Seotion 1. That the folloryin~ are faots: The budcet of
estimated expenditures from the '-''l.ter fund of the oity of A.uburn
the year 1934, which budget Vias duly adopted by the City Council
October, 1933, contains the follo'lline items:

and oonstruction of a concrete dam and other safe e;l1S.rds in and near the

said river of the pipe line and "blow_off" of the Coal Creek SpriIl<'3s
munioipally mv.ned water system of the oity of Auburn; durine; the early
~1nte~ of the years 1933-1934 several high and severe floods in ~hite
river washed away and destroyed certain works theretofore placed and
oonstructed in said river for the proteotion from the vro.shings of S9.id
river of the pipe line and "blot:'-off" of the Coal Creek SprinGs munici-
pally owned water system of the oity of Aubl~n: future flood waters of
said river n~l seriously threaten and are a menace to said municipally
owned water system: the necessity for the building and. cOnstruotion of
such concrete dam and other safe f"Ual'ds COUld not }:1...ave been reasol'..ably
foreseen in Ootober, 1933, when the oity budget for the year 1934 was
adopted: the estimated cost of the buildinG of suoh conorete dam end
other safe guards is the rum of ,1,500.00: by reason of the foregoing
faots an emergency exist~ requirin~ the expenditure durine the year
1934 from the water fund of the city of Auburn for labor and materials
in build ing and 0 onstruct ine; a c onorete dam and <;>ther safe guard..s. as
hereinbefore specified, in excess of the sum of ,'5,400.00 capital
outlay provided for in said budcet o:{' expenditures from the vro.ter fund
during the year 1934, of the SID of ,1,500.00.
Section 2. That a concrete dam and other safe el~rdsshall
be built and oOnstructed in and near the northerly bank of IThite
river for the protection from the flashings of said river of the pipe
line and "blow-off" of the Coal :''ree~: Sprines munioipally ovmed water
works system of the city of Auburn, which work shall be done by or
under the direction and supervision of the city of Auburn; and that
emergenoy warrants be drawn on the water fund of the oity of Auburn in
payment(therefor in a sum or sums not exoeedine in the aegreeate the
sum of ,'1,500.00.

Section 3. That this ordinanoe shall be treated and oonsidered
as retro-active and that upon its passaee and approval as r~m.red by
law this ordinance shall be in full foroe and effect as of rcl 'f _
