Ordinance No. 6492" (Wagner/Fiursh) M Ordinance of the City Council ofi the City of Aubum, Washington, amending Sections 2.03.040 and 2.03.U90 of the Aubum City Code related to the organization of City administrative govemment ORDINANCE NO. 6 4 9 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING SECTIONS 2.03.040; AND 2.03.090 OF THE AUBURN CITY CODE RELATED TO THE ORGANIZATION OF CITY ADMINISTRATIVE GOVERNMENT WHEREAS, the City of Aubum has functioned very well with its organizational structure and its capable and qualified employees; and WHEREAS, with the election of a new Mayor and the individual prerogatives of the new Mayor's administration, it is understandable and reasonable that changes would be made that better suit that administration; and WHEREAS, in connection with the commencement of the new Mayoral administration, it is appropriate that changes affecting the administra4ion be reflected in the Ciry Code, yet preserving the responsibilities and prerogatives of the City Council. NOW, THEREFORE, THE CITY COUNC�L OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN as follows: Section 1. Amendment to Citv Code. That Section 2.03.040 of the Auburn City Code be and the same hereby is amended to read as follows:. 2.03.040Appointment of appointive officers. A. The +�aya�Mavor shall appoint, and .at his/her pleasure may remove, all si�-Cit}Lappointive officers, subject to the provisions of any applicable law, rule or regulation pertaining to civil service,. state law or city ordinances. The Mavor shall also have the authoritv to make �er�pera� #emporac�assignments of positions_, including but not limited to pab�+�Public sa#et�-Safe �+�es�e�Director or �+blis-Public sa#ety-Safe sbie�Chief and �De u pelfse-Police sk�ie#Chief, or equivalent positions. C. It is provided, however, that appointment or termination of the sik� C��#e�a�y-Attomev shalf be subject to confirmation by a majority of the members of the si�-C�seaflsilCouncil. It isfurther provided that termination of the Police Chief shall be subject to anv applicable statutes or rules reqardinq termination ofia police chief for cause. D. The Mavor shall submit to the Citv Council for review an orqanizational chart showinq current orqanizational reportinq relationships and qrouosed chanaes. That Section 2.03.090 of the Auburn City Code be and the same hereby is amended to read as follows: 2.03.090 Departmental coordination duties. A. The +�ayeFMavor shall be responsible for the coordination of the activities of the various si#�Ci�!�#sDepartments, bear�s-Boards and ser�issieAS-Commissions to eliminate waste and duplication of efforts, prevent the �epa�eat�Departments#rom working at cross purposes, avoid conflicts in authority, and promote effective liaison between all agencies that work for the �C�• B. In furtherance of the coordination duties set forth in this Section, the Mavor is authorized to chanpe the reportinq requirements of anii amonq the various appointed officers, includinq movinq said officers to different departments or divisions. Provided, that the Mavor shalF not chanqe the reportinq requirements of apqointed officers in the Office of the CityAttornev, Citv Clerk, or of commissioned officers of the Police Department. C. Jf the chanqe in reporting requirements chanqes the powers or duties of a Citv Department as set forth in this Code and as specified in state statute, the Mavor shall brinq an amendment to the applicable Code sections Ordinance No. 6492 January 2, 2014 Page 2 of 3 before the City Council for review and aoaroval as soon as practicable (1957 code § 1.03.100.) Section 3. Imalementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of tliis legislation. Section 4. Severabilitv. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereofi to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. Section 5. Effective date. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
