A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
3 WASHINGTON, FIXING A TIME FOR A PUBLIC HEARING ON THE PETITION
FOR VACATION OF THAT PORTION OF RIGHT-OF-WAY NEAR 8" STREET
4 NE IN THE VICINITY OF PIONEER CEMETERY, WITHIN THE CITY OF
AUBURN, WASHINGTON

6 WHEREAS, Petition No V-02-98 requesting the vacation of
7 a portion of right-of-way near 8th Street NE in the vicinity
8 of Pioneer Cemetery, has been signed and filed with the City
9 by the owners of more than two-thirds of the property abutting
10 upon that portion of unopened road sought to be vacated; and
11 WHEREAS, RCW 35 79 010 requires the City Council to
12 schedule a public hearing on a petition requesting the
13 vacation of street right-of-way when the petition has been
14 filed with the City and signed by the owners of more than two-
15 thirds of the property abutting the proposed vacation;
16 NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL
17 OF THE CITY OF AUBURN, WASHINGTON, AS FOLLOWS
18 Section 1. Pursuant to RCW 35 79 010, the City Council
19 acknowledges receipt of a petition to vacate of a portion of
20 right-of-way near 8th Street NE in the vicinity of Pioneer
21
Cemetery, which is attached hereto, designated Exhibit "A" ,
22
and incorporated by reference herein

1 Section 2 . The legal description of the street right of
2 way sought to be vacated is described on attached Exhibit "A",
3 and incorporated by reference herein

Section 3 . Pursuant to RCW 37 70 010, the City Council
5
hereby schedules a public hearing on said petition to be held
6
on the 21s` day of September, 1998 at 7 30 p m in the Council
7
Chambers of the Auburn City Hall before the City Council All
8
persons interested in said petition may attend that hearing
9
Section 4 . Pursuant to RCW 35 79 020, upon passage of
10
11 this Resolution the City Clerk shall give twenty (20) days
12 notice of the pendency of the petition by posting written
13 notice in the manner required by the statute and as required
14 by City Ordinance
15 Section 5 . The Mayor is hereby authorized to implement
16 such administrative procedures as may be necessary to carry
17 out the directives of this legislation

Gentlemen:
We, the undersigned,being owners of two-thirds or more of the real property abutting that portion of
land designated as public street right-of-way known as 8' Street NE and more particularly described as
follows:
The North 30 ft. of the E 130 ft-. of the following described property-
Beginning at the point of intersection of the North line of said Section 18, with the
Easterly line of State Road No. 5, which point is 1091.20 feet East of the Northwest_comer of
said Section 18; Thence continuing East, along said Section line, 160.00 feet to the TRUE
POINT OF BEGINNING OF THE TRACT HEREIN DESCRIBED-
Thence East, along said Section line, 177.99 feet to a point which is 1429 19 feet East of
the Northwest Corner of said Section 18; Thence South 359.25 feet more or less, to a point on a
line which is parallel to and 300.00 feet North of the previous North City Limits of the City of
Auburn; Thence West along said parallel line,253 77 feet; Thence North 241.25 feet; Thence
East 75 78 feet; more or less,Thence North to point of beginning; Situate in the County of King,
State of Washington.
Do hereby petition your Honorable Body to vacate said portion of right-of-way hereinabove described.
