E., in the City of Auburn, situate North of the North marginal line of 4th street N. E. WHEREASi"heretofore, to-wi"t: on August 3, 1943, David A. Bot- ting and Ruby S. Botting, his wife, caused to be filed with the City Clerk of the City of Auburn their petition in writing, addressed to the Mayor and City Council of the City of Auburn, praying that all that portion of I street N. E., in the City of Auburn, situate North of the North marginal line of 4th street N. E., in said city, be vacated, and WHEREAS, heretofore, to-wi't: on said 3rd day of August, 1943, at a regular meeting of the City Council of the City of Auburn held on said day, it was made to appear to the satisfaction of said City Coun- cil that said petitioners were the owners in fee simple of all of the private property abutting upon that portion of said I street N. E., so sought to be vacated, and said City Counoil did then and there, by res- olution, fix and designate Tuesday evening, September 7,1943, at 8 o'clock P. M., at the City Hall in the City of Auburn, King County, Washington, as the time and place when and where said petition would be heard by said City Council, and WHEREAS, pursuant to the provisions of said resolution, the City Clerk of the City of Auburn did thereafter and on the 7~ day of August, 1943, and more than t~enty ~ays prior to the date fi~or suoh hearing, as aforesaid, duly gave twenty days notice of the pendenoy of , said .petition, by a typewritten notioe set up and posted in three of the most public places in~the City of Auburn, and by a like typewritten not- ice set up and posted-in a conspicuous place on the portion of said I Street N. E. so sought to be vaoated, which typewritten notice was signed by the City Clerk of the City of Auburn, and contained a statement that a petition had been filed to vacate all that portion of I Street N. E., in the City of Auburn, situate North of the North marginal line of 4th Street N. E., and that'September 7, 1~45,.at 8 O'clock P. M., at the City Hall in the City of Auburn, King County, Washington had been fixed and determined as the time and plaoe for the hearing of said petition; and WHEREAS, due proof by affidavit of the posting and setting-up of said notices as aforesaid is now on file in the offioe of the City Clerk of the City of Auburn, and WHEREAS, said petition came on to be heard by said CITY COUNCIL on the 7th day of September, 1943, at the City Hall in the City of Aub- urn, King County, Washington, and no written or other obJeotions having Y been submitted 1, the City Council, or filed by the City Clerk; and VnrKREAS, it has been made to appear to the satisfaction of the City Council of the City of Auburn that the portion of I Street N. E. so sought to be v.sc!!!ted is of no use to the City of _AUburn, .orto the public, for street or other. purposes; and - WHEREAS, the City Counoil of the City of Auburn, being tully advised of the facts and the law in the premises, has ordered the prepar- ation of this ordinancel NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN DO ORDAIN AS FOLLOWS: . ;. .........~ .,r ~.", .. ~~~' .. . -' ,-.. -- .-.., . E., in said city, be and the same hereby is vacated, and that said vacated portion of I street N. E. shall be attached to the private property abutting thereon, as provided by law. Section 2.
