AN ORDINANCE vacating the south 20 feet of that portion of Main STreet ,East in the City of Auburn adjacent to Lots 1 2 3 4, 5, 6 and 7 in Block 1 of French's Seoond Addition to Siaught~r and providing that the title to all of the vaoated area shall vesi in the owners of the abutting property. WHERE!S,.heretofore, to-wit: on or before May 4, 1943, Herman Sohultz, Gordon polley, and I. T. Yark oaused to be filed with the City Clerk of the City of Auburn thair petition in writing, addressed to the City Council of tha City of Auburn, praying that the south 20 feet of all that portion of Main Street East in the City of Auburn adjacent to Lots 1, 2, 3,4, 5, 6 and 7 in Block 1 of Frenoh1s Seoond Addition to Slaughter be vaoatedj and WHEREAS, heretofore, to-wit: on the 4th day of May, 1943, at a regular meeting of the City Counoil of the city of Auburn held on said day, it was made to appear to the satisfaotion of said City Counoil that said petitioners were the owners of all of the private property abutting upon that portion of said Main street East so sought to ba vacated, and said City Counoil did then and there, by resolution, fix and designate Tuesday evening. .Tune 1, 1943, at 8 P. M., at the City Hall in the City of Auburn, King County, Washington, as the time and plaoe when and where said petition would be heard by sald City Counoilj and WHEREAS, pursuant to the provisions of said resolution, the City Clerk of the City of Auburn did thereafter and on the sixth day of May, 1943, and more than 20 days prior to the day fixed for suoh hearing as aforesaid, duly give twenty days' notioe of~th, ..,; !,..,.,..~. pendenoy of said petition by a typewritten notioe set up and posted in three of the most publio plaoes in the City of Auburn and by a like typewritten notioe set up and posted in a conspicuous place on the portion of said Main Street East so sought to be vaoated, which typewritten notioe was signed by the City Clerk of the City of Auburn and oontained a statement that a petition had been filed to vaoate the south 20 feet of that portion of Main Street East in the City of Auburn adjaoent to Lots 1; 2, 3,4, 5, 6 and 7 in Block 1 of French's Second Addition to Slaughter, and that June 1, ~943, at 8 o'olock p.m., at the City Hall in the City of Auburn, King County, Washington, had been fixed and determined as the time and place for the hearing of said petitionj and WHEREAS, due proof by affidavit of the posting and setting up of said notioes as aforesaid is now on file in the offioe of the City Clerk of the City of Auburnj and WHEREAS said petition oame on regularly to be heard by said City Council o~ said June 1, 1943, at 8 o'clook p.m., at the City Hall in the City of Auburn, King County, Washington, (that being the time and. place fixed for said hearing as aforesaid), and no wtitten or other objeotions having been submitted to the City counoil or filed with the City Clerkj and. .,::'< I ~ ',':;-.' .. WHEREAS, it has been made to appear to the satisfaction ot the said City Counoil of the City of Auburn that the portion of Main Street East so sought to be vacated is of no use to the City of Auburn or to the publio for street or other purposes; and WHEREAS, the city Counoil of the City ot Auburn~being tully advised of the faots and the law in the premises, has ordered the preparation of this Ordinanoej NOW, therefore, the CITY COUNCIL of the CITY OF AUBURN do ordain as follows: Section 1. That the south 20 feet ot that portion ot Main Street East in the City of Auburn, 1n the Oounty of King. state of Washington, abutt1ng upon and adJc)1ning Lots 1, 2, :3, 4, 5, . and 7 1n Blook 1 ot Frenoh's Seoond Addition to Slaughter, as the same appears on the reoorded offioial plat thereof, be and the same hereby is vaoated, and that ..id vacated portion shall be attaohed to tho private property abutting thereon as provided by law.
