ORDINANCE NO. 858
AN ORDINANCE providing for the lioensing of oard rooms, regula-
ting the operation thereof, providing for the revooation of oard room
1ioenses, presoribing penalties, and deo1aring portions of former ord-
inanoes of the City of Auburn in conflict or inconsistent with the proy-
isions of this ordinanoe to be superseded by this ordinance.
THE'C1TY~COUNCIL-OF'I'HE CITY OF AUBURN DO ORDAIN-AS FOLLOWS:
Seotion 1.

This ordinanoe, and the enforoement thereof, is
maintain the peaoe, good government and welfare of
and as neoessary and proper local, police regulations.
Seotion 2. The word "person" whenever used in thia ordinanoe
shall be held and construed to mean and include natural persons, firms,
co-partnerships and oorporations, whether aoting by themselves or by a
servant, agent or employee.
Seotion 3. The words "oard room" whenever used in this ordinanoe
shall be held and construed to mean a p1aoe of business oonduoted for gain
and profit, in whioh are contained one or more oard tables upon whioh
games with cards are or may be played.
Seotion 4. It shall be un.lawfUl for any person to maintain or
operate any oard room in the city of Auburn unless suoh person shall then
be the holder of an unexpired, unrevoked license therefor, issued by the
City of Auburn, in which said person is named as licensee.
Seotion 5. No 1ioense shall be granted or issued by the City of
. Auburn ~tO' any.person to maintain or operate a oard room until after .suoh
person shall have made written application therefor, paid to the City of
Auburn the proper license fee, and the granting of such lioense shall
have been ordered by the City Council and such lioense issued as herein-
after provided.
Seotion 6. Eaoh lioense to be issued hereunder shall be for the
period of a calendar year, beginning on January first and ending on the
last day of December of the same oa1endar year, or for a period of less
than a calendar year and ending on the last day of December of the same
calendar year. The fee for suoh license shall be 0 ~ (J{) for one card
table, and $ . ~ for each additional card tab e.
Section 7. Every applioant for a license hereunder shall make a
written application therefor, addressed to the City Counoil, subscribe
app1icantts name to the application, and file the same with the City Clerk.
The city Clerk shall read aloud said application at the next regular meet-
ing of the City Council, and the same shall be then referred to the Lio-
ense Committee of the City Council for investigation and report. Each
app1ioation shall state (1) the name and plaoe of residenoe of the app1i-
oant, (2) the number of card tables to be operated under the license applied
for, (3) the names of all persons, if any, other than applicant, interested
in the business to be conduoted under such license, (4) that the app1ioant
has not been oonvicted in any oourt of any violation of the laws of the
State of Washington or the ordinances of the City of Auburn relating to
gambling or games of chance, or involving moral turpitude or intent to
defraud, and (5) shall accurately describe the premises where such business
is to be oonducted during the period ot the license applied tor. After the

report ot the Lioense Committee upon suoh applioation to the City Counoil,
the City Counoil, it satisfied that the statements oontained in suoh ap-
p1ioation are true and that app1ioant is of good moral oharaoter, may in
its disoretion, grant or rejeot suoh app1ioation, and if granted order the
1ioense issued. If ordered granted, the app1ioant shall forthwith file
with the City Clerk the offioial reoeipt of the City Treasurer showing
full payment of the lioense fee hereinbefore fixed, and thereupon the City
Clerk shall issue to suoh applicant the license, specifying therein the
number of tables authorized thereby, and a definite desoription of the
premises where the business is to be oonduoted. Such license shall be for
the term of one oalendar year or the unexpired fraction of suoh year.
Seotion 8. In addition to other penalties provided by law, the
City Counoi1 expressly reserve4 unto itself the right to revoke any lio~
ense issued under._the provisions. of this ordinanoe, at anYe time, when the
same was prooured by-fraud or false representation of fact, or where it
shall be proved to the satisfaotion of the City Counoil that the 1ioensee,
or any employee of the lioensed plaoe, while aoting within the scope of
his employment, shall have been oonvioted or shall have forfeited any
bond upon a oharged violation of tb.is ordinance, or any law of the State
of Washington, or of the United States, relating to gambling or games of
ohanoe, or the possession or sale of intoxioating liquors, or narootio
drugs. ~t least three days before revoking any license, the City Counoil
shall oause to be mailed to the holder of suoh license at the address at
whioh such oard room is oonducted, or to be delivered to the licensee
personally, a notice stating the time and place of hearing conoerning
suoh proposed revocation and that the licensee shall be entitled to be
heard thereat and to introduce the testimony of witnesses. The aotion of
the City Council, after suoh hearing relative to such revooation, shall
be final, and in case suoh license shall be revoked no 1ioense under the
provisions of this ordinance shall be issued to the person whose license
has been so revoked for a period of ~~ months from and after the date
of such revooation.
Section 9. All oard rooms shall be so oonstruoted and arranged
and maintained that there shall be kept, at all times, an open spaoe suf-
ficient to provide a olear, uninterrupted view of the same from without.
In oase any oard.roomsha11 be located in a basement or above the street
level, it shall be so construoted and arranged, and at all times main-
tained so as to provide a maximum view of the interior from the entrance
thereto.
Seotion 10. No lioense granted hereunder shall be assignable or
authorize the oonduot of the business thereby 1ioensed in any other place,
or by any other person, than as designated in suoh 1ioense.
Section 11. It shall be unlawful for the owner or any manager
or other person in oharge of or employed in any card room,
(1) to admit or allow to remain therein any person under the age of twenty-

(2) to permit suoh card room to be kept open or any playing of cards~bet-
ween the hours of /.e:O/ o'olook A. M. and ~:Ot) o'olook A. M. of anyone
day, or
(3) to oonduot or ,ngage in or to permit any gambling in suoh card room, or
(4) to exchan~or oash or money any ohecks or tokens redeemable in mer-
ohandise.
Seotion 12. Any person who shall violate any of the provisions
of this ordinanoe shall be deemed guilty of a misdemeanor, and shall be

Seotion 13. All portions ot former ordinanoes ot the City of
Auburn in oonf1iot with or inoonsistent with the provisions ot this
ordinanoe, if any, shall be held ano1. construed to be superseded by the
provisions ot this ordinanoe, in so tar and only in so tar as the same
are so in oonflict or inoonsistent with this ordinanoe.
Seotion 14. It any section or subdivision, sentenoe, olause
or phrase ot this ordinanoe is, for any reason, held to be invalid, suoh
deoision shall not effeot the validHy of the remaining portions of this
ordinance.
