Background Summary:
Right-of-Way Use pertnit 73-23 is a request ftom the Aubum Noon Lions Club to use North Division Street
between Main Street and 1'�Street NE/NW to operate a beer garden during the Aubum Days Festival.
This street wi�l be elosed starting at 8 pm on August 9"through 8:00 pm,August 11,2013. See the
attached map and conditions for details.

Ris�ht-of-Wav Use Permit Saecial Conditions
for ROW Use Permit 13-23
Staff recommends approval of the permit,subject to the following
conditions:
1. ApplicanYs failure to comply with anyprovisions/conditions of this
permit shall be terms for immediate termina4ion.
2. Applicant shall maintain cuRent insurance incluiiing Liquor Liability
Endorsements naming the City as an additional insured throughout the
life of the permit and provide the City with proof that they are insured.
3. Applicant shall provide a signed and notarized Hold Harmless
agreement.
4. Applicant shall comply with the City's nuisance code under ACC 8.12..
5. Applicant shall keep the public ROW free of litter and drink or food
waste.
6. The Gity reseryes the right to adjust the terms and conditions or revoke
this Right-of Way Use Permit pending the foilowing considerations:
a. Public complaints involving perceived issues impacting pubiic use
of the ROW afFected by the permit. '
b. Public comment or other community interest concems. '
c. Any emerging issue or ch"ange in use of the ROW that may impact
the public irrterest, as follows:
i. The remaining capacity of the rights-of-way to accommodate
other uses ifthe applicanYs proposed use is granted.
ii. The effect, if any, on public health, safety, and welfare if the
authorization is grarrted.
iii. Such other factors as may demonstrate that the grant to use
the rights-of-way will serve 4he community interest.
7. Road Closure of North Dlvlsion Streetbetween Maln Street and 1`t
Street NW/NE at 6 om on Auqust 9. 2013 throuah 8 om on Aus�ust
11 2013.
a. City of Aubum Streets Division will provide, set up and take down of
road closure signage and advanced notification of"No Parking"
signage on closed street. "No?arking° shall be in eifect all day to
avoid having to tow any vehicles.
8. Applicant shall retum the right-of-way to the same condition they found
it, and sha�l remove any gartiage or equipment they bring in.
