successors and assigns, under the imminent threat of the Grantee's exercise of its rights of
Eminent Domain, the property legally described as follows:

attached hereto and made a part hereof.
The Grantor, for itself and for its successors in interest, does expressly limit the covenants of the
deed to those herein expressed and exclude all covenants arising or to arise by statutory or other
implication and does hereby covenant that against all persons whomsoever lawfully claiming or
to claim by, through or under said Grantor and not otherwise, the Grantor will forever warrant
and defend the said described real estate.

matters which may appear in the public record, including those shown on any recorded plat or
