ORDI'ANCE NO. 835
AN ORDINANCE: Relating to oertain requirements to be oomplied
wi th by, and the bond to be given by, a garbage contractor; and
amending Section 12 of Ordinanoe No. 465 as amended by Ordinanoe No. 668
as amended by Ordinanoe No. 767 of the Ordinanoes of The City of Auburn:
THE CITY COUNCIL OF THE CITY OF AUBUm DO ORDAIN AS FOLLOWS:
Seotion 1. That Section 12 of Ordinanoe No. 465 of the Ordinances
of The City of Auburn as allSnded by Ordinance No. 668 as amended by
Ordinanoe No. 767 of the Ordinlnoes of The City of Auburn, be al!flnded
so that as amended, said Seotion 12 shall read as follows:
"Seotion 12. That the garbage oontraotor shall wholly at
.his own expense aoquire by lease, purohase or otherwise
and provide and maintain a plaoe and grounds as a garbage
dump to which all garbage and waste matter and dead animals
and fowls aooumu1ated or aooumulating within the limits of
the City of Auburn and removed by the garbage oontractor
shall be removed and there destroyed; that such place and
grounds to be so used as a garbage dump shall be wholly
outside of the oorporate limits of the City of Auburn and
not less than eighty (80) rods, measured in a straight
line, from the nearest part of suoh oorporate limits; that
the Garbage Contractor shall at all times save the City of
Auburn harmless from any and all olaims arising or to arise
from the use of suoh plaoe and grounds as a garbage dump
and will, Wholly at his expense, defend any suit, aotion
or olaim (if any) brought or olaimed on account of suoh
use; that the garbage contraotor shall, immediately after
emptying any garbage oan provided with a oover as in this
Ordinance required, properly replace such oover upon
such garbage can; that all of the provisions of this ordin-
ance insofar as the same relate to or effect such garbage
oontractor, shall be deemed a oontract between the City of
Auburn and such garbage contractor as fully and to the same
extent as though the same were fully inoluded in a separate
written oontract between the City of Auburn and such garbage
oontractor; and that before any contract shall be finally
let and awarded by the City of Auburn to a garbage contraotor
for the removal and destruction of garbage and waste matter
and before such oontract shall be signed and exeouted on
behalf of the City of Auburn, the person, firm or oorporation
to whom such oontraot is being let and awarded shall furnish
a surety bond to the City of Auburn to be awroved by the City
Council in the sum of Two Thousand Dollars ('2,000.00) condi"
tioned for the faithful performanoe of his, their or its
contraot and for the faithful oomplianoe by said garbage
contractor with all of the Ordinanoes of the City of Auburn
relating to the removal and destruotion of garbage and waste
matter. "
