HomeMy WebLinkAbout2959 1 RESOLUTION NO 2 9 5 9 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, 3 WASHINGTON, AUTHORIZING THE MAYOR TO EXECUTE A PUBLIC WATERMAIN EASEMENT BETWEEN THE CITY OF AUBURN WATER UTILITY 4 ENTERPRISE FUND AND THE LAKEHAVEN UTILITY DISTRICT 5 THE COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A 6 REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES THAT 7 8 Section 1 The Mayor of the City of Auburn is herewith 9 authorized to execute a public watermain easement between the 10 City of Auburn Water Utilities Enterprise Fund and the 11 Lakehaven Utility District A copy of said easement is 12 13 denominated as Exhibit "A" and a map of said easement 14 dominated as Exhibit "B" is attached hereto and incorporated 15 herein 16 SECTION 2 . SW 11-21-04 Additional on page: Assessor s Tax Parcel MTh 112104-9009-00 For and in consideration of the sum of ten dollars ($10 00) and other good and valuable consideration, receipt of which is hereby acknowledged, and for benefits to be derived by the Grantor herein, Grantor, City of Auburn, a municipal corporation, (Utility Enterpnse Fund), hereby conveys and warrants to the Lakehaven Utility District, Grantee herein, a municipal s-1 corporation, of King County, Washington, its successors and assigns, a perpetual Nonexclusive Easement under, over, through and across the following described real property for the purpose of laying, maintaining, and mstalling a Public Watermain AND APPURTENANCES THEREOF, said real property being described as follows: SEE EXHIBIT "A", ATTACHED HERETO AND BY THIS REFERENCE MADE A PART HEREOF Said Grantee shall have the absolute right, at times as may be necessary, for immediate entry upon said Easement for the purpose of maintenance, inspection, construction, repair or reconstruction of the above improvements without incurring any legal obligation or liability therefore. Said Grantee shall have the absolute nght to place any type of driving surface within said Easement deemed necessary by the Grantee. Said Grantor shall not in any way block, restnct or impede access and egress to or from said Easement, and/or in any way block, restrict or impede full use of the real property within the above-described Easement by said Grantee for the above-described purposes.
