3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AUTHORIZING THE CREATION OF AN INTERGOVERNMENTAL
4 AGREEMENT BETWEEN THE CITY OF AUBURN AND THE CITY OF EDMONDS
POLICE DEPARTMENT FOR THE PURPOSE OF SALE BY THE CITY OF
AUBURN OF TWO (2) SURPLUS RADIOS AND TWO (2) RADIO ACCESSORY
5 SETS TO THE CITY OF EDMONDS POLICE DEPARTMENT FOR POLICE
6 VEHICLE PURPOSES OF THE CITY OF EDMONDS POLICE DEPARTMENT
7 WHEREAS, Chapter 39 33 RCW entitled "Intergovernmental
8
Disposition of Property" provides for the sale of

property by any municipality to any other governmental body,
10
including but not limited to other municipalities; and
11
WHEREAS, the City of Auburn Surplus Property Unit is
12
converting to surplus public personal property two (2) radios
13
and two (2) radio accessory sets, described in Exhibit "A"
14
attached hereto and incorporated herein by this reference; and
15
WHEREAS, the City of Edmonds Department has indicated a
16
willingness to purchase the surplus radio equipment as
17
described in Exhibit "A" for the amount of Three Hundred Fifty
18
Dollars and no cents ($350 00) plus sales tax of 8 6% for a
19
total of Three Hundred Eighty Dollars and ten cents ($380 10)
20
for the radio units and radio accessory sets; and
21
WHEREAS, the City of Edmonds Police Department has
22
indicated that it will be utilizing the surplused radios and
23
radio accessory sets described in Exhibit "A" in police
24
vehicles for police purposes

1 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
2 WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH
3 RESOLVES AS FOLLOWS
4 Section 1 . The City of Auburn is authorized pursuant to
5
Chapter 39 33 RCW to sell public property to any other
6
governmental body, including but not limited to other
7
municipalities
8
Section 2 . The Surplus Property Unit of the City of
9
Auburn public personal property in the form of two (2) radios
10
and two (2) radio accessory sets, described in Exhibit "A" to
11
12 be converted to the status of surplus property
13 Section 3 . The City of Edmonds Police Department has
14 indicated a willingness to purchase the two (2) radios and two
15 (2) radio accessory sets surplused by the City of Auburn and
16 described in Exhibit "A" for the amount of Three Hundred Fifty
17 Dollars and no cents ($350 00) plus sales tax of 8 6% for a
18 total of Three Hundred Eighty Dollars and ten cents ($380 10)
19 Section 4 . The Mayor is hereby authorized to implement
20 such administrative procedures as may be necessary to carry
21 out the directives of this legislation

INTERGOVERNMENTAL AGREEMENT BETWEEN
CITY OF AUBURN AND CITY OF EDMONDS
FOR
SALE OF SURPLUS PROPERTY
THIS AGREEMENT is made and entered into this 4 day
of V Li , 1998 , by and between CITY OF
EDMONDS, a municipal corporation, hereinafter referred to as
"EDMONDS" and the CITY OF AUBURN, a municipal corporation
organized under RCW 35A, Optional Municipal Code,
hereinafter referred to as "AUBURN"
WHEREAS, AUBURN is a municipal corporation having
ownership of public personal property, among other things,
in the form of radio equipment; and
WHEREAS, Chapter 39 33 RCW entitled INTERGOVERNMENTAL
DISPOSITION OF PROPERTY provides for the sale of public
property by any municipality to any other governmental body,
including but not limited to other municipalities; and
WHEREAS, AUBURN' S Surplus Property Unit is converting
to surplus public personal property two (2) radios and two
(2) radio accessory sets , described in Exhibit "1" attached
hereto and incorporated herein by this reference; and
WHEREAS, EDMONDS has indicated a willingness to
purchase the surplus radio equipment as described in Exhibit

A for the amount of One Hundred Fifty Dollars and no cents
($150 00) for each radio unit and Fifty Dollars and no cents
($50 00) for each radio accessory, plus 8 6% sales tax for a
total of Three Hundred Eighty Dollars and ten cents
($380 10) ; and
WHEREAS, EDMONDS has indicated that it will be
utilizing the surplused radios in police vehicles as part of
EDMONDS Police Department ; and
WHEREAS, AUBURN agrees to sell to EDMONDS, for the sum
of Three Hundred Fifty Dollars and no cents ($350 00) plus
8 6% sales tax for a total of $380 10 for radios and radio
accessory sets as described in Exhibit A; and
NOW THEREFORE, the parties agree as follows
1 AUBURN shall surplus two (2) radios and two (2)
radio accessory sets presently considered as public personal
property of AUBURN; and
2 EDMONDS agrees to pay to AUBURN the sum of Three
Hundred Fifty Dollars and no cents ($350 00) plus 8 6% sales
tax for a total of $380 10 for radios and radio accessory
sets surplused by AUBURN; and
3 AUBURN agrees to deliver to EDMONDS two (2) radios
and two (2) radio accessory sets upon payment of Three
Hundred Fifty Dollars and no cents ($350 00) plus 8 6% sales

tax for a total of $380 10 and pursuant to the terms
contained within this INTERGOVERNMENTAL AGREEMENT
4 WARRANTY - GUARANTY
AUBURN makes no warranty or guaranty as to
condition of the surplus radios and radio accessory sets at
time of purchase Purchase by EDMONDS of the two (2)
surplus radios and two (2) radio accessory sets is on an "AS
IS" basis
5 SEVERABILITY
If any provision of this Agreement is determined
to be invalid or unenforceable for any reason the remaining
provisions shall remain in force and effect
