AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDIN6 FOR
3 THE ANNEXATION TO THE CITY OF AUBURN OF A CONTINGUOUS AREA OF lANO LYING
ON THE EAST SIDE OF °B" STREET N.W. IN THE 4200 BLOCK, WHICH LAND IS
4 DESCRIBED IN A PfTITION DULY FILED WITH THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON.

WHEREAS, the City Council of the City of Auburn was notified by owners of
6
7 property having more than ten percent in value of the assessed valuation
within the proposed area to be annexed, that they desired to circulate a peti-
8
tion to cortenence annexation proceedings to the City of Auburn; and
9
WHEREAS, the petition for annexation of the property hereinafter described
10
was duly filed with the City Council of the City of Auburn on the 19th day of
11
July, 1982, which petition was signed by the owners of more than 75% in value
12
13 of all of the property lying within the limits of the proposed area to be
14 annexed according to the assessed valuation for general taxation of the pro-
15 Perty for which an annexation is petitioned, said petition setting forth the
16 �egal description of the property to be annexed and being accompanied by a
17 plat outlining the boundaries of said area sought to be annexed; and
18 WHEREAS, the City Cauncil of the City of Auburn fixed a date for public
19 hearing to be held at 8:00 P.M. in Council Chambers of the Auburn City Hall on
20 August 2, 1982, setting forth notice of said public hearing for annexation to
21 be published in the official City newspaper of the City of Auburn in one issue
22 of said newspaper, and providing for the posting in three public places within
2 3 the area proposed for annexation of copies of said notice of public hearing;
24 and
25 WHEREAS, notice of public hearing of said petition of annexation ta the
26 City of Auburn has been duly published in the official newspaper of the City
27 of Auburn in one regular issue of said newspaper, and the said notice of
28 public hearing having been posted 9n three public places within the area pro-
29 posed for annexation by the City Clerk of the City of Auburn, and said public
30 hearing being held at 8:00 P.M. in the Council Chambers of the Auburn City
31 Hall on August 2, 1982, and the City Council of the City of Auburn having

1 determined that said annexation is in the best interest and welfare of the
2 City of Auburn, did accept and approve the petiton above described and
3 directed the filing of a notice of its intention to annex the hereinafter
4 described property with the Boundary Review Board as required by Section 9 of
5 Chapter 189 of Laws of the State of Washington for the year 1967;
6 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AUBURN,
7 WASHINGTON, AS FOLLOWS:
8 Section 1. That the petition for annexation of the property hereinafter
9 described in Section 6 of this Ordinance has been duly and properly filed with
10 the City Council of the City of Auburn, and complies with all requirements of
11 law.
12 Section 2. That by regular motion adopted and passed by the City Council
13 on the 19th day of July, 1982, it was ordered that a public hearing be had on
14 said petition for the annexation at 8:00 P.M. in the Council Chambers of the
15 puburn City Hall on August 2, 1982, praviding for the proper notice to be
16 Published and posted according to law.
17 Section 3. That proper notice of public hearing was duly published in the
18 offic9al newspaper of the City of Auburn, and was duly posted in three public
19 places within the area proposed for annexation hereinafter described, and that
20 a public hearing was held at 8:00 P.M. in the Council Chambers of the Auburn
21 City Hall on the 2nd day of August, 1982.
22 Section 4. That at the conclusion of the public hearing in the City Hall
23 Council Chambers of the City of Auburn on the 2nd day of August, 1982, the
2� City Council did approve the petition for annexation and directed th2 filing
25 of a notice of its intention to annex the hereinafter described property with
26 the Boundary Review Board as required in Section 9 of Chapter 189 of the State
27 of Washington Law for the Year 1967.

Section 5. That notice of intention to annex was filed rri th the Boundary
29 Review Board effective August 24, 1982, and the Boundary Review Board received

1 no request for review and did not itself choose to invoke jurisdiction; there-
2 fore, inasmuch as the sixty-day period subsequent to filing provided for in
g RCW 36.93.100 has elapsed, the Notice of Intention was deaned approved as of
q October 1, 1982, and the Boundary Review Board forwarded their findings to
5 the City Counril of the City of Auburn.
6 Section 6. That the property lying continguous on the east side of °B"
7 Street N.W. in the 4200 Block, hereinafter described be and the same is hereby
8 annexed to the City of Auburn, said property being more particularly described
9 as follows, to-wit:
10 Lot 20, White River Valley Home Tracts, Volume 13, page 17, Records of
King County, Washington.

Together with;

That portion of 80th Avenue South, abutting the west boundary of the above
13 described property.
14 Situate in the southeast quarter of Section 36, Township 22 North, Range 4
EWM.

Section 7. That the effective date of the annexation of the above
16
described property to the City of Auburn sha11 be the effective date of the
17
passage of this Ordinance providing for such annexation.

19 Section 8. That in accordance with the terms of the petition for annexa-
20 tion of the above described property, the area to be annexed shall assume the
21 indebtedness of the City of Auburn existing at the effective date of the
22 passage of this Ordinance.
23 Section 9. The Mayor is hereby authorized to implement such administra-
24 tive procedures as may be necessary to carry out the directions of this
25 legislation.

1 Section 10. This Ordinance shall take effect and be in force five (5) days
2 from and after its passage, approval and publication, as provided by law.
