HomeMy WebLinkAbout2986 1 RESOLUTION NO. 2 9 8 6 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE MAYOR TO EXECUTE PAYMENT FOR 4 RELOCATION ASSISTANCE EXPENSES TO THOROUGHBRED AUTOBODY, INC AS ALLOWED UNDER THE UNIFORM RELOCATION ASSISTANCE AND REAL 5 PROPERTY ACQUISITIONS POLICY ACT RELATING TO CITY PROJECT PR 529, (C STREET SW/SR 18 RAMP/BNSF GRADE SEPARATION) FEDERAL 6 AID NO P-STPUL-TA96 (071) 7 WHEREAS, Thoroughbred Autobody, Inc are displacees of 8 the above referenced federally funded project and are subject 9 to receive certain relocation benefits which include moving 10 and re-establishment expenses; and 11 WHEREAS, The City of Auburn and Thoroughbred Autobody, 12 Inc have negotiated a self move and re-establishment 13 agreement in the amount of $40, 202 00, see Exhibit "A" 14 attached hereto; and 15 WHEREAS, upon Thoroughbred Autobody, Inc completing 16 their self move, the City of Auburn will make final payment 17 for relocation expenses in the amount of $40 , 200 00 to the 18 displacee as allowed under the Uniform Relocation Assistance 19 and Real Property Acquisition Policy Act; and 20 WHEREAS, relocation expenses for this project will be 21 reimbursed to the City of Auburn by both the Intermodal 22 Surface Transportation Efficiency Act (I S T E A ) and the 23 Transportation Improvement Board (T I B ) 24 25 26 'Resolution No.2986 July 13, 1998 Page 1 I NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, 2 WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH 3 RESOLVES THAT 4 Section 1. The Mayor of the City of Auburn is herewith 5 authorized to execute final payment for relocation expenses to 6 Thoroughbred Autobody, Inc in the amount of $40, 200 00 7 Section 2 . P-STP-UL-TA96(071) 309 "C"Street,Auburn WA We, the undersigned, hereby certify that we are the owners and/or represent the owners of certain personal property which is lawfully located upon real property in connection with the foregoing public works project. As a result of the acquisition, said personal property must be removed from the acquired site. On behalf of Thoroughbred Auto Body Inc, etal, (Thoroughbred) we hereby agree to accept a negotiated cost self move for the relocation of Thoroughbred, We agree that the amount of $40,202 represents a complete and final payment to relocate the personal property from 309 "C" Street in Auburn to the replacement site at 4227 "A" Street in Auburn, Washington. Upon completion of the move the City of Auburn agrees to process a payment in the amount of $40;202 to the said owners of the personal property Thoroughbred agrees that the maximum amount reimbursable for the move ($40,202) is based upon the property located upon the site as of June 29, 1998 which is being relocated to the replacement site at 4227 "A" Street in Auburn. Thoroughbred also agrees that only personal property relocated from the 309 "C" street site to the Auburn replacement site shall be eligible for reimbursement. During the move Thoroughbred agrees to allow the City of Auburn or its representative daily access to both the displacement and replacement sites so that the move may be monitored. Thoroughbred agrees to notify Mr Mitch Legel (Telephone 253-804-5070) of the City of Auburn as to when the move will take place prior to the commencement of the move. The negotiated amount includes payment for the cost to relocate all personal property items and for the maximum amount for re-establishment expenses allowed by law and regulation. 1 $30,202 for moving all personal property from 309 "C" Street to 4227 "A" Street in Auburn. 2. $10,000 for re-establishment expenses. It is agreed that the relocation costs identified above represent a complete and final payment of all relocation expenses to be paid to Thoroughbred.
