HomeMy WebLinkAbout2493 1 RESOLUTION NO. 2 4 9 3 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, APPROVING THE PRELIMINARY PLAT OF A 18-LOT SINGLE- FAMILY SUBDIVISION TO BE KNOWN AS "VELVET SQUARE" LOCATED 4 NORTH OF 21ST STREET S.E. , EAST OF "M" STREET S.E. , WITHIN THE 5 CITY OF AUBURN, WASHINGTON. 6 WHEREAS, Application No. PLT0002-93 , dated October 27 , 7 1993 , has been submitted to the City of Auburn, Washington by 8 STOBIE & ASSOCIATES. , requesting approval of a Preliminary 9 Plat for an 18-lot single-family subdivision to be known as 10 "Velvet Square" located north of 21st Street S. E, east of "M" 11 Street S.E. , within the City of Auburn; and 12 WHEREAS, said request above referred to was referred to 13 the Hearing Examiner for study and public hearing thereon; and 14 WHEREAS, pursuant to staff review, the Hearing Examiner 15 conducted a public hearing to consider said petition in the 16 Council Chambers of the Auburn City Hall on February 15, 1994 , 17 at 7 : 00 p.m. , at the conclusion of which the Hearing Examiner 18 recommended approval of the Preliminary Plat, based upon the 19 following Findings of Fact and Conclusions, to-wit: 20 21 FINDINGS OF FACT 22 1. The applicant, Stobie and Associates, through its 23 engineer, Andy Rykels, P.E. , requests preliminary plat approval of an 18 lot single-family subdivision. 24 25 26 -------------------------- Resolution No.2493 March 1, 1994 Page 1. 1 2 . The subject property is 4 . 33 acres in size and is located 2 north of 21st Street S. E. , east of "M" Street S.E. , and west of the bowling alley. 3 3 . The subject property is currently vacant, but is zoned R- 4 4 , multi-family. 5 4 . The Comprehensive Plan designates the subject site for multi-family uses. Existing zoning and land uses in the 6 vicinity include C-1, commercial to the north; R-2 , single-family to the south; C-1, commercial to the east; 7 and R-2 , single-family to the west. 5. The plat will be provided access with an existing "stub" 8 street which intersects with 21st Street S. E. The "stub" 9 is not constructed; however, its right-of-way was dedicated in 1957 as part of an adjacent subdivision. 10 6. The street which will serve the proposed division will 11 terminate in a cul-de-sac. The length of the street measured from the north right-of-way to the center of the 12 cul-de-sac is 607 feet. If measured to the nearest radius of the cul-de-sac, the length is 562 feet, but if 13 measured to the outer edge of the cul-de-sac the length is 652 feet. 14 7 . The Land Division Ordinance limits the length of cul-de- 15 sacs to not more than 600 feet. However, the Land Division Ordinance does not stipulate how the length is 16 to be measured. Accordingly, the proposed plat meets the requirement of the Zoning Ordinance particularly when one 17 considers that due to the existing zoning up to 78 units could be developed on the site. 18 8 . Single-family uses are permitted in multi-family zones 19 pursuant to Zoning Code Section 18 . 18 . 020 (A) . However, a restriction should be placed on the plat which would 20 preclude future conversions to multi-family uses. Any future multi-family use would not be compatible with the 21 plat as proposed or the existing single-family neighborhood adjacent to the site. 22 9. There is illustrated on the plat a "Tract All which is 23 intended to be a storm drainage infiltration area. This tract should be designed, screened, and landsdaped to be 24 compatible with a single-family neighborhood and should be dedicated to the City. 25 26 -------------------------- Resolution No.2493 March 1, 1994 Page 2 1 10. There are existing utility, ingress, and egress easements 2 which will underlie the proposed right-of-way. These should be removed to alleviate future ownership concerns. 3 11. The utility and traffic studies done as part of the environmental checklist indicate a lack of an adverse 4 impact to the public infrastructure. 5 12 . At the time of the public hearing, an adjoining neighbor 6 expressed concern with regard to the adequacy of the width of the ingress and egress. In response, the City 7 indicated that the 50 ft. right-of-way is the standard residential street right-of-way. The City also indicated 8 that the Fire Department has reviewed the application. 9 13 . The staff report with its recommendation of conditional approval is incorporated herein by reference as those set 10 forth in full. 11 12 CONCLUSIONS OF LAW 13 14 1. The Land Division Ordinance sets forth criteria which must be established prior to the time that a preliminary 15 plat may be approved. 16 2 . The Ordinance requires that adequate provisions are made for public health, safety, and general welfare, and for 17 streets, alleys, or other public ways. Adequate provisions have been made concerning access and 18 utilities. Due to the small size of the plat, parks and schools will not be adversely impacted. 19 3 . The proposed subdivision must conform to the general 20 purposes of the Comprehensive Plan. A portion of the Comprehensive Plan, Goal 16, attempts to conserve 21 existing single-family neighborhoods while promoting the development of new single-family neighborhoods. 22 Accordingly, the proposed subdivision conforms to the Comprehensive Plan. 23 4 . There are no other specific plans which apply to the 24 proposal... 25 26 Resolution No.2493 March 1, 1994 Page 3 1 5. The plat provides convenient travel and promotes the 2 effective use of land in accordance with Section 17 . 02 . 030 of the Land Division Ordinance. 3 6. The plat illustrates that it either meets or is capable 4 of meeting the requirements of the Zoning Ordinance together with the City's engineering standards. 5 7. The potential environmental impacts of the proposed 6 subdivision have been mitigated such that the preliminary plat will not have an unacceptable adverse impact upon 7 the quality of the environment. 8 9 For each of the above stated reasons, the recommendation 10 of the Hearing Examiner to the Auburn City Council on the 11 application for a Preliminary Plat is approved and confirmed. 12 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, 13 WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH 14 RESOLVES THAT: 15 Section 1. The above cited Hearing Examiner's Findings 16 and Conclusions are herewith approved and incorporated in this 17 Resolution. 18 Section 2 . The Preliminary Plat of "Velvet Square" , an 19 18-lot single-family subdivision containing 4 . 33 acres, 20 located north of 21st Street and legally described on attached 21 Exhibit "A" , is approved. 22 Section 3. Restrictions shall be recorded on the final 23 plat that would allow only single-family homes, and its 24 accessory uses and/or structures on each lot. 25 26 -------------------------- Resolution No.2493 March 1, 1994 Page 4 1 2 Section 4 . Tract "A" which contains the storm water 3 facilities shall be designed to be compatible with a single- 4 family neighborhood. The design shall consider minimum 5 slopes, minimum water depth and appropriate landscaping. 6 Tract "A" shall be dedicated to the City as part of the final 7 plat. 8 Section S. The conflicts with the existing easements 9 with the proposed dedicated right-of-way shall be resolved to 10 the satisfaction of the City Engineer, prior to final plat 11 approval. 12 Section 6.
