A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
3 WASHINGTON, AUTHORIZING THE MAYOR TO EXECUTE A PUBLIC
WATERMAIN EASEMENT BETWEEN THE CITY OF AUBURN WATER UTILITY
4 ENTERPRISE FUND AND THE LAKEHAVEN UTILITY DISTRICT

THE COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A

REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES THAT
7

Section 1 The Mayor of the City of Auburn is herewith
9
authorized to execute a public watermain easement between the
10
City of Auburn Water Utilities Enterprise Fund and the
11
Lakehaven Utility District A copy of said easement is
12
13 denominated as Exhibit "A" and a map of said easement
14 dominated as Exhibit "B" is attached hereto and incorporated
15 herein
16 SECTION 2 . The Mayor is hereby authorized to implement
17 such administrative procedures as may be necessary to carry
18 out the directives of this legislation

For and in consideration of the sum of ten dollars ($10 00) and other good and valuable
consideration, receipt of which is hereby acknowledged, and for benefits to be derived by the
Grantor herein, Grantor, City of Auburn, a municipal corporation, (Utility Enterpnse Fund),
hereby conveys and warrants to the Lakehaven Utility District, Grantee herein, a municipal
s-1 corporation, of King County, Washington, its successors and assigns, a perpetual Nonexclusive
Easement under, over, through and across the following described real property for the purpose
of laying, maintaining, and mstalling a Public Watermain AND APPURTENANCES
THEREOF, said real property being described as follows:
SEE EXHIBIT "A", ATTACHED HERETO AND BY THIS REFERENCE MADE A
PART HEREOF
Said Grantee shall have the absolute right, at times as may be necessary, for immediate entry
upon said Easement for the purpose of maintenance, inspection, construction, repair or
reconstruction of the above improvements without incurring any legal obligation or liability
therefore.
Said Grantee shall have the absolute nght to place any type of driving surface within said
Easement deemed necessary by the Grantee.
Said Grantor shall not in any way block, restnct or impede access and egress to or from said
Easement, and/or in any way block, restrict or impede full use of the real property within the
above-described Easement by said Grantee for the above-described purposes. Said Grantor may

fence across said Easement and/or along the boundaries of said Easement provided that a gate is ,.
constructed in said fence. Said gate shall be of sufficient length and location to allow the Grantee
full use of, and access and egress to and from the real property within the above-described
Easement. If said gate is to be locked, keys shall be provided to the Grantee.
This Easement shall be a covenant running with the above-described real property and burden
said real estate, and shall be binding on the successors, heirs and assigns of all parties hereto

EXHIBIT "A"
All that certain real property situate in the City of Auburn, King County, State of Washington,
being a portion of the Northeast Quarter of the Southwest Quarter of Section 11, Township 21
North, Range, 4 East, Willamette Meridian, and being also a portion of that certain parcel of land
conveyed to the City of Auburn, as described in deed and recorded under Recorder's File No.
463082, King County Records, described as follows:
Commencing at the Northeast Corner of said City of Auburn parcel, said point being the Center
of Section 11, Thence, South 01°11'50" West along the North-South centerline of Section 11, a
distance of 110.00 feet, to the TRUE POINT OF BEGINNING of the herein described 20 00 foot
wide easement strip;
THENCE, continuing along the North-South centerline of Section 11, South 01°11'50" West
265 17 feet, to the Northerly Right-of-Way line of the Cul-de-Sac of"W" Street NW., as shown
on the Plat of West Beverly Hill Division 1, recorded in Volume 140 of Plats, Pages 97 through
100 inclusive;
THENCE, Westerly along said Northerly Right-of-Way Line, 20.72 feet, along the arc of a 45 00
foot radius curve, concave to the South and having a radial beanng of South 01°11'50" West,
through a central angle of 26°23'16",
THENCE, North 01°11'50" East, leaving said Northerly Right-of-Way line, parallel with and
20 00 feet West from the North-South centerline of Section 11, a distance of 269.86 feet;
THENCE, South 88°48'10" East 20 00 feet to the True Point of Beginning.

part hereof for a graphic representation of the above described Easement strip.
