A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, AUTHORIZING THE MAYOR
TO NEGOTIATE AND EXECUTE AN AGREEMENT
BETWEEN THE CITY OF AUBURN AND THE
WASHINGTON STATE DEPARTMENT OF ECOLOGY FOR
PARTIAL SETTLEMENT OF THE ONGOING LITIGATION
REGARDING THE NATIONAL POLLUTION DISCHARGE
ELIMINATION SYSTEM PHASE II APPEAL
WHEREAS, The City Council authorized the Mayor to enter into an Interlocal
Agreement with the Cities of Bainbridge Island, Bellevue, Des Moines, Everett,
Issaquah, Kent, Mount Vernon, Renton, Seatac, Snoqualmie, and Sumner, and Cowlitz.
County to jointly prosecute an appeal of the Department of Ecology's Phase II National
Follutant Discharge Elimination System (NPDES) Permit; and
WHEREAS, some of the issues (LID, lack of guidance, lack of ineaningful
opportunity for review and comment) were consolidated with the Phase I permittees.
The Pollution Control Hearings Board held a hearing on these issues at the end of
Qctobec, and its decision is due 60-90 days from the date ofithat hearing; and
WHEREAS, The technical group and steering committee have negotiated a
partial settlement with Department of Ecology that clarifies or amends some of the
remaining definitions at issues; and
'WHEREAS, sta ff believes that this partial settlement, while not resolving all
issues, will narrow the focus and allow the City and the Coalition to more e�ciently
allocate resources; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, HEREBY RESOLVES as follows:

Section 1. That the Mayor is hereby au4horized to negotiate and execute a
Partial Settlement Agreement between the City and the Washington State Department
of Ecology for some of the issues related to the NPDES II permit appeal as
recommended by Counsel.
Section 2. That the Mayor is authorized to implement such administrative
procedures as may be necessary to carry out the directives of this legislation.
Section 3: That this Resolution shall take effect and be in full force upon
passage and signatures hereon.
