ORDINAl~CE NO. 842
AN ORDINANCE: Relating to the National Defense, Civilian
Defense. and Air Raid Precautions; Providing for "Black Outs" upon
receipt of air raid warning signals; Requiring the performance of
certain acts and prohibiting the performance of certain other 8.cts
during a period of air raid alarm and a black out period; Defining
offenses and presoribing pena1ities.
THE CITY COUJ.WIL OF THE CITY OF AUBURN DO ORDAIN AS FOLLOWS:
Section 1. By reason of the faot thnt a state of war now
exists between the United ~tates of Amerioa and the Governoents of
Japan, Germany, and Italy, and by reason of the further faot that
this city is in close proximity to the Paoifio Ooean and that there
is great and continuing danger that during the continuance of such
war attempts may be made by the enemy to suddenly attack and bomb
this oity, this ordinance is deemed neoessary to maintain the peace,
good government and welfare of this city and.its trade, oommeroe
and manufaotures, and to assist in the proteotion of the lives,
limbs and property of its inhabitants.
Seotion 2. As used in this ordinanoe the following words and
phrases shn11 mean:
Signal"
"Air Raid Warning! shall mean a signal, by siren, whistle, horn
or other audible device of two minutes duration consisting of a
f1uxuating or warbling signal of varying pitoh.
"All Clear Signal" shall mean a continuous signal by siren,
whistle, horn, or other audible device of two minutes duration at a
steady pitoh.
"Period of Air Raid Alarm" shall mean the interval of time
between the giving of the air raid warning signal and the giving of
the next succeeding all clear signal.
"Hours of Darlmess" shall mean t be interval of time between
the hour of sunset and the hour of sunrise of the next follOWing day.
"Black Out Structure" shall mean any space so enclosed that any
illumination maintained or existing therein is not visible from any
point outside suoh enclosure.
"Black Out" shall mean all hours of darkness included in a
period of air raid alarm.
Seotion 3. The Chief of Po1ioe of the City of Auburn is hereby
authorized and direoted to cause the sounding of an air raid warning
signal and of an all clear signal when, and only when) this city is
notified so to do by the Second Interceptor Command or any other
proper Federal authority or proper 'authority of the State of Washington.
Section 4. Any person who effeots or maintains any illumination
or permits any illumination under his oontro1 to be effected or
maintained at any p1aoe within the City of Auburn during any period

o~air raid alarm in the hours of darkness except within a black out
struc ture shall be guilty of a mi sdemeanor.
Section 5. The maintenance or leaving of any illumination,
except within a black out structure without provision for its ex-
tinguishment, within one minute after the commencement of a period of
air raid alarm by a competent person over the age of eighteen years
attendant at the place where such illumination is controlled, is
hereby prohibited.
Section 6. In order to enable the Chief of Police to conform
to the request of the Second Interceptor Command or other proper Federal
authority or proper authori ty cl the State of Washington for the
obscuration, diminution or extinguishment of any illumination,
whether in or out of doors,'which increases the vulnerability of the
City of Auburn, or any portion thereof, to air attack or for the
regulation 0 f traffic during the period of air raid alarm, the Mayor
of the City of Auburn may adopt and promulgate reasonable rules and
regulations for such purposes, and any rules or regulations so
adopted by him shall be and remain in effect for thirty days there-
after, but no longer unless approved within said time by resolution
of the City Counci1~ provided, however, that any rule ox regulation
so adopted by the ~~yor may at any time be recinded by resolution of
the City Council. Violation of any such rule or regulation so adopted
and promulgated is hereby declared to be a misdemeanor.
Section 7. It shall be unlawful to disobey any lawful direotion
or order of a police officer, peace officer, highway patrolman, or
fareman given during a period of air raid alarm, which order is
reasonably necessary for the maintenance of public safety or to
effect the extinguishment or obscuration of light.
Section 8. It shall be unlawful to congregate in groups of
five (5) or more persons, exclusive of the Mayor, police and peace
officers, highwqy patrolmen, and firemen, on any public sidewalk,
street, alley or exposed place in the City of Auburn during the
period of air raid alarm.
Section 9. Any illumination contrary to the provisions of this
ordinanoe or to any rule or regulation adopted and promulgated in
accordance with Section 6 hereof, constitutes a public nuisance,
and the same may be summarily abated by any police officer, peace
officer, highway patrolman, or fireman. Any structure may be
entered by any police officer, peace officer, highway patrolman, or
fireman, using ~ reasonable force if necessary for the purpose of
abating such a nuisance by e~tinguishing such illumination.
Seotion 10. At the commencement of a period of air raid alarm,
the operator of any vehicle shall forthwith bring suoh vehicle as
far as possible to the side of the street, road or highway off the
main traveled portion thereof, and the operator of such vehicle
shall bring such vehicle to a stop clear of any crcssing, intersec-
tion, fire house, fire plug, hospital or other emergency depot or
area, and during the hours of darkness shall extinguish all lights
therein or thereon and said vehicle shall ramain so situated during
the period of air raid alarm, unless directed or ordered to move
by a police officer, peace officer, highway patrolm&n, or fireman.
The provisions of this section shall not apply to essential
emergency vehicles such as military equipment, police and fire equip-
ment and ambulances.

Seotion 11. The fOllovling rules and regulat ions as to lights
on motor and other vehicles during blackouts must be striot1y
observed and obeyed:
Rule 1. Headlights, tail lights, and stop lights shall be
covered by a dark oil cloth or rubber mask or hood securely
attached. A horizontal slit 1/2 inch by 3 inches in the lower
portion of headlight lenses covered inside with blue cellophane
will be used.
Rule 2. During blackouts clearance lights must not be used.
Rule 3. Light regulations effeotive o~y during b1aokouts or
air raids and under all other oonditions the legal lights required
by law shall be used. Under no oiroumstances will blue cr colored
lights be used under normal driving oonditions.
Rule 4. Police and Fire equipment and ambulances may use
legal lights during a b1aokout for emergenoy runs only. Under all
other oonditions they will proceed with a minImUm amount of light.
Rule 5. Emergency vehioles must not use sirens in any mRnner
to oonf1iot with air raid warning signals.
Seotion 12. If a blackout extends over a period of several
hours, only emergency traffic essential to national defense will be
allowed to move on the streets and highways suoh as: Defense
materials, supplies, food stuffs, mail, intercity bu~es, and defense
workers. These vehicles shall be equiped with lights" as required
by Seotion 11, Rule 1, of this ordinanoe.
Emergency traffio shall be kept to a ~nlmum.
Vehioles shall keep well spaoed on the streets and highways.
Vehioles shall be operated at a speed that is reasonable and
proper and oonsistent with the oonditions that exist at the point
of operation.
Section 13. It shall be unlawful for any person without
authority, during any air raid alarm, to use, wear, and exhibit or
possess any uniform, insignia, oredentia1, or other indioation of
authority, or any imitation thareof, adopted and issued by any
offioia1 civilian defense organization.
Section 14. Any person who shall operate a siren, whistle
or other audible device in suoh a manner as to simulate an air raid
warning signal or any all olear signal, except upon order of the
Chief of Polioe, or other proper authority, shall be guilty of a
misdemeanor.
Seotion 15. The provisions of every ordinanoe of this oity and
every administrative order made pursuant thereto, requiring any
illumination to be r.laintained in oonf1iot wit h this ordinanoe or wi th
any rule or regulation made pursuant to Seotion 6 of this ordinanoe,
shall be deemed suspended during the period between any air raid
warning signal and the next sucoeeding all clear signal.

Seotion 16. Any person who sha1t1tiolate any provlslon of
this ordinance shall be guilty of a misdemeanor, and, upon convic-
tion thereof, shall be punshed by a fine of not exoeeding $300.00
or by imprisonment not to exceed ninety days or by both such fine
and imprisonment.
Section 17. If any provision of this ordinance or the
application thereof to any person or circumstances is held invalid,
.such invalidity shall not affect other provis ions or applications
of this ordinance which oan be given effect without the invalid
provision or application, and to this end the provisions of this
ordinance are declared to be severable.
Seotion 18. This ordinanoe shall take effect and be in force
five days from and after its passage, approval, and publication as
required by law.
