AN ORDINANCE OF THE CITY COUNCIL OF THE GITY OF AUBURN, WASHINGTON, AMENDING
3 CERTAIN SECTIONS OF THE AUBURN CITY ZONING ORDINANCE N0. 4229, CODIFIED
AS TITLE 18 RELATING TO FIAZARDOUS WASTE AND SUBSTANCE AMENDMENTS.

WHEREAS, the State of Washington Department of Ecology has approved the
5
hazardous waste zoning ordinance amendments on August 11, 1988; and
6
WHEREAS, the amendments comply with the requirements of Chapter 70.105
7
RCW, the Department of Ecology's hazardous waste zoning guidelines and State

siting criteria;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO

ORDAIN AS FOLLOIJS:

Section 1. City of Auburn Zoning Ordinance No. 4229, codified at Title 18
12
(Zoning), is hereby amended to add or modify specified subsections relating to
13
hazardous waste and substance amendments.

Section 2. The following subsections are hereby added to include
15
necessary definitions.

18.04 DEFINITIONS.

18.04.285 Dan erous Waste. "Dan erous waste" means those solid
18 wastes desianated in WAC 3-303-070 throuah 173-303 103 as
danqerous waste.

18.04.295 Desianated Facility Zone "Desiqnated Facilit Zone"
20 means a zoninq district in which hazardous waste treatment and
storaqe facilities are allowed uses sub'ect to the state sitina
21 criteria desianated in Chapter 70 105 RCW
22 18.04.355 Eztremely Hazardous Waste "Extremelv hazardous waste"
means those solid wastes desianated in WAC 173-303-070 throuah
23 173-303-103 as extremel hazardous waste
24 18.04.45r2 Hazardous Material .
25 18.04.453 Hazardous Substance. "Hazardous Substance" means an
iquid, solid, qas or sludae includina any material substance
2g pcoduct, commodity, or waste reaardless of quantit that exhibits
any of the characteristics or criteria of hazardous waste as defined
2� by Chapter 7 3,303 WAG.

18.04.454 Hazardous Substance Processinq or Handlina "Hazardous
2 Waste Processinq or Handlina" means the use storaqe manufacture
production, or other land use activity involVina hazardous substan-
3 ces. Hazardous substances processin and handlina activities do not
include individually packaaed house-hold consumer products or quan-
4 tities of hazardous substances of less than five gallons in volume
per container.

18.04.455 Hazardous Waste. "Hazardous waste" means and includes

7 18.04.456 Hazardous Waste Storaae. "Hazardous waste storaae" means
the holdinq of hazardous waste for a temporarv period Accumulation
8 of waste on the site of eneration is not stora e as lon as the
storage complies with app icable requirements of Chapter 73-303

10 18.04.457 Hazardous Waste Treatment. "Hazardous waste treatment"
means the physical , chemical or bioloaical processin of danaerous
11 waste to make such wastes nondanoerous or less danqerous safer for
transport, or amenable for eneray or m8terial resource recoverv

18.04.458 Hazardous Waste Treatment and Storaae Facilit Off-site
13 ' Hazardous waste treatment and storaqe facilitv off-site" means the I
treatment and stora e of hazardous wastes from enerators on ro-
14 perties other than that on which the off-site facilit is ocated
l5 18.04.459 Hazardous Waste Treatment and Stora e Facilitv On-Site
Hazardous waste treatment and storaae facilitv on-site" means the
16 treatment and storaae of hazardous wastes qenerated on the same site
17 Section 3. The following subsections are hereby amended to classify cer-
lg tain commercial and industrial zones as designated facility zones allowing on-
19 site hazardous substance processing and handling, and hazardous waste
2p treatment and storage facilities:

Chapter 18.22 RO (Residential Office) and RO-H (Residential
22 Office-Hospital District) :

24 18.22.060(D). No on-site hazardous substance processinq and

use. On-site hazardous waste treatment and stora e facilities shall

No hazardous substances or wastes shall be released into the
2 environment so as to cause danaerous or offensive emission or con-
tamination of anv public or private water supply sewaae treatment
3 processes, watercourse or water body, the air, or, the around,
except in accordance with standards approved by provisions of
4 federal , state and local laws and reaulations
5 Section 6. The City has complied with all requirements of the Washington
g State Environmental Policy Act including the issuance of a Declaration of
7 Non-Significance, in accordance with RCW 43.21C et seq. The Ordinance
g amendments herein are in compliance with the requirements of Chapter 70.105
g RCW, pursuant to the determination of the State Department of Ecology by
10 letter dated August 11, 1988, attached and designated Exhibit "A" and incor-
11 Porated by reference in this Ordinance.
12 Section 7. The Mayor is hereby authorized to implement such administra-
13 tive procedures as may be necessary to carry out the directions of this
14 legislation. I
IS Section 8. This Ordinance shall take effect and be in force five (5) days
16 from and after its passage, approval and publication, as provided by law.
