ORDINANCE NO. 804 .
AN ORDINANCE: Deolaring a public emergenoy to exist
requiring the expenditure during the year 1938, from the
ourrent expense fund of the City of Auburn, of moneys not
provided for in the budget for the year 1938, for the pur-
pose of oleaning out the large city sanitary septio tank
situate near the northeast oo~er of the northwest quarter
of Section 13, Township 21 north, Range 4 east W.M., dis-
posing of the contents thereof, providing a roadway neo-
essary for the doing of suoh work, and making such repairs
to said septio tank as may be found necessary; and author-
izing the issuanoe of emergenoy warrants to meet suoh emer-
genoy.
THE CITY COUNCIL OF THE CITY OF AUBURN DO ORDAIN AS
FOLLOWS: .
SeGtion 1. That the following ar@ faots: The large
oity sep~lo ~ank situate on and in the west 290 feet of
the east 390 feet of the north 150 feet of Seotion 13,
Township 21 north, Range 4 east W.M. , Which septiG tank
forms a part of the sanitary sewer system of the City of
Auburn, has been in use about sixteen years. Since it
was last oleaned out, it has largely filled and is now
largely filled with sludge and other waste matter so that
the same is not now effioiently operating to the extent
for which it is intended. It is neoessary that the sludge
and other waste~matter now in suoh septio tank be removed
therefrom without delay and hauled away and dep9si~~in
some plaoe or plaoes where it may be legally deposited.
To aooomplish SQoh removal and hauling away it will be
neGessary that the City of Auburn first provide a suita-
ble roadway from SUGh septio tank to a publio highway.
After suoh septio tank shall have been oleaned ou~, it
may be found neoessary to make certain repairs.to suoh
tank. No moneys have been budgeted to be expended by the
City of Auburn during the year 1938 whioh will be avail-
able to pay the cost and expense of providing such road-
way, of suoh removal, haUling away and disposing of suoh
sludge and other waste matter,and of making suoh repairs,
if any, to such septio tank as may be found neGessary.
Section 2. That by reason of the faots stated in
Section 1 of this ordinanoe, a publio emergency now exists
requiring the expenditure during the year 1938, from the
ourrent expense fund of the City of Auburn, of moneys not
provided for in the budget for the year 1938, for the pur-
pose of oleaning out the septiG tank referred to in Seotion
1 of this ordinanoe, removing the sludge and other waste.
matter now therein from suoh septio tank and hauling the
same away and dep9sitiDgthe same in some plaoe or places
where it may bo leSAlly neposited,and for the purpose of
providing a suitable roadway from suoh septiG tank to a
publio highway to make possible suoh hauling away, and for
the purpose of making suoh repairs, if any, to suoh sep-
tio tank as may be found neoessary after suoh septic tank
shall have been oleaned out; that suoh emergenoy could not

have been reasonably foreseen at the time of making the
budget of estimated expenditures from the ourrent expense
fund of the City of Auburn during the year 1938, whioh bud-
get was adopted by said city in Ootober, 1937; that suoh
emergenoy is one of the emergenoies specified in the pro-
viso of Section 9005-6 of Remington's Compiled Statutes
of Washington in that the immediate preservation of pub-
lio health is involved, and that therefore this ordinanoe
may be passed without notioe upon the day of its intro-
duotion; and that the estimated amount of expenditures
required to meet suoh emergenoy is the sum of . ',1.?:-O !!.,.o, .
Section 3. That emergenoy warrants be drawn on the
ourrent expense fund of the City of Auburn in payment of
the oost and expenses to be inourred in meeting the Emer-
genoy speoified in Sections 1 and 2 of this ordinanoe in
