THIS AGREEMENT AND CONTRACT, made and entered into, in triplicate, at Aubum,
Washington, this � day of�2013, by and between the CITY OF
AUBURN, WASHIlVGTON, a municipal corporarion, and Petersen Brothers. Inc, 2008 East
Vallev Hig,hwav East. Sumner. WA, 98390, hereinafter called the CONTRACTOR.
WITNESSETH:. T'hat, in consideration of the terms and conditions contained in the Contract
Documents entitled "CP0912, Citywide Guardrail Improvements Project," which aze by this
reference.incorporated herein and made a part of this Contract, the parties hereto covenant
and agree as follows: ,
I. The CONTRACTOR shall do all work and fiunish all tools, materials and equipment for
Project CP0912, Citywide Guardrail Improvements Pmject — the installation of
approximately 7,700 feet of guardrail and associated removal and shoulder restoration work
tfiat includes removal and construction of asphalt pavement, removal and construction of
concrete flatwork, new signage, curb, concrete barriers, pavement sh�iping, and fencing for a
total contract value of three hundred eighty-five thousand, four hundred ninety-four dollazs
and fifty cents ($385,494.50) in accordance with and as described in the Contract Documents
which are by this reference incorporated herein and made a part hereof, and shall perform any
alterations in or additions to the work provided under this Contract and every part thereof.
This Contract shall be executed by the Contractor and retumed to the City within 7 calendar
days afterthe receipt of the dated notification of awazd and the Contract time shall commence
within 5 working days after execudon of the Contract by the Ciry and so designated on the
Notice to Pmceed. Physical completion shall be within 45 working days of the date on the
Notice to Proceed.
If said work is not completed within the time specified, the CONTRACTOR agrees to pay
liquidated damages to the CITY OF AUBURN, as specified in Section 1-08.9 (Liquidated
Damages)of the Standard Specifications. '
The CONTRACTOR shall provide and bear the expense of all equipment, work and labor of
any sort whatsoever that may be reguired for the transfer of materials and for constructin�
and completing the work provided for in this Contract and every part thereof, except such as
are mentioned in the ContractDocutnents to be fiunished by the CITY OF AUBURN.
IL The CITY OF AUBURN hereby promises and agrees with the CONTRACTOR to
employ, and does employ the CONTRACTOR to provide the materials and to do and cause
to be done the above described'work and to complete and finish the same according to the
Contract Documents and the terms and conditions herein contained and hereby contracts to
pay for the same according to said Contract Documents and the aforesaid proposal hereto
attached, at the time and in the manner and upon the condiuons provided for in this Contract.
III. The CONTRACTOR for himself, and for his heirs, executors, administrators, successors,
and assigns, does hereby agree to the fiill performance of all the covenants herein wntained
upon by part of the CONTRACTOR
N. It is further provided that no liability shall attach to the CITY OF AUBURN,
WASHIIVGTON by reason of entering into this Contract, except as expressly provided
herein.

organized and'existing under the laws of the State of Gonnecticut
as a surety corporation, and qualified under the laws of the State of Washington to become
surety upon bonds of con�actors with municipal corporations, as suiety, aze jointly and
severally held and fumly bound to the City of Auburn, Wasliington, in the pena(sum of three
hundred eighty-five thousand, four hundred ninery-four iiollazs and fifty cents ($385,494.50),
for the payment of which sum we jointly and severallybind ourselves and our successors,

WHEREAS,the City of Auburn on the 3rd day of September, 2013, let to the ahove bounden
prinoipal a certain Contract. The said Conh�act being numbered 13-03, and providing for the
construction of Project CP0912, Citywide Guazdrail Improvements Project - installation of
'approximately 7,700 feet of guardrail and associated removal and shoulder restoration work
tfiat inoludes removal and construcfion of asphalt payement, removal and construction of
concrete flatwork, new signage, curb, conorete barriers, pavement striping, and fencing'
(which Contract is referred to herein and is made a part hereof as though attached hereto),

NOW, THEREFORE, if the above.bopnden principal shall faithfully and truly observed and
comply with the terms, conditions, and provisions of said Contract in all respects and shall

performed unde; said Con�act, upon the terms proposed therein, and any and a11 duly
authorized modi&cations of said Contract tliat may hereafter by made, and within the time

subcontractors and material men, and all persons.who shall supply principal or subcontractors

by reason of any carelessness or negligence on the part of said principal or any subcontractor

according to law, and shall indemnify and hold the Gity of Auburn, Washington, haimless '
from any damage or expense by reason of failure of performance, as specified in said
Coahact,and
The undersigned principal and the imdersigaed surety prese�tlris contract bond related to the
Conh�act,PROVIDED that this document shall not be enforceable unless and until the City of
Aubumawards and executes the Coauact to the undersigaed priacipal. No obligations imder
tlris bond, for,the performance of the above-referenced contract, shall be enfozcea6le until the
Ciry of Aubum has executed the contract to the undersigned principal.
Ttie S�uety, hereby agrees that modifications and changes may be made in the terms and
provisions of the aforesaid Coniract without notice to Surety, and any such modifications or
changes incieasing the totai amount to be paid the Principal shall automatically increase the
obligation af the Surety on tlus Contract Bond in a like amount, such increase; however,not
to exceed twenty—five percent(25%)of the original amount of this bond'without the consent
of the Surety.
PROVIDED,however,that 60 days after the Final Acceptance of this Con�act,the expiration
of the lien period, and if there aze no liens pending, and provicled the conditions of the release
of Contnct Bond as provided in the Contract are met,THEN and in that event this obfigation
sl�all be void;but otherwise it shall be and remain in fiill force and effect
It is hereby expressly agreed ihat if any legal actioa is necessary to be brought under the

Auburn's wriEten notice to Principal setting out C'tty of Auburn's claim against Principal.
Gity of Auburn's written notice should state intended amount to be claimed in the event
Priacipal fails to commence action to cure such default within30 business daysfrom the'date
of the notice.
A FURTHER CONDITION OF THIS OBLIGATION IS SUCH, that if Principal �shall
faithfully carry out and perform the said guarantee, and shall, on due notice, repafr and make
good at its own expense any and all defects in the said work and Deliverables which may
devefop during the One Yeaz period following the Final Acceptance of the Contract by the
Auburn City Council or shall pay oyer, make good an8 reimburse to the said CRy of Adburn
all loss and damage which said CRy of Auburn may sustain by reason of failure or defaulE of
said Principal so to do, then this obligation shall 6e null and void, otherwise shall remain in
full force and effect but not later than One Year following the Final Acceptance of the
Contract by the City Council or the date Principal delivers a further Warranty Bond in the
amowrt as stated above per the requiremems of the Contract, whichever date is.fater: The
Principal and Surety shall hotd the City of Auburn harmless from all defects appea;ing or
developing in the material or workmanship provided or performed under this Contract within
a period of One(1) Yeaz after Final Acceptance,T[�N and in that event this:obligation stiall
be void; but otherwise it sha(l be and remain in full force and effect.
It is hereby expressly agreed that if any legal action is necessary to be brought.under the
conditions of this bond, that the decisions of the Courts of the State of Washington shall be
binding.

This change order adjusts the lump sum unit price for "Vehicle Detection System, Complete" to reflect a negotiated price
adjustment with the Contractor. The original unit price for "Vehicle Detection System, Complete" was established by
— -- Change OrderNor2 and was based on -a quote front an electrical subcontractor who was - ultimately not approved to
perform work on this contract due to outstanding issues with the Washington State Department of Labor and Industries.
The Contractor was not aware of this issue at that time that they submitted the quote. The Contractor subsequently hired
a different subcontractor to complete the work at a higher cost than originally quoted by the original subcontractor. The

Summary of Proposed Changes:
The Contractor shall replace the advance loop and lead in wire on northhound Kersey Way at the
Evergreen Way SE intersection that is in conflict with the proposed guardrail. Loop installation shall
be per Section 8 -20 of the WSDOT Standard Specifications and per the attached specifications. The
Contractor shall abandon the existing advance loop conduit and wire in place. The lump stun item
"Vehicle Detection Loop, Complete" is added to the Contract and shall include payment for all costs to
famish, install, and test the new loop, including sawcutting and sealing the pavement, and to
coordinate activiation and setup of the new loop with the City. The existing stop bar loops wire,
conduit, and boxes shall be protected in place.

8 -20.3 CONSTRUCTION REQUIREMENTS
8- 20.3(1) GENERAL

All cable entering cabinets shall be neatly bundled and wrapped.
8- 20.3(9) BONDING, GROUNDING Supplement
When loop lead -in wires or interconnect wire are the only wires in the junction box, bonding is
not required.
8- 20.3(14) SIGNAL SYSTEMS
8- 20.3(14)C INDUCTION LOOP VEHICLE DETECTORS
Supplement
The loop shall be installed where staked by the Engineer. Saw cuts shall not remain empty for a
duration longer than twenty -four hours after the saw cut is completed.
Loops shall be wound clockwise and consist of 4 turns of loop conductor.
From the loop to the junction box, the loop wires shall be twisted two turns per foot and labeled
at the junction box in accordance with the loop schematics included in the plans. A 3/8 -inch saw
cut will be required for the twisted pair.
Loop wires shall be connected to the lead -in cable using compression sleeves and sealed with 2-
inch wide rubber mastic tape. An extra 10 feet of both loop wires and lead -in cable shall be
coiled neatly in the junction boxes for future work. Loops shall be round and saw cuts shall be
6 -foot diameter and shall be constructed using equipment designed for cutting round loops. The
equipment shall use a concave, diamond - segmented blade. The saw cuts shall be vertical and
shall be a minimum of 0.25 inches wide. The saw cut depth shall be between 2 '/2 inches and 3
inches measured at any point along the perimeter. The bottom of the saw cut shall he smooth.
No edges created by differences in saw cut depths will be allowed.
8- 20.3(14)D TEST FOR INDUCTION LOOPS AND LEAD -IN CABLE Supplement
Continuity checks of prc- formed loops shall be done before installation, and both continuity and
resistance to ground after the loops are embedded in the pavement.

SATURATION DIVING:
The standby rate applies until saturation starts. The
saturation diving rate applies when divers are under
pressure continuously until work task and decompression are
complete. the diver rate shall be paid for all saturation
hours.
WORK IN COMUTNATION OF CLASSIFICATIONS:
Employees working In any combination of classifications
within the diving crew (except dive supervisor) in a shift
are paid in the classification with the highest rate for
that shift.
HAZMAT PROJECTS:
Anyone working on a HAZMAT job (task), where HAZMAT
certification is required, shall be compensated at a
premium, in addition to the classification working in as
follows:
LEVEL D + $.25 per hour - This in the lowest level of
protection. No respirator is used and skin protection is
minimal.
LEVEL C + $.50 per hour - This level. uses an air purifying
respirator or additional protective clothing.
LEVEL B + $.75 per hour - Uses same respirator protection as
Level A. Supp.l_i.cd air line is provided in conjunction with
a chemical "splash suit ".
LEVEL A +$1.00 per hour - This level utilizes a fully
encapsulated suit with a self- contained breathing apparatus
or a supplied air line.

Trucks Pulling Equipment Trailers: shall receive $.15 /hour
over applicable truck rate
WELDERS - Receive rate prescribed for craft performing
operation to which welding is incidental.
Unlisted classifications needed for work not included within
the scope of the classi.fi.cations listed may be added after
award only as provided in the labor standards cont:rnct clauses
(29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lisrs the classification
and usage rates that have been found to be prevailing for the
cited type(s) of construction in the area covered by the wage
determination. The classifications are listed in alphabetical
order of "identifiers" that indicate whether the particular
rate is union or non - union.
Union Identifiers
An identifier enclosed in dotted lines beginning with
characters other than "SU" denotes that the union
classification and rate have found to be prevailing for that
classification. Example: PLUM0196 -005 07/01/2011. The first
four letters , PLUM, indicate the international union and the
four -digit number, 0198, that follows indicates the local union
number or district council number where applicable , i.e.,
Plumbers Local 01.98. The next number, 005 in the example, is
an internal number used in processing the wage determination.
The date, 07/01/2011, following these characters is the
effective date of the most current negotiated rate /collective
bargaining agreement which would be July 1, 2011 in the above
example.
Union prevailing wage rates will be updated to reflect any
changes in the collective bargaining agreements governing the
rates.
0000/9999: weighted union wage rates will be published annually
each January.

Non -Union Identifiers
Classifications listed under an "SU" identifier were derived
from survey data by computing average rates and are nor union
rates; however, the data used in computing these rates may
include both union and non -union data. Example: SULA2004 -007
5/13/2010. SD indicates the rates are not union majority rates,
LA indicates the State of Louisiana; 2004 is the year of the
survey; and 007 is an internal number used in producing the
wage determination. A 1993 or later date, 5/13/2010, indicates
the classifications and rates under that identifier were issued
as a General Wage Determination on that date. -
Survey wage rates will remain in effect and will not change
until a new survey is conducted.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can
be
* an existing published wage determination
* a survey underlying a wage determination
' a Wage and Hour Division letter setting forth a position on
a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests
for summaries of surveys, should be with the Wage and Hour
Regional Office for the area in which the survey was conducted
because those Reyional Offices have responsibility for the
Davis -Bacon survey program. If the response from this initial
contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
