ORDINANCE NO. 855. .AN ORDINANCE Authorizing and directing compliance with acts o~ Congress and orders promulgated pursuant thereto regulating the buying and selling of certain materials, supplies and equip- ment; and authorizing compliance with the Water Supply Mutual .lid Program of the Washington State Defense Counoil; proTiding that on account of the war emergency ordinances and Charter provil1ons regulating the purchase and sale by the various departments of the City ot such materials, supplies and equipment be suspended during such time as the purchase or sale thereof shall be regulated pur- suant to acts of Congress, or I1S may be required to oooperate with the Water St.pply Mutual J.1d Program o~ the Washington State De~ense Council; de<<laring a public emergency and prOdding that this Ordi- nanoe shall take effect immediately after publioation. THE CITY COUNCIL OF THE CITY OF .lUBURN DO ORD.AlN AS FOLLOWS: SECTION 1. That whenever an aot of Congress or an order promulgated pursuant to an act ot Congrees shall regulate the sale and purohase ot materials, supplies and equipment, and the regulation so preseribed shall be appllo'able to sales and purchases by the City ot Auburn and shall be in conflict with the provisions ot ordinances or the City Charter regulating sales and purohases by the City, it is hereby determined and directed that purchases and sales o~ materials, supplies and equipment for the various departm.ente ot the City be made in the manner prescribed by suoh act of Congress or rules promulgated pursuant thereto and that the provisions of the City Charter and of any ordinances which mar be in conflict with the regulations prescribed by or pursuant to act ot aongress shall be c.ons1dered as inoperative and as suspended. ..~ SECTION 2. That whenenr cooperation by the City o~ J.uburn with the Water Supply lIutual .lid Program of the Washington State De~ense Counoil oonflicts with prov1eions ot ordinances or the City Charter regulating sales and purchase. ot materials, supplies and equipmlU1;!." It is hereby determined that the provisions of the City Charter and of any ordinances which may prohibit the City cooperating or participating in the Water Supply Mutual Aid Program of the Washington State Defense Council shall be oon- sidered as inopera.tive and as suspended. SECTION:5. That by reason of the extraordinary war emergency now existing, it is imperative that the provisions of this ordi- nance beoome effeotive without delay and by reason thereof a public emergency is hereby declared to exist making it necessary that this ordinance shall become effective immediately after publication as required by Law.
