Councilmen Absent: Petersen. Minutes of the previous meeting held Augizst 2 , 1960, were approved as mailed: ' PUBLIC HEARING None . BIDS ' ' None • CORRESPOrrDED10E CITY EATGINEER The City �Glerk read a letter from George Schuler, City En�„n,eer, for appronal of the final estimated cost .for work done by Rainier Asphalt ?aving Co. on Cross Street. Total amount ' �2,$31.90, less 15� retained percentage for 30 days, �424.7�. Amount due contractor, �2,40'].12. It was moved by Kammeyer and seconded by Towner that the amount of �2,1�0�.12 be paid to Rainier Asphalt Paving -Co. � MCTION CARRIED The City Clerk read another letter from George Schizler re- questing the Council make final acceptance of the work done by DeCoria Construction Co. for street widening and pay the 15p re_ tained percentage due contractor. � " It was moved by Towner and seconded by Fitzsiminons that DeCoria Construction Co. be paid the 15°,�� retained percentage of ' $�6,162.31. MOTION CIu'i.RIED CALL FOR BZDS The City Clerk read a call for bids for the construction of a two course bitumenous penetration sur£acing on. F St. . S. E. . be- tween 25th and 29th St. S. E. under Loca1 Improvement' District #138, bids to be opened Sept. 6, 1960, at $ p. m. , specifications to be obtained from the City Engineer�s office. It was moved by Towner and seconded by Sonnemann that the City Clerk be instructed to call for bids on the surfacing of F St. S. E, between 25th and 29th St. S, E. MOTION CARRIID _ PLANNING COMMISSION The City Clerk read a letter from the Auburn Planning Com- mission stating they had held a public hearing on the petition of 8. M. Bradburn to rezone from kG to C-1 for a medical center, i � The bommission ap�roves the petition. • It was moved bp Aaby and seconded bp Kammeyer that the ' Council concur in recommendations of ttie Planning Commission and ' the City Attorney be instructed to draft the necessary ordinance. MOTION CARRIED AUDIENCE Lewis Armstrong, attorney, represented the Bothells in their ' protest against bhe motorcycle race course behind their property. �i Mr. Armstrong stated he had appeared before the ..Council earlier protesting the go=carts and, at that time, had mentioned the ` motorcycle course and requested something be done about them also He stated when the noise ordinance was passed, he had asked members of the Council to give' a great deal of consideration .be- fore issuing the motorcycle people a license. PAGE 2361 , AUBURN, WASHINGTON TUESDAY AUGUST 16, 1960 _ _ . _ received a letter from Mr. ,Fair.brother, executive director, of King County Planning Commission, stating the property had a non=conform `ing ;use being classified as residential. Mr. Armstrong".further stated that according to city ordinances , a race track in a resi- dential area is illegal and that the information Mr. Fairbrother had about this area being used as a race track was not true. Mr. Armstrong stated he had gone to the King County Assessor►s office to obtain information about this property. In 1956, he said, this property was inspected for asse§sment and because of the dilapidated condition of the corral area, no value for asses.sment was placed on it. In 1959 the property was again inspected with reualuation for house improvements only. At ' that time and since, because the race track and corral were in such delapiflated condition and had not been in use for 'years, no value was placed on thear. Mr, Armstrong also stated that the road leading up to this. • race course was a private one. The county would not and the Eity had not accepted it. Hundreds oF people attending the races have been using;_this road raising much dust. Mr. Armstrong stated his clients want something done aboutthis race "course on property not zoned for the purpose and request if £ound to be a violation of an existing ordinance, that the matter be taken care of. George Schuler stated he has been investigating this matter an looking into the King County_ PTanning Commission records. A lette had .been sent to Mr. Fairbrother requesting information on 'the • praperty for the past ten years with a' view of determinin g if a permit for racing purposes had. ever been issued to the property. To date the status had not been obtained but he was expecting the information within the following week. This is for F�St�S. E, between 25th and 29th Sts. S. E. There was also ano�er request �'or an L. I. D. on 5th St. between K and M Sts. N. E. for a sanitaTy sewer. The committee felt it was unnecessary to create an6ther local improvement district and would like this included in L. I. D �136. It was moved by Towner and seconded by Aaby that the request for an L. I . D. on 5th St. N . E. between K and M Sts. N. E. be ' included in L. I. D. #13$. • MOTION CARRIED WATER COMMITTEE � Councilman Kammeyer reported they would like to call for bids ' on the West Hill Spring improvement. It was moved by Kammeyer, seconded by Aaby, that the City Clerk be instructed to call for bids on the West HiTl Spring improvement, bids to be opened at 8:00 p. m. September 6, 1960. Specifications may be obtained at R. E. 4JolffTs office in Seattle. MOTION CARRIED The Water Department budgeted �6000.00 in Capital Outlay: for a chlorinator system which will not be needed as the item will be paid from different finances. It was moved by Kammeper and seconded by Gaines that the Gity Attorney draft the necessary resolution transferring this �6000.00 from Capital Outlay to Miscellaneous Equipment of Capital Outlaq in order that the money may be used to purchase a back hoe. ' The City Attorney reported on the assessed valuation of Auburn; 1960, with reference to maximum bonding capacity o£ the , City and �amount available for future bonding for a sub-library 7 building. ' The Mayor stated that he and the City Engineer had investigat d the repairing of the roof and decided Mr. Hord�s proposal was the best.
