AN ORDINANCE Vacating two certain portions of that part
of "J" Street Southeast in the City of Auburn, King County, Wash-
ington, situate between Main Street East and First Street South-
east in said City,
WHEREAS, Heretofore, to-wit: on or before the 20th day of
August, 1940, George L. Taylor, Theda Bock Short and A. B. Joslyn
caused to be filed with the Oity 01erk of the Oity of Auburn, their
petition in writing, addressed to the Oity Oounci1 of the said City
of Auburn. praying that all of those portions Of "J" Street South-
east, situate between Main-Street East and First ~treet Southeast in
the said Oity of Auburn, which a~e hereinafter particularly bound-
ed and described, be vacated; and
WHEREAS, Heretofore. to-wit: on the 20th of Au~ust, 1940,
at a regular meeting of the City Council of the City of Auburn.
held on the said day. it was made to appear to the satisfaction of
said City Oounci1, that said petitioners were the owners of more
than Two-Thirds (2/3) of the private property abutting upon that
portion of "J" Street Southeast in the Oity of Auburn, situate
between Main Street East and First Street Southeast in said City,
sought to be vacated and said Oity Oounci1 did then and there by
resolution, fix and designate Tuesday evening September 17th, 1940
at Eight o'clock P.M. at the City Hall in said Oity of Auburn, King
Oounty, Washington, as the time and place when and where said peti-
tion would be heard and determined by said City Oounci1; and
ITHEREAS, Pursuant to the urovisions of the said resolution,
the City Olerk of the City of Auburn did thereafter on the 21st
day of Au~ust, 1940, and more than Twenty (20) days prior to the
date fixed for such hearing as aforesaid, duly give Twenty (20)
days notice of the pendency of said petition by a typewritten
notice_set up in Three (3) of the most publiC places in the Oity
of Auburn and by a like typewritten notice set up in a conspicuous
place on the portions of the said "J" Street Southeast. situate
between ;,1ain Street East and .J;'irst .:3treet Southeast, so sought to
be vacated, which typewritten notices were signed by the City Clerk
of the City of Auburn and contained a statement that a petition
had been filed to vacate the two particular portions of "J" Street
Southeast in the City of Auburn hereinafter particularly described,
that said petition was pending and that September 17th, 1940 at
Eight o'clock P.M. at the City Hall in the Oity of Auburn. King
County, Washington had been fixed and determined as the time and
place for the hearing of the said petition; and
WHEREAS, Due proof by affidavit of the posting and setting
up of said notices as aforesaid, is now on file in the office of the
City 01erk of the said Oity of Auburn; and
WHEREAS. Said petition came on regularly to be heard by
said Oity Oounci1 on September 17th, 1940 at Eight O'clock P.M. at
the City Hall in said 0 ity of Auburn, King County, .Tashington, (that
being the time and place fixed for said hearing) and no written
objections to the granting of the said petition having been submit-
ted to the Oity Council, or filed with the City Clerk; and
WHEREAS, It has been made to appear to the satisfaction of
the Oity Council of the said City of Auburn, that the two portions
of "J" Street ;3outheast in the City of .duburn, so aought to be
vacated, are now of no use to the City of Auburn or to the public

for street purposes by reason of the fact that said portions of
said street are outside of those portions of "J" Street Southeast
now improved and are out of line with other portions of "J" Street
Southeast in said City; and
~HEREAS, The City Council of the City of Auburn, being fully
advised of the facts and the law in the premises, ordered the pre-
paration of this Ordinance,
N07/ THEREFORE, Th'E CITY COUNCIL OF THE CITY OF AUBURN DO
ORDAIN AS FOLLOWS:
Section 1. That the two following described tracts of land
situate in that part of "J" dtreet Southeast in the City of Auburn,
lying between Main Street East and First Street Southeast in said
City, described as fOllows. to-wit:
The Easterly Ten (10) Feet of that portion of "J" Street
Southeast in the City of Auburn, King County, Washington, ly-
ing inmediate1y Westerly of and abutting upon Lot Seven (7)
in Block Two (2) of French's Second Addition to the Town of
Slaughter (now Auburn) in King County, Washington, more
specifically and definitely described as follows: Beginning
at the Southwest corner of said Lot 0even (7) in Block Two
(2) of said Addition, running thence Westerly upon the South
line of said block produced a distance of Ten (10) feet to a
pOint; thence Northerly parallel with thei(ester1y line of
said Lot Seven (7) to a point upon the Northerly line of said
Block Two (2) produced Westerly; thence East upon said Norther-
ly line of Block Two (2) produced Westerly to the Northwest
corner of said Lot Seven (7); thence Southerly along and upon
the Westerly line of said Lot Seven (7) to the point and place
of' beginning; the same being all of that portion of "J" Street
Southeast in said City, lying between the Easterly line of the
sidewalk and said Lot Seven (7) in block Two (2) of said addi-
tion, ALSO
" The East er1y Ten (10) feet of that portion of "J" Street
Southeast- in the City of Auburn, King County, Washinston, ly-
ing immediately Westerly of and abutting upon Lot Seven (7)
in Block One (1) of French's Second Addition to the Town of
Slaughter (now l'uburn) in King County, Washington, more speci-
f1ca11y and definitely described as follows: Beginning at the
Southwest corner of said ~ot Seven (7) in Block One (1) of said
Addition, running thence Nester1y upon the South line of said
Block produced a distance of Ten (10) feet to a pointj thence
Northerly parallel with the Westerly line of said Lot Seven
(~) to a point upon the Northerly line of said Block One (I)
nroduced Jester1y thence East upon said Northerly line of Block
One (1) 1?roduced ,iesterly to the Northwest corner of said Lot
Seven (7)j thence doutherly along and upon the Westerly line of
said Lot Seven (7) to the point and place of beginning; the
same being all of that portion of "J" Street .-:>outheast in said
City, lying between the Easterly line of the sidewalk and said
Lot Seven in Block One (1) of said Addition;
all situated and being in the County of King and 0tate of Washing-
ton, be and the same hereby are vacated.
Section 2. That this ordinance shall take effect and be in
