A suggestion ofaddingtes wells starting with a base line now and creating aboundary around the existing wetland to monitor any future expansion of the wetland. Also adding trees since no buffer was established creating a slope direct to the cemetery property. A drainage easement will hold the HOAof the development responsible for any future issues. Jamie Kelly (O]A' Parks Planner and Development Manager) was able to explain the rules for wetland buffer and development that the builder should have been required to do. Discussion on whether a public hearing ever addressed the current issues in years prior without coming toaconclusion. Irrigation Water — The onsite irrigation well was never technically capped. This is based oninformation from the Department of Energy. A 1975 water rights application, testing and a letter from 1976 indicate that there was not enough water volume and the application was canceled. The DOE has made the suggestion to bring on a well professional to reevaluate the well for irrigation. |s the cost of the initial development and the legal fees to possibly establish the water rights even feasible verses continuing the water service provided by Lake Haven Water District?
