. A start-up meeting by the project team is included at the beginning of the project to discuss issues and the project requirements for the final deliverable. 1.2 Monitor the project schedule and budget to ensure conformance with the project contract. 1.3 Prepare progress reports to accompany monthly invoices. Task 2. Subbasin Grouping V, HV There have been many proposed changes/updates in Subbasins V and HV since completion of the 1990 Plan. These changes include development of a wetland mitigation site and compensatory flood storage area by the Port of Seattle, formation of the I Street LID, extension of S. 277th Street, and related adjustments to areas suitable for development. This task will document these proposed changes/updates and re- evaluate the recommendations originally included in the 1990 Plan. The outstanding issue for the City is whether the wetland mitigation site / compensatory storage area can also serve as a stormwater detention facility 2.1 Assemble Data / Maps / SWMM Model. Obtain available information from the City, including but not limited to topographic survey, inventory and subbasin maps, utility record drawings for storm, sanitary sewer and water pipelines, drainage complaints, and the SWMM model from the 1990 Plan. 2.2 Verify / Update Existing SWMM Model. The existing conditions input files for Subbasins V and HV will be verified using the storm drainage utility information and the subbasin maps collected from the City to check for consistency Discrepancies will be documented and resolved in the data input tiles. Once the SWMM input tiles have been verified, the models will be run to verity that the results are consistent with the model results presented in the 1990 Plan. The 10-, 25-, and 100-year return frequency storm events, assuming an SCS 24-hour duration Type IA hyetograph distribution, will be modeled. Future land use, consistent with the current zoning map for the City of Auburn, will be assumed for all computer runs. The level-of-effort estimated for this sub-task assumes that the SWMM models for the existing drainage networks in the subbasins are completely represented by the models and minimal effort will be required by KCM to get them to run. The 1990 Plan used Version 4.03 (February 1989) of the EPA's SWMM model, while this analysis will be using Version 2.04 (March 1996) of the XP-SWMM model. The XP- SWMM model is an upgraded version of the original SWMM model, and hence, model results may differ Model results that differ from those presented in the 1990 Plan will be documented. 2.3 Document Planned Projects/ Update SWMM Model. Document proposed changes and updates since the 1990 Plan, including development of a wetland mitigation site by the Port of Seattle, formation of the I Street LID, extension of S. 277th Street, development of a compensatory flood storage area, and related adjustments to areas suitable for development. Modify the XP-SWMM model for the subbasins as needed to reflect these proposed changes. 2.4 Identify Problem Areas: Identity any problem areas that will still exist with the proposed changes for these subbasins, as well as document that the combination of proposed individual projects can be linked without creating new problems. 2.5 Evaluate Alternatives. Based on problem areas identified in the previous task, evaluate up to two alternatives for eliminating the flooding problems on a basin-wide basis. At this time the two alternatives envisioned for this area are joint use of the Port's mitigation area or development of another site. 2.6 City / Project Team Meetings: Two project team meetings and a presentation to Council are scheduled with the City to review completed work on identifying problems, the initial evaluation of alternative solutions, and selection of the preferred alternative for the subbasms. 2.7 Preferred Alternative Recommendation. Following the first progress meeting with the City, the preferred alternative will be developed further to finalize costs, calculate benefits on a per acre basis, and identify project implementation considerations. 2.8 Draft Chapter far Cmnprehensrve Plan Update. All analysis completed for the subbasins will be documented in a format consistent with the final comprehensive plan update. The report written for these subbasins will become a chapter of the Comprehensive Plan Update without any further editing. Task 3. Subbasin AA There have been proposed changes/updates in Subbasin AA since completion of the 1990 Plan. These changes primarily include land swaps, land conversion for wetlands and development, and provisions for compensatory flood storage and stormwater detention. This task will document these proposed changes/updates and re-evaluate the recommendations originally included in the 1990 Plan. 3 1 Assemble Data / Maps / SWMM Model. Modify the XP-SWMM model for the subbasin as needed to reflect these proposed changes. 3 4 Wetland Assessment This task describes preliminary wetland permitting assistance and on-site wetland mitigation planning for a proposed regional detention facility in Subbasin AA on an approximately 38-acre site located south of S. 277th Street and east of State Route 167 The wetland assessment will be conducted by KCM subconsultant Springwood Associates, Inc. as part of the City s Comprehensive Plan update for this subbasin. Subtasks assigned to Springwood include agency coordination and conceptual mitigation design. 3 4 1 Site Analysis This task includes reviewing background information and obtaining COE confirmation of the wetland delineation (completed by others). 3 4 11 Review Background Information Collect and review the existing Wetland Delineation Report, as well as other existing information including topographic maps of the property, floodplain maps, stream and stormwater drainage maps. 3 4.1.2 Confirm the Wetland Delineation Site Visits: Springwood will conduct site visits with the City and regulatory agency personnel to verity wetland boundaries and confirm the existing wetland delineation. Coordination. Springwood will coordinate with the City and agency personnel. All communications will be documented in writing. 3.4.1.3 Preliminary Impact Assessment This task includes preparing a preliminary assessment of impacts resulting from construction of the proposed detention facility This task does not include a formal functional assessment, which may be required for this project at a later time. Coordination: Coordinate with KCM for preliminary facility design. 4 Prepare preliminary impact assessment: Based on preliminary facility design describe potential impacts from the proposed project by wetland type and acreage. 3 4.2 Preliminary Wetland Mitigation Plan 3.4.2.1 Conceptual Design (50%) Wetland Mitigation Design Criteria. Develop design criteria for the wetland mitigation based on preliminary engineering design. Determine Acceptable Mitigation Ratios: Review regulatory requirements for mitigation and determine the replacement ratios for proposed mitigation actions. Conceptual Grading Design. Based on preliminary engineering design, prepare a conceptual grading plan for in-house review Conceptual Planting Design. Based on preliminary hydrology information, prepare conceptual planting plans. Preliminary Acreage Estimate: Prepare a preliminary estimate of mitigation acreage to determine the necessity for additional otfsite mitigation. Conce tual Miti_ation Desi n Memorandum. Document the assumptions, design criteria, target mitigation ratios, mitigation concept, preliminary acreage calculations, and anticipated offsite mitigation requirements (it any) in a design memorandum for internal use and decision making. Coordination: One meeting with KCM and City staff regarding mitigation requirements and conceptual design development. One design meeting with KCM. 3 4.2.2 Wetland Mitigation Master Plan Draft Wetland Mitigation Master Plan Drawing Develop a Draft Wetland Mitigation Master Plan showing proposed plant communities, plant species by community, preliminary acreage estimates, and all potential mitigation activities the City will undertake. Submit for internal team review Final Wetland Mitigation Master Plan Drawing: Based on City and KCM review comments, develop the Final Wetland Mitigation Master Plan. The plan will be used in preliminary meetings with wetlands regulatory agencies. Coordination. One meeting with KCM and City staff regarding the total mitigation proposal plus miscellaneous communications. 3 4.3 Permit Assistance and Coordination An Individual 404(b)(1) wetland permit application and State 401 Water Quality Certiticate will be required for this protect State and local permits that may also be required include the State Hydraulic Project Approval (HPA), a Shorelines Master Permit, and permits administered by the City that are conditioned by the City Wetland Management Regulations. Task 3.4.1 includes coordinating with agencies with regulatory authority over wetlands and waters of the U.S. including the City, the U.S. Army Corps of Engineers (COE), U.S. Natural Resources Conservation Service (NRCS), U.S. Environmental Protection Agency (EPA), U.S. Fish & Wildlife Service (USFWS);' Washington State Department of Ecology (Ecology), Washington State Department of 5 Fish and Wildlife (WDFW) and Indian Tribes. All meetings and communications will be documented in writing 3 4 3 1 Preliminary Wetland Mitigation Permitting This task addresses preliminary meetings with agency personnel to review potential impacts and proposed mitigation concepts. On the basis of comments received, the mitigation design will be revised for permit submittal. Individual agency mitigation review meetings: Individual meetings will be held with key agencies to obtain early input and comment on proposed mitigation actions. If appropriate, these meetings will be combined. This task assumes two on-site field meetings and two office meetings. One additional meeting is budgeted. Coordination: Coordinate with KCM and City staff. Subbasin Grouping A, B, Z The 1990 Plan recommended the diversion of stormwater from Subbasin B to Subbasin E, and the development of additional stormwater detention through expansion of existing facilities and construction of new facilities. Since 1990, the City has elected to eliminate the stormwater diversion and to pursue alternative measures for solving flood problems in Subbasin B. Alternative measures to be considered include new detention facility sites through land purchases, maximizing infiltration and routing stormwater to the south towards the Stuck River 6 In a separate project, KCM has already assembled available data for the subbasins, verified and converted the SWMM models to XP-SWMM, and is making a preliminary evaluation of the infiltration opportunities in the area. Subbasin Grouping G, H, I There have been proposed changes/updates in the Subbasins G, H and I since completion of the 1990 Plan. These changes include 1990 recommended projects that have already been implemented and ongoing drainage plan development for the muuucipal airport. In addition, there are remaining elements from the 1990 Plan that still need to be constructed. 5 1 Assemble Data /Maps / SWMM Model. Obtain available information from the City, including but not limited to topographic survey, inventory and subbasin maps; utility record drawings for storm, sanitary sewer and water pipelines, drainage complaints; and the SWMM model from the 1990 Plan. 5 2 Verify / Update Existing SWMM Model. The existing conditions input files for Subbasins G, H and I will be verified using the storm drainage utility information and the subbasin maps collected from the City to check for consistency Discrepancies will be documented and resolved in the data input files. 7 Once the SWMM input tiles have been verified, the models will be run to verity that the results are consistent with the model results presented in the 1990 Plan. The 10-, 25-, and 100-year return frequency storm events, assuming an SCS 24-hour duration Type 1A hvetograph distribution, will be modeled. Future land use, consistent with the current zoning map for the City of Auburn, will be assumed for all computer runs. The level-of-effort estimated for this sub-task assumes that the SWMM models for the existing drainage networks in the subbasins are completely represented by the models and minimal effort will be required by KCM to get them to run. The Boeing plan will be summarized and included in the Auburn Comprehensive Plan Update. 15.1 Assemble Data / Projects: Obtain the drainage plan developed for the Boeing site within the South Annexation Area and summarize the analysis and recommendations contained in the plan. 15.2 Draft Chapter for Comprehensive Plan Update. White River West Area - Lakeland Hills Separate from the City's 1990 Plan, a drainage plan has been prepared for the Lakeland Hills development within the White River West Annexation Area. The Lakewood Hills drainage plan will be summarized and included in the Auburn Comprehensive Plan Update. The remainder of the White River West Annexation Area is scheduled for similar development. The Comprehensive Plan Update will designate this area as a 13 "special study area" to be analyzed in the future when a development plan is proposed to the City 16.1 Assemble Data/Projects: Obtain the drainage plan developed for the Lakeland Hills development within the White River West Annexation Area and summarize the analysis and recommendations contained in the plan. 16.2 Draft Chapter for Comprehensive Plan Update All analysis completed for the Lakeland Hills site will be documented in a format consistent with the final comprehensive plan update. West Area West is the designation given by Auburn to an area not previously included in the 1990 Plan. 21.1 Assemble Data/Maps: Obtain available information from the City and King County, including but not limited to topographic survey, inventory and subbasin maps; utility record drawings for storm, sanitary sewer and water pipelines, and drainage complaints. 27.2 Delineate Subbasin Boundaries. Using available topographic maps, and other information available from King County, delineate subbasin boundaries. Task 22. Stormwater Program Evaluation The Washington State Department of Ecology has implemented the Puget Sound Stormwater Program in response to stormwater policy presented in the Puget Sound Water Quality Management Plan. Under the program, Ecology requires all cities to implement a "Basic Stormwater Program" Ecology also requires jurisdictions in urbanized areas to complete and implement a range of activities in addition to the basic stormwater requirements. These additional requirements comprise a "Comprehensive Stormwater Program for Urbanized Areas" Auburn has been identified by Ecology as one of 52 municipalities required to meet the comprehensive stormwater program requirements. The following Scope of Work describes a compliance/deficiency evaluation of the Auburn Surface Water Management Program in relation to Ecology's Basic and Comprehensive Stormwater Programs for municipalities in the Puget Sounds basin. The Washington State Department of Ecology (Ecology) recently implemented the Puget Sound Stormwater Program in response to stormwater policy presented in the_, Puget sound Water Quality Management Plan. Under the program, Ecology requires 15 all cities and counties in the state to implement a "Basic Stormwater Program" by adopting the following. • A Stormwater Management Ordinance • A Stormwater Management Manual • A Best Management Practices (BMP) Manual • A Stormwater Maintenance Ordinance. Ecology also requires jurisdictions in urbanized areas to complete and implement a range of other activities in addition to the basic stormwater requirements. These additional requirements comprise a "Comprehensive Stormwater program for Urbanized Areas." At a minimum, the comprehensive program is required to include the following elements: • Pollutant Source Identification, Ranking, and an Ongoing Assessment Program • Investigations and Corrective Actions for Problem Storm Drains • Programs for Operation and Maintenance of the Stormwater System • A Water Quality Response Program to Investigate Sources of Water Quality Problems and Implement Compliance/Enforcement • Establishment of Local Coordination Arrangements such as Inter-local Agreements, Joint Programs, Consistent Standards, and Regional Boards of Committees. • A Stormwater Public Education Program • Inspection, Compliance, and Enforcement Measures • An Implementation Schedule • Retrofitting Existing Development or Treatment of Discharges from New and Existing Development, as Necessary The overall goal of this project will be completion of an evaluation of the City's current stormwater program to determine if the required elements of the Basic and Comprehensive Programs have been developed and are being implemented. If an element is being implemented, an evaluation will be made to determine if the scope and nature of the element meets the Ecology requirement for that element. Recommendations will be made for appropriate actions to be taken if it is determined that the element has not been developed and implemented, or only partially satisfies the Ecology requirement. 22.1 Document Review and Evaluation The objective of this task is to review all relevant City documents and evaluate the extent to which they put the City in compliance with Ecology requirements. KCM will. 16 1 Compile all relevant documents from the City of Auburn. These may include, but are not limited to, the following: • City ordinances • Stormwater management and basin plans • Comprehensive plan sections relating to stormwater • Pierce County and King County Surface Water Design Manuals • Other documentation describing program implementation. 2. Review all City documents to determine it and how they meet the Ecology requirements indicated in the following publications: • 'Guidance for Local Governments when Submitting Manuals and Associated Ordinances for Equivalency Review" (the Equivalency Guide) • "Stormwater Program Guidance Manual for the Puget Sound Basin" (the Program Manual). 3 Identify any changes needed to bring current City documents into compliance with Ecology requirements. Complete a series of "equivalency tables," similar to those contained in Ecology s Equivalency Guidance, listing the following: • Ecology requirement • Title of City document and, where applicable, section of City document where Ecology requirement is met • Adoption status of City document • Legal status of City Document (e.g., is it a legally binding document, has it been adopted by reference in an ordinance?) • Deficiencies in City documents • Other comments. Deliverables • Equivalency tables evaluating the City's current stormwater program relative to Ecology's requirements. 22.2 Activity Review and Evaluation Several of the requirements of the comprehensive stormwater program refer to ongoing implementation activities, rather than to a particular document or ordinance. The objective of this task is to determine which of the activities required by Ecology are currently being implemented by the City, any changes to these activities that may be necessary, and which activities are not currently being implemented by the City ' KCM will prepare a detailed list of the activity-oriented elements required by Ecology This list and an initial assessment of activities that have been completed or are planned 17 by the City will be prepared for review by the City A meeting between KCM and the City will then be held to discuss the list and initial assessment, and to acquire additional information. KCM will. 1 Prepare detailed list of the activity-oriented elements required by Ecology 2. Complete an initial assessment of City activities and how they meet Ecology requirements 3 Meet with Auburn to discuss KCM's initial assessment of the City's programs and compliance with Ecology requirements 4 Meet with the Department of Ecology to present and discuss the evaluation, provide a follow-up letter summarizing the discussion and direction 5 Revise the equivalency tables described in Task II.3 above to include activity-oriented elements and the following information. • Ecology requirements and comments • City activities that meet the requirements • Discussion of implementation (e.g., if a "one-time" activity has been planned or completed, how often a periodic activity is performed) • Deficiencies in City activities • Other comments. Deliverables • List of activity-oriented elements • Summary letter to the Department of Ecology • Final stormwater program equivalency tables. 22.3 Action Plans Information gathered in Tasks 22.1 and 22.2 will be used to develop an action plan for the City so that full compliance with all Comprehensive Program requirements can be achieved. The action plan will include level-of-effort cost estimates for development of documents or implementation of activities that have been found to be deficient. The action plan can then be used to establish priorities in a future work program. KCM will. 1 Develop a list of recommended actions based on the deficiencies listed in the equivalency table completed in Tasks 22.1 and 22.2 2. Prepare level-of-effort cost estimates to complete each of the recommended actions 18 3 Set priorities for the actions based on guidance in the Program Manual and equivalency tables 4. Prepare a Draft Stormwater Program Action Plan that presents the following: • Equivalency tables prepared in Tasks 22.1 and 22.2 • A prioritized list ot recommended actions based on equivalency tables • Level-of-effort cost estimates to complete each of the recommended actions 5 Revise draft action plan based on City review and written continents. Deliverables • One camera-ready copy of the Draft Stormwater Program Action Plan • One camera-ready copy ot the Final Stormwater Program Action Plan. 23.4 Coordination with Ecology The Department of Ecology is responsible for reviewing and approving municipal stormwater program. KCM will perform the following task: 1 Meet with Ecology to present and discuss the results of the project. 23.5 Draft Chapter for Comprehensive Plan Update All work complete for this task will be prepared as a chapter of the Comprehensive Plan Update. 19 KCM, Inc.
