HomeMy WebLinkAbout4138 , . . ,~ It . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ~ ~ ----- " ORDINANCE NO. 4 1 3 8 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR THE ANNEXATION TO THE CITY OF AUBURN OF A CONTIGUOUS AREA OF LAND A .39 ACRE IN SIZE LOCATED AT 2910 AND 3002 "A" STREET SOUTHEAST, WHICH LAND IS DESCRIBED IN A PETITION DULY FILED WITH THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON. WHEREAS, the City Council of the City of Auburn was notified by the owner of property having more than ten percent in value of the assessed valuation within the proposed area to be annexed, that he desired to circulate a peti- tion to commence annexation proceedings to the City of Auburn; and WHEREAS, the petition for annexation of the property hereinafter described was duly filed with the City Council of the City of Auburn on the 29th day of January, 1986, which petition was signed by the sole owner representing more than 100% of the value of all of the property lying within the limits of the proposed area to be annexed according to the assessed valuation for general taxation of the property for which an annexation is petitioned, said petition setting forth the legal description of the property to be annexed and being accompanied by a plat outlining the boundaries of said area sought to be annexed; and WHEREAS, the City Council of the City of Auburn fixed a date for public hearing to be held at 7:30 P.M. in Council Chambers of the Auburn City Hall on March 17, 1986, setting forth notice of said public hearing for annexation to be published in the official City newspaper of the City of Auburn in one issue of said newspaper, and providing for the posting in three public places within the area proposed for annexation of copies of said notice of public hearing; and WHEREAS, notice of public hearing of said petition of annexation to the City of Auburn has been duly published in the official newspaper of the City of Auburn in one regular issue of said newspaper, and the said notice of public hearing having been posted in three public places within the area pro- posed for annexation by the City Clerk of the City of Auburn, and said public hearing being held at 7:30 P.M. in the Council Chambers of the Auburn City Hall on March 17,1986, and the City Council of the City of Auburn having Ordinance No. 4138 Page One of Four 6/24/86 " , . . . , ..' .... ~ ., .: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 determined that said annexation is in the best interest and welfare of the City of Auburn, did accept and approve the petiton above described and directed the filing of a notice of its intention to annex the hereinafter described property with the Boundary Review Board as required by Section 9 of Chapter 189 of Laws of the State of Washington for the year 1967; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AS FOLLOWS: Section 1. That the petition for annexation of the property hereinafter described in Section 6 of this Ordinance has been duly and properly filed with the City Council of the City of Auburn, and complies with all requirements of law. Section 2. That by regular motion adopted and passed by the City Council on the 3rd day of March, 1986, it was ordered that a public hearing be had on said petition for the annexation at 7:30 P.M. in the Council Chambers of the Auburn City Hall on March 17, 1986, providing for the proper notice to be published and posted according to law. Section 3. That proper notice of public hearing was duly published in the official newspaper of the City of Auburn, and was duly posted in three public places within the area proposed for annexation hereinafter described, and that a public hearing was held at 7:30 P.M. in the Council Chambers of the Auburn City Hall on the 17th day of March, 1986. Section 4. That at the conclusion of the public hearing in the City Hall Council Chambers of the City of Auburn on the 17th day of March, 1986, the City Council did approve the petition for annexation and directed the filing of a notice of its intention to annex the hereinafter described property with the Boundary Review Board as required in Section 9 of Chapter 189 of the State of Washington Law for the Year 1967. Section 5. That notice of intention to annex was filed with the Boundary Review Board effective May 13, 1986, wherein the Boundary Review Board Ordinance No. 4138 Page Two of Four 6/24/86 ~ . .... .. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 executed a Waiver of Review pursuant to RCW 36.93.110, and it was the decision of the King County Boundary Review Board that the action proposed in said Notice of Intention be approved on June 12, 1986. Section 6. That the property lying contiguous on a .39 acre parcel of land located at 2910 and 3002 "A" Street Southeast, hereinafter described be and the same is hereby annexed to the City of Auburn, said property being more particularly described as follows, to-wit: Beginning at a point on the Auburn City Limits as established by Ordinance No. 1171, said point being 103 feet north of the northwest corner of Lot 4, Block 1, South Auburn Garden Tracts; Volume 20, page 76; thence South along said City limits to the Northwest corner of said Lot 4; thence east along the north line of said Lot 4 to its interesection with Lot 10 of said Block 1; thence north along the wst line of Lots 10 and 11 of said BLock 1, 103 feet; thence west parallel to the north line of said Lot 4 to TPOB; situate in Section 30, Twp 21 North, Range 5 E.W.M. Section 7. That the effective date of the annexation of the above described property to the City of Auburn shall be the effective date of the passage of this Ordinance providing for such annexation. Section 8. That in accordance with the terms of the petition for annexa- tion of the above described property, the area to be annexed shall assume the indebtedness of the City of Auburn existing at the effective date of the passage of this Ordinance. Section 9: The Legal Department for the City of Auburn shall file a cer- tified copy of this Ordinance with the King County Department of Assessments, Accounting Division. 24 25 26 27 28 29 30 31 32 Section 10. The Mayor is hereby authorized to implement such administra- tive procedures as may be necessary to carry out the directions of this legislation. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
