HomeMy WebLinkAboutSumner Veterinary Hospital VETERINARY EMERGENCY MEDICAL TREATMENT AGREEMENT This emergency medical treatment agreement ("Agreement") is entered into this 27`' day of June 2013, between the City of Auburn, Washington, a Washington Municipal Corporation (the "City") and Sumner Veterinary Hospital, a Washington ("Clinic"). Recitals 1. The City must provide emergency medical treatment for injured dogs and cats found within the incorporated city limits of Auburn. 2. The City has determined that entering into an agreement with Clinic to provide such emergency treatment is in the best interests of the citizens of the City. Agreement For valuable consideration, including the promises made in this Agreement, the City and Clinic agree as follows to provide the services and to abide by the teens hereinafter described: 1. Clinic Establishment Emergency medical treatment is located at Clinic's facility at 16024 60th ST E Sumner, WA 98390. The Clinic will be able to provide services 24 hours a day, 7 days a week including weekends and major holidays. 2. Animals Accepted b Cy linic Clinic shall accept for emergency medical treatment injured dogs and cats brought in by, or at the specific direction of, an Auburn Animal Control Officer or other City employee. This agreement does not require Clinic to accept animals brought in by private citizens who are not specifically directed by an Auburn City employee to do so. For animals brought in by non-City employees the.clinic will attempt to identify the specific location the injured animal was located in order to ensure the proper billing agency. 3 Services by Clinic Clinic shall furnish emergency medical care to alleviate pain and suffering for any animal. As soon as possible thereafter, Clinic shall release the animal to the City or the City's authorized agent unless the owner is identified and has assumed financial responsibility for the animal. City will transfer all animals from Clinic to City as soon as practicable. Clinic will notify the City that animals need to be picked up by 9:00 a.m. Rev.Date 6.24.13 Page 1 of 4 4 Euthanasia The staff veterinarian of Clinic shall perform euthanasia on any animal that the veterinarian determines is irremediably suffering. The Clinic staff will first make every attempt to contact owners of the animal if there are any identifying collars, tags or microchips on the animal. Should an animal be presented to Clinic that requires immediate euthanasia, after initial exam, Clinic will perform the euthanasia at the following rates based on the weight of the animal: 4#t and under $37.00; 4-20# $85.00; 21-49# $105.00 and, 50# and up $125.00. The City will be responsible for disposal of the euthanized animals. 5 Chafes to City City shall pay Clinic up to $150.00 for emergency medical treatment given to each injured dog or cat brought in by or at the direction of an Animal Control Officer or agent of City. A $52.00 fee will cover the urgent care after-hours examination and up to 24 hours of hospitalization. Additional services or products will be discounted at 50% and will be capped at $150 limit after discount has been applied. 6 Charges for owner identified animals If the owner of an injured animal that is taken to Clinic is identified, Clinic will provide any additional standard emergency services based on the owner's consent, agreement and approval for services with Clinic. The owner is responsible for all medical costs incurred and no discounted services will be provided. If owner refuses to pay for services already rendered by direction of the City. the City will be charged. 7 Billing for unidentified animals All bills submitted to City by Clinic shall be itemized according to the fee schedule set forth in this Agreement. Representatives of City presenting animals to Clinic for evaluation and care will be responsible for documenting a description of the animal, the date and time the animal was accepted, the location where the animal was found (including zip code), and the name, address, and telephone number of the person delivering such animal to the Clinic. Main St#201 Auburn, WA 98002 Attn: Heather Shaw Clinic will bill City monthly for services provided. Payment for services will be within 30 business days of the billing date. Delay in payments may result in either late fees or nullification of this contract. 8 Release of Animals Clinic shall not release any animal under the terms and conditions of this Agreement to any person other than an agent of City or the owners of the animal. 9 Indemnification Clinic shall indemnify and save City, and its officers, agents, employees, and assigns free and harmless from any and all loss or liability arising out of Clinic's performance of its obligations under this Agreement. City shall indemnify and save Clinic, and its officers, agents, employees, and assigns free and harmless from any and all loss or liability arising out of City's performance of its obligations under this Agreement. 10 Terms of Agreement a. This Agreement shall be effective upon being signed by both parties hereto, and shall continue in force and effect until terminated by either party by providing ten (10) days written notice to the other party. For purposes of this section, notice may be served upon City at 340 E. Main Street, Auburn, WA 98001. This Agreement shall supersede all prior Agreements between the parties hereto relating to emergency medical treatment. b. Notwithstanding the provisions of subsection (a) above City shall have the authority to terminate this Agreement immediately should it be determined by City that its participation in said Agreement is in violation of any law or contravenes the order of any court of competent jurisdiction or that City 's authority to provide the services herein set forth has been preempted. The C' or a designated representative, shall represent City in all matters pertaining to this Agreement and shall administer this Agreement on behalf of City. b. All letters, papers, reports and all other documents shall be sent to the designated representatives at their respective addresses. 12 Independent Contractor Clinic is, for all purposes arising out of this Agreement, an independent contractor and no employee of Clinic, for any purpose arising out of this Agreement, is an employee of City. 13 Sale of Clinic/Change of Ownership Clinic will notify City in writing within thirty (30) days of any change in ownership or sale of the clinic.
