HomeMy WebLinkAboutAuburn Police Guild MEMORANDUM OF UNDERSTANDING By and Between CITY OF AUBURN And THE AUBURN POLICE GUILD The City of Auburn (City) and the Auburn Police Guild (Guild) are parties to the 2013-2015 collective bargaining agreement (CBA). Officer James Hamil separated from the City on June 2, 2015. During the exit interview, Hamil asked about the thirty-five percent (35%) sick leave reimbursement upon his separation, which is in Section 11.6 of the current CBA. At that time, he was told that he was not eligible to receive the sick leave reimbursement because the CBA said that an employee would be eligible "upon retirement, death, or disability retirement." It was explained to Hamil that, although he was separating from law enforcement to go into nursing, he was not of an age to be eligible for retirement. Therefore, the City viewed his separation as Hamil simply leaving City employment, which is not a qualification for sick leave reimbursement for an Officer of Hamil's longevity. Hamil said that he was disappointed and was under the impression that he would be eligible based on his completion of over fourteen (14) years of service. After much consideration and in the spirit of cooperation and goodwill, the City will grant the request of the Guild to allow Hamil to cash out thirty-five percent (35%) of his sick leave. This is a one-time decision and shall not be precedent setting. Furthermore, to be eligible for future sick leave reimbursement, an officer hired after November 30, 1993, with between fourteen (14) to twenty-four (24) years of service must be separating due to retirement, death, or disability retirement. Retirement for the purposes of the CBA and this memorandum of understanding (MOU) shall be retirement eligible as defined by LEOFF. Except as expressly amended herein, all other provisions of the January 1, 2013, through December 31, 2015, collective bargaining agreement between the City of Auburn and the Auburn Police Guild remain in full force and effect.
