HomeMy WebLinkAbout2930 1 RESOLUTION NO 2 9 3 0 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE 4 THE CONVEYANCE OF PUBLIC SANITARY SEWER EASEMENTS ALONG WITH ASSIGNMENTS OF PUBLIC SANITARY SEWER EASEMENTS FROM THE CITY OF 5 AUBURN TO METROPOLITAN KING COUNTY 6 WHEREAS, the City Council of the City of Auburn approved 7 Resolution No 2795 authorizing a Facilities Acquisition 8 Agreement, dated February 21, 1997, between the City of Auburn g and King County to transfer of the City' s interest in the West 10 Valley Interceptor Sewer, the Lakeland Hills Pump Station and 11 the Lakeland Hills Force Main to Metropolitan King County; and 12 WHEREAS, said Agreement authorized the City to convey to 13 Metropolitan King County the sewer facilities described therein 14 along with ingress and egress easement rights; and 15 WHEREAS, the attached Assignment of Easement Agreement, 16 Exhibit 1, conveys the easement rights of ingress and egress to 17 the facilities as authorized in said resolution no 2795 ; and 18 WHEREAS, the City had subsequently acquired fee ownership 19 interests in real properties encumbered by easement rights also 20 owned by the City for said sewer facilities; and 21 WHEREAS, when easement ownership and fee title on which 22 the easement is located become vested in the same person, the 23 resulting merger of these rights terminates the easement, 24 25 26 Resolution No 2930 March 12, 1998 Page 1 1 therefore the attached easements in Exhibits 2 , 3 and 4 , are 2 required in affirmation by Metropolitan King County 3 THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A 4 REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES AS FOLLOWS 5 Section 1 . The Mayor and the City Clerk of the City of 6 Auburn, Washington, are hereby authorized to assign all those 7 easements as shown on Exhibit 1 attached hereto and to convey 8 those easements as shown on Exhibits 2 , 3 , and 4 attached 9 hereto to Metropolitan King County Exhibit 5 attached hereto 10 depicts the general locations of the actions described herein 11 Section 2 .
