The �meeting` was called to order by Mayor Shaughnessy, Councilmen present : Aaby, Lea, Kammeyer, Fitzsimmons, Sonnemann, Knechtel , and Gaines. Minutes of the previous meeting held September 4, 1962, were approved as mailed. CORRESPONDENCE . O PETITION FOR L. I .D. ' WATER MAINS AND FIRE HYDRANTS A petition signed by thirteen owners of property to benefit by the construction of water mains with fire hydrants on East Main St, from R St. to Cedar Lane, Ist St. N .�. from Eastline of Heisse man Addition to 200 feet east of U St . N . E. , U St. N . E. from East Main St. to Ist St. N. E. , Cedar Lane from E. Main St , north 470 ft. , U pl . N .E. from U St. N .E. east I80 feet, requested the City Council to create a Cocal Improvement District for this purpose. It was moved by Kammeyer and seconded by Aeby that the City Attorney 6e instructed to draw up the necessary Ordinance to imple ent this petition. MOTION CARRIED PETITION TO REZONE ALFRED W. GURR � A petition received from Alfred W. Gurr requested the rezonin of propecty located at the fntersection of EnumrJaw Hiway and J .St S. E. from Residence 2 to Commercial 3 . The petition was signed by eighteen pcoperty owners � ying within a two hundred foot radius of the property, stating that they had no objections to the proposed rezoning. . 1 This petitiom was referred to the Planning Commission. , FEDERAL AVIATION AGENCY QUITCLAIM DEED A letter received from the Federal Aviation Agency was accompanied by an executed original Quitclaim Deed conveying to th City of Autiurn a twenty foot strip of land for widening a street n ar the Air Route Traffic Control Center, Auburn, Washington. It was moved by Kammeyer and seconded by Gaines that the City Attorney be instructed to record the quit claim deed from the Federal Aviation Agency . � MOTION CARRIED REQUEST FOR TWO HOUR PARKING WILBER STUDIO _ A letter received from Wilber Studio requested that two hour parking signs be established on East Main Street from "E" Street t "F" Street. It was moved by Lea and seconded by Sonnemann that two hour parking signs be installed in the available parking spaces on the � South side of East Main Street between "E" Street and "F" Street. MOTION CARRIED DIKE EXCAVATION & REPLACEMENT GREEN RIVER, TRIBUTARY DUWAMISH RIVE A letter received from the State of Washington, Department of Fisheries, reported to the Council that an investigation had been I made by a representative of the Department of Fishers and the Department of Game of the proposed project to excavate the exiatin dike for outfall pipe on the Green River, located within the SE} of 5ection 6, Township 21 North, Range 5 East,;�W.M. , King County. , Page 2527 . AUBURN WASHFNGTON TUESDAY SEPTEMBER 8 1962 an� that these departments will have no objection to the proposed project subject to restrictions .for the protection of fish life. Elisabeth Heritage, City Clerk reported that she had forwarded a copy of this letter to � ichard E. Wolff, Consulting Engineer on the Water Sewer Extension project. DEPARTMENT OF HEALTH, EDUCATION, .AND WELFARE OUTFALL SEWER PROJECT A letter received from the Department of Health, Education, � and Welfare authorized the Council to advertise for and open bids on the Out#aIl . Sewer project as submitted by the Washington State Pollution Control .Commission in connection with the City's application for Federal . grant. ORDINANCE N0. 1556 • Elisabeth Heritage, City Clerk , reported to the Council ,that she had mailed Ordinance No. 1556 to the Department of Highways, bu had not received an answer from them yet. ' COMMITTEE REPORTS PURCHASING COMMITTEE No Report FIRE COMMITTEE No Report LICENSE COMMITTEE Councilman Fitzsimmons reported for the License Committee , stating that they had decided to hold the petition to abate noise at Tubby 's Drive- In in abeyance until January, 1963 . He requested the Police Department to check Tubby 's Orive- In for noise durin_g this period of time, and report their findings to the License Commi tee. STREET COMMITTEE ' It was moved by Lea and .seconded by Fitzsimmons that. the performance bond be returned to Heisserman Construction Company on sea,l coafing done this summer; also, that the 10% retained be paid to Heisserman Construction Company..` MOTION CARRIED Councilman Lea reported that Mr. Mrs. Robert J . Anderson .who sent a complaint against a sap dripping tree on 1414 I'2th Street Northeast to the Council , had been referred to the City Engineer for further �consultation. City Engineer Cote' reported that he had not been able to contact the parties as yet. Counciiman Lea reported th.at Roderick W. Stewart who had requested school bus service on 29th Street Northwest had bee� ' referred to the local school district and the County Commissioners who maintain the County road. WATER COMMITTEE ' BIDS ON CLASS 150 PIPE It was moved by Kammeyer and seconded by Gaines that the City Clerk be instructed to call for bids on Class 150, Thin Cement Lined C. I . pipe, specifications to be available in the City Clerk 's office, bids to be opened October 2, 1962, at 4 :00 p. m. , MOTION CARRJED BIDS FOR CONSTRUCTION OF OUTFALL LINE lt was moved by Kammeyer and seconded by Gaines that the City Glerk be instructed to caJl for bids on the construction of 4,670 feet of 30- inch Smoothflo corrugated metal pipe outfall line, cut through. the Green River dike, replacement of bank protection, and miscellaneous. work, Specifications will be available at the office of R. E. MOTION CARRIED POLICE COMMITTEE Councilman Sonnemann reported for the Police Committee stat.in that Chief Darby would like to attend a convention in Yakima. It was moved by Fitzsimmons and seconded by Kammeyer that � Chief. Darby be authorized to attend the convention in Yakima. MOTION CARRIED Councilman Sonnemenn reported that the Police Department had logged of the area to be. used as a pistol range, and were now waiting for the land . to be graded. So"rensen & Son lnsurance & Bonds requesting the Council to advise them, when they give final approval of the compJet:ion of Mr. Ulery ' s contract, in order to release Mr. Ulery from this bond. It was moved by Kammeyer and seconded by Knechtel that the City Attorney be authorized to notify Mr. Ulery ' s .bonding company that the contract bet�reen him and the City has been completed, and thereby release Mr. UPery of his bond, with the provision that he first grade road he" constructed down to its oria�inal, level . MOTION CARRIED Page 2529 AUBURN WASH"INGTON TUESDAY SEPTEMBER 18 1962 VALLEY CEMENT FINISHING COMPANY PERFORMANCE BOND City Engineer Cote' reported that Valley Cement Finishing Company had signed the performance bond and would start work on the contract for concrete curb & gutters, grading surfacing & paving o,f Dogwood Street tomorrow. City Attorney Smythe reported that he had not received a decision back from the Supreme Court on the case Mulkey Vs City of Auburn. � PARALLEI PARKING ON "E" STREET N.E. Councilman Lea reported that the. matter of parallel parking on °E" Street Northeast between Main 5treet & Ist Street had been turned 'over to the Street Department. The lines marked on the street for parallel parking must be sand blasted .off and work on the project had not yet been started, although slated for immediate . future. NEW BUSINESS CLAIM FOR DAMAGES Attorney Smythe reported that copies of a form "CLAIM FOR DAMAGES" had been made, and would be available to any persons who receive injury or damage in connection with the City of Auburn. PUBLIC HEARING ON 1963 BUDGET Mayor �haughnessy called a public hearing to be held .on the 1963 Budget, October I , 1962 at 8 :00 p. m. in the Council Chambers at the City Hall . CENTRAL BUSINESS DISTRICT PLAN ' Planning Director Schuler reported that three meetings Had been held on the Central Business District Plan, since the Iast Council meeting. They have heard several objections to this plan, and are now working to find a solution to these problems. HOUSING AND HOME FINANCE AGENCY Planning Director Schuler reported that the Housing and Home , Finance Agency had a program by which they would pay up to 30% of' ' the cost of open lands for parks. He said that he had given the head of the park committee a pamphlet on this program and written i foc more information. ' PLANS FOR THE NEW LIBRARY � Ken Schoenfeld, representative of the Library 6oard, showed the Council proposed plans for the new Library and Park . CLAIMS It was moved by Sonnemann and seconded by Kammeyer that the following claims against the city all having previously been passed and signed by the Finance �ommittee, be approved and the � City Clerk be authorized to draw warrants in payment.
