This Agreement is between the City of Auburn (hereinafter called
the "City") and the International Associations of Firefighters,
Local No. 1352 (hereinafter called the "Union") for the putpose
of setting forth the mutual understanding of the parties as to
conditions of employment for those for whom the City recognizes
the Union as the collective bargaining representative.

1t�is Agreement is made and elitered into by and between the City of Auburn,
hereinafter referred to as the "City", and the International Association of
Eirefighters, Local No. 1352, hereinafter referred to as the "Union".
ARPICLE I - R�TITION
Sect"ion 1. 7t�e City recognizes the Uniaa� as the sole and exclusive
bargaining agent for the pi�rpose of establishing wages, hours and other wn-
diti�s of employment for all of its full-time department e�loyees e�loyed
in hork classifications set forth in ApF.endix "A".
Section 2. 7t�e probationazy period for a new eoployee shall be in acoor-
dance with Civil Service Eh�les and Regulatioais.
ARTICLE II - UNION S�C[7RITY ADID DF�LT(.TION OF DUFS
Section 1. Each e�loyee oovered b� this Agreement who is a manber of the
Union on or after the effective date of this Agreement, shall as a wndition
of oontiriued �loyment, remain a tmrd�er of the Unim duri.ng the term of this
AgreemPnt. Fach employee hired after the effective date of the Agree�nent
shall within a period of thirty-orie days omonencing fran the first date of
esnploylrent as a oondition of cor�tinued a�loyment make applicatian to and
beo��e a m�nber of the Union; or, in the case of �loyrees with a bona fide

religious objectim to joinirig the Union, contiibute an �noant ecji�al to the.
periodic dues and initiation fees uriifoimly required as a oondition of
acquiring or retaining mPmbership to a mutually agreei3 upon charitable organi-
zation as provided for in R(,�1 (Y�apter 41.56.
Section 2. 'Itie City agrees to deduot each month Uni� dues equal to one
percent (1$) of a First Class Firefighter's base wage and asses9nents fran the
e�lopee's i,rages in the manner prescribed by law. �e amoimt so dediicted
shall be sent each payday to the Uni�.
Atticle III - Uni� ActibitY
The City agrees rnt to discrvninate against any enployee for lawful acti-
vity in behalf of or m�nbership in the Union. The Union alsb agrees mt to
discriminate against an employee of the City for their failure to join the
Unimi.
AKPICLE IV - F%RJRS OF NARK APID dS7EIa.'IME
Section .l. Fbr e�loyees having twenty-four (24) hour duty shifts, shifts
shall begin at 7:00 a.m. arid expire tHe following day at 7:00 a.m., providing
that shifts oocurring � Sundays and holidays established by City Ordinance
shall oamience at 8:00 a.m, This regular workweek shall not excecd an average
of forty-eight point three (48.3) hours or 2511.60 annually exclusive of the
additional one hour incurred ielative to the special Suridap arx3 holiday
shifts. This shall be acoomplished by the use of, credit shifts (24 hours) to
be sdxduled evenly throughout the year.
Section 2. Zhe rnrnial wvrkweek for day shift persorinel shall not ezceed
forty (40) hours per workweek. As mutually agreecl, the e�loyee may work five
(5) eight (8) hour days (Monday through FYiday) or four (4) ten (10) hour days

(Nbnclay through Thursday) or (�esday through Friday) .
_ Section 3. All off-shift personnel will be paid a minimian of two hours
pay at his/her overtime rate when called back to duty when off shift. All
personnel called back to duty for an �nergency situation shall be released as
soon as the emergency is over and the eguipment that was used is put back in
service.
Secti� 4. An employee shall be paid for oyertime at the rate of time and
one-half the stzaicjht time hourly rate for his/her individual classification.
Fbr overtime purposes mly the straight time hourly rate shall be determined
by multiplying monthly rates (stated in Appendix "A") by twelve and dividing
that airo�mt 6y 2060.
Section .5. Whes�ever possible, additional manpower requir�nent of the Fire
DepactmPnt shall be met by first affording the opport�mity to hork to full-
paid members of the Fire Department.
Section 6. Credit shifts may be traded between employe��, or moved with the
Shift Officer's approval as long as there remains the mini�an rn.�mber of inen �
duty. Shift Officer credit shift moves may be authorized by the C�ief of the
Departrnent or designee.
ARTICLE V - FTF�GFS
Section 1. FSnployees oovered by this Agreement shall, campncing January
1, 1984, be amg�ensated in �cordance with the qrage schedule attached to
this Agreement and marked Appendix "A". Additirnally, this wage schedule ahall
be increased by 808 of the November 1984 CPi�I o� January 1, 1985. 1t�e 808 CPI
increase shall have a maximian increase of 6.08, and a miniman increase of 4.08.

Section 2. Proficiency pay in the atrount of two percent (28) of a
_ Firefighter First Class base salary regardless of rank as set forth in
Apperxlix "A" shall be applied to the base salary for each bargaining imit
member holding a valid F]rergencj+ Medical �+ectinician (FMf) Certificate fran the
State of Washington, and the clepartmental mechanic.
Section 3. �loyees in the bargaining im it that have wmpleted wurses
a�licable to a fire science degtee, shall be paid an educational incentive
based on the following percentages of a First Class Firefighter's base salazy
regardless of rank as listed in Appendix "A" for credits oong�leted:

Section 4. L�gevity pay shall be paid regardless of rank to job classi-
fications of Firefighter, Lieutenant and Captain upon oompletion of years of
service in accordance with the follaaing schedule:

Sectia� 5. Any e�loyee bem�orarily assigned by the Chief of the
Department to work in a higher classification shall be paid at the established
rate of pay for such classificati� while performing such duties with payment
to be made oa�ing with the first shift.
Secti� 6. An e�ployee required to appear in oourt during off-duty hours
as a wi�ss ori behalf of the �loyer ralative bo a duty-related inci�nt
shall be oaa�ensated for a minitman of two (2) hours to a �ximan of four (4)

Hours at time and one-half for actual attendance at the aourt hearing per
calendar day. '
Section 7. Ztie base hourly rate of pay, ezcept of calculating overtime
pay actually worked, shall be equal to the (m�thly base X twelve) - (regular
workweek X fifty-two) .
Section B. 7t�e Fire Fighters' cvrrent rate of pay shall be equal to the
(mos�thly base rate of pay plus inoentives, including l�gevity X 12) -
(the work week X fifty-two) .
Section 9. Paydays shall be an or before the fifth and twenthieth of each
month. Should a special circimstance or problem occuc regarding ttie distribu-
• tion of checks on these dates, the Finance Departinent will notify the Uni�
President of the alternate pay plan.
Section 10. Effective 1-1-84, the follaaing pay differential is hereby
established: A) Hetween First Class Fire Eighter and Lieutenant, 110$ of FFIC
base; B) Hetween Lieutenant and Captain, 1208 FFIC base.
Article VI - Holidays
Sectirn 1. Fbr pirposes of this Agreement holidays shall start at the
begirming of his/her normal shift of the day itself and oontinne for the next
thenty-four hours.
Section 2. All shift personnel shall be allowed five shifts leaye
annually regardless of shift assigrmient in lieu of holidays. Holidays may be
� sd�eduled any time with the approval of the Shift Offioer as lang as there
remains the required miniman rnm�ber of personnel on duty. Aolidays may be
taken with the apprwal of the Shift Officer in half�ay shift increments (12

hoars) o�ing at 7:00 a.m. or 7:00 p.m. Holidays shall not be oon-
secutively granted to any �lopee of the Fire Department unless the Fire
Chief finds that there aze special circ�mstances justifying the same and that
the extended absence of such ee�loyee shall rnt ing�air the efficiency of the
Department.
Sectian 3. At the discretion of the firefighter, upon written request to
the Departrrent Iiead no later than November 30, the C�ty agrees to pay at
firefighter's current rate of pay a maxuman of two iuiiised shifts of holiday
leave. Payment shall be made by separate check on or before December 20 of
each year.
Secti� 4. Fhg�loyees called back to work on schedule shifts off that fall
� the following tiolidays established by City Ordinance shall be paid two
times their hourly rate of pay in a000rdance with the ovectime formula in
additirn to rormal cximpensation.

Section 5. Holidays taken in any �rcwnt shall be subject to being b�nnped

Article VII - Vacation
Secti� 1. Fach member of the Fire Departrent shall be granted a vacation
in each calendar year without loss of pay. Such vacations shall be oo�uted
in accordance with Secti� 4 and 5 of this Article and under the direction and
supervision of the Chief of the Fire Departnent.
Section 2. Vacation shall be ahosen by individual firefighter per
' DepartmPnt 13iles and Regulabions as stated belaa:
Vacatiai may be takPn in one shift increments by twenty-four hour
shift e�loyees but will be subject to being bCa�ed by a vacation period
of two (2) oc more shifts with thirty (30) days notice during the months
of January, February, March, April, May, September, October, November and
December.
During the months of June, July and August, vacati� mist be taken in
anaiuit of three (3) or �rore o�nsecutive shifts to hold vacation privi-
leges. If less than three shifts of vacati� aze taken during this period,
they shall have the same rights as a holiday and be subject to being
b�ed by regular vacation periods of ttiree (3) or more shifts. No more
than two (2) periods of three (3) or more shifts shall be scheduled by any
e�loyee during J�me, July or August prior to Marcfi 1. Seniority shall
determine the vacation scheduling prior to March 1.
Sectim 3.. At the discreti� of the firefighter, upon written request to
the DepartmPnt Head ro later than November 30, all remaining vacation over six.
shifts which have been earned but not taken in accordance with the existing
� policy, shall be paid by separate �eck on oi before Dece�er 20 of each year
at firefighter's dirrent rate of pay.
Sectiai 4. Fach full-time �er of the Aubnrn Fire Department shall be
entitled to aocrne annual vacatirn leave for each month of oontinuous service

aainencing frcen the date of their initial e�nployment in the Fire Department of
the City of Auburn. �
Fire Department personnel working shift work shall be entitled vacation in
acoordance with the follo!wing. schedule:

Section 5. Fire Department e�loyees ti,orking dap shift shall be granted
vacati� in accordance with the following schedule:
1 thru 5 years service Accrue 14 days
6 thru 10 yeazs service Aocrue 18 days
11 thru 15 yeazs service Aocrue 20 days
16 thru 20 years service Accrue 22 days
21 or more pears service l4ccrue 24 days
Section_ 6. FYnployees may have ro more than 23 months times their monthly
acc�anulation of vacation hours � the books �less they have carry ,over
approved by the Chief.
Article VIii - Sick Leave
Section 1. All full-tune e�loyees shall be entitled to utilize sick
leave when they aze incapacitated for the perforniance of their duties by
reaso� of sickriess or injury or when through f�nily illness their presence
is required. Sick leave shall accrue on the basis of one shift (29 hours)
per calendaz m�th to a maximian of 1,300 hours or eight tioiirs (8) per
calendar month to a maxuman of 960 hours for day shift persau►el. Ffien
' sick leave is taken by an �loyee, it shall be deductecl rn the basis of
aie hour of sick leave aocrual for each rne hour of sick leave used.

Section 2. Sickness shal.l be reported at the beginning of any period of
illness to the Department Head, and, within three days after returning to
wvrk, the ertq�loyee shall give a written statement including a doctor's cer-
tificate when requested, explaining t1�e nature of his/her illness and shall
su�nit a formal request for approval of leave so taken. Such request, when
approved by the Department Head, shall be filed in the department sick leave
file,
Section 3. Upon certification of disability retirement by the
Department of Retirement Systems, retirement, death or termination in good
standing (not termination for cause) the employee shall be reimbursed at current
rate of pay for unused acciued sick leave up to a maximinn of 1300 hours in
accordance with the following schedule based on eontinuous years of service:

Section 4. Effective January 1, 1983, all present LDC)FF II employees, as well
as LEOFF II employees hired after that date, shall receive 350 hours of disability
leave which will be exclusive of normal accrued sick leave and will be used for
duty related injuries or illness only and shall be used to supplement workmen's
compensation. If used, the disability leave pool will acc�nulate back up to 350
hour.s at a rate of 25 hours per month and cannot be sold back to the City as with
regular sick leave.

Article IX - Beceavement Leave
F3nployees shall be allowed up to three calendar days off for day personnel
or one 24-hour shift for shift personnel without loss of pay for death in
his/her immediate f�nily requiiing his/her presence, upon approval of the
llepartment Head. Iimnediate family shall include under this caption only
grandparents, father, m�ther, father-in-law, mother-in-law, spouse, brother,
sister or children of ertg�loyee.
Article X - Jury Pay
Section 1. An employee serving on a jury will be excused from work with
pay provided that the City salary paid to the employee for tlie period of jury
service shall be reduced by the amount of m�ney he receives for that service.
Section 2. I�ppearances before a oourt, legislative wrmnittee, or a quasi-
judicial body as a witness in response to a subpoena or other directive, shall
i� aporoved as authorized leaves with pay. However, the city salary shall be
reduced by the amount paid for such an appearance.
ARTICLE XI - HEF�LTH INSURANC'E
Section 1. Health care, dental care and life insurance program shall be
granted to eligible employees and their dependents, the oost to be paid by the
rity.
The plan includes:
1.) Association of Washington Cities' Medical Plan
2.) Washington Dental Service Dental Plan "A"
3.) Great West Prescriptions
4.) Western Vision Eye Care
5.) Association of Washington Cities' Life Insurance
6.) TEOFF II Disability Insurance of $12/per month.
Article XII - Uniform Allaaance
Section 1. Uniforms and protective devices shall be furnished by the
City.

Section 2. Any changes in imiforms shall be made through �utual consent
of the Chief of the Department and the Union Uniform aannittee with prior
approval of the Mayor.
Article XIII - GRIEUANCE, �iCILIATI(Pl P.PID ARBITRATIQd PRO(�DURE
Ebr purpose of this Agreement, the term grievar�e means any dispute bet-
weeen the Fiiq�loyer and the Uni� ooncerning alleged breach or violati� of
this Agreement. Any alleged grievance shall be taken up by the e�loyee with
his/her supervisor within ten shift days of the occurrence. 7t�e above parties
agree bo make every effort bo settle the grievara;e pro�tly at this stage. If
ro satisfactory settlement is reached, the follaaing procedure shall apply:
Step 1• 1l�e grievance shall be reduced to written fozm by the aggrieved
� employee stating the sectian of the Agreenent violated and explaining the
grievance in detail. 7t�e Uni� representative shall present the written
grievance to the Battalion Chief within five working days after the alleged
grievance is taken up by the �loyee with his/her supervisor. �he Battalion
Chief shall c�nence a meeting within five working deys after receipt of the
written grievanoe between the �loyee, Supervisor and the Union represen-
tative. Five days after such meeting, the Battali� Chief shall tran�nit a
: oop� of his/tier decision t� the a99rieved e�loyee and the Chief of the
Depart�tent.
Step 2• Should the grievance remain imresolved after the written deci-
sian is delivered in Step 1 tn the Chief of the Depart�nent, a meeti.ng shall be
held by Chief of the Departinent with the �loyee, Lfiiaa� representative and
� Battalioa� Chief withip ten working days frcan reoeipt of the written decision
relative to Step 1. Rt�e Chief of ttie Department sha]1 make a decision or� the
matter in writing within ten working days froen such meeting. Qopies of the
Chief's decision will be furnished the aggrieved and the IInirn representative.

Step 3• Any grievance remainin9 unresolved after the decision has been
rendered in Step 2 shall be tiansmitted t� the Mayor in writing whereupon the
Mayor shall oorduct an investigatory hearing within five working days of
receipt of the written grievance. The Mayor shall render a decision in
writing within three days of such hearing.
Step 4• If the grievance is rot settled in Step 3, the grievance may be
sutenitted bo an azbitraGor as. hereinafter provided. The parties shall select
within ten days a disinterested party to serve as azbitrator. In the event
the F}a�loyer and the Unim aze imable � agree u�on an arbitsator, ttie
azbitrator shall be selected by the process of eliminatioat fran a panel of
eleven arbitrators farnished by the American Arbitration Association. The
azbitrator shall render a decision as pro�tly as possible. The Arbitrator
shall have jurisdiction and authority only to interpret, apply or determine
ca�liance with the speciii.^. ter� of the Agreement and shall not have juris-
dictioa� to add to, detract frort� or alter in any Way the prov3sion of this
Agreement. Any decision within the jurisdictiaa� of the Arbitrator shall be
final and binding upon the parties. 14ie expenses and fees incwnbent to the
services of the a;bitrator shall be equally shared by the Fmployer and the
CTnion.
Any time limits stipi�lated in the grievance procedure may be extended for
stated periods of time by the appropriate parties tiy imitual agreement in
writing: Pending final decisiar� of any grievance by any of the above proce-
� dure, work shall c�tinue without interrupti� and �mder oonditions prevailing
prior to the time the dispute started.

'14�e Union recoqnizes the prerogative of the City to operate and �nage its
affairs in all respects in acoordance with its responsibilities, and the
powers or authority which the City possesses. These include, but are r�t
limited to, the follawirx�:
a) �e Union recognizes the exclusive right of the City to establish
reasonable �,ork rules.
b) Zt�e City has the right to schedule overtime work as required and oon-
sistent with the requirements of mmicipal e�lnyment and the public interest.
c) It is �mderstood 6y the parties that every incidental duty oonnected
. with operations en�nnerated in job descriptions is rot always specifically
described. Nevertheless, it is interx7ed that all such duties shall be per-
formed by e�loyees.
d) The City reserves the right tn discipline employees or discharge
„ employees for cause. Ztie City reserves the right to lay off personnel for
lack of work or fimds, or for the oocurrence of o�ditions beyond the oontrol
of the City or where such oontinuation of work would be wasteful or improduc-
tive. 4fie City shall have the right to deteimine required schedules of work
azr3 to establish the methods and prooesses by which such work is performed.
- e) 7he City agrees to maintain a standard of work scheduling oonsistent
with other cities in the azea whose firefighters avrk a similar tour of duty.

Article,.XV - Bulletin Board
A bulletin board stiall be provided by the City and located in a mitually
satisfactory plaoe for posting by the Union of unirn rotioes of ineetings,
wian electidns and results of �irn elections.

Article XVI - No Strike
The Uni� agrees that there shall be no str=ikes, slowc]oams, stoppages of
work, or any interference with the efficient management of the Fire Depari�nent
during the term of this Agreement.
Article XVII - Union Representative
Section 1. 7t�e business representative or other duly authorized IJnion
representative shall be permitted to visit the departm�t cluring operating
hours for pu_rposes oon�istent with the Agreement, provii3ing he/she does not
inteifere with working e�loyees.
Section 2. ZY,e Union �rees not to aortduct Union tiusiness � the City's
time and agrees that ro Unio�n meetings will be held during regular established
� operating hours on City p"renises. 1b enable full iepresentation at meetings
by �ers of the bargainirg imit, the established operating hours for. this
purpose shall be deemed to be between 7:00 a.m. and 5:00 p.m. Monthly

A11 rights, privileges and benefits pertaining to Firefighter personnel

• MEMORANDUM OF UNDERSTANDING
BY-AND BETWEEN
: THE CITY OF AUBURN
AND
- FIREFIGHTERS LOCAL #1352
Pursuant to negotiations held on the issue of EMT pay, the parties have
agreed to the following:
Effecti4e May 1, 1985, the EMT Pay, which is premium pay based on two per-
cent (2%) of a First Class Firefighter' s base monthly salary ($49.00) , will
be added to employees' base monthly salary with the following understanding:
. 1. All employees in the unit from the rank of FF4C up to and
including the rank of Lieutenant, are required to hold
valid EMT tards as a condition of employment, except as
noted below.
" 2. Any employee holding one of the positions specified below,
; or any other position so identified by the Fire Chief,
shall make every effort to maintain valid EMT cards, but
: exceptions may be made by the Fire Chief if their job as-
signments do not repuire the use of EMT level First Aid
- skills. They shall , howeder, maintain an American Red �
Cross Advanced First Aid Card, or its equivalent, per the
requirements of the applicable county and state regula-
tory agencies.

3. Employees who do not maintain valid EMT cards and who are not
specified above, sha11 be subject to disciplinary action unless,
in the opinion of the Fire Chief, extenuating circumstances
exist, in which case approval for sho�t-term exception must be
, obtained from the Fire Chief and the applicable county and state
regulatory agencies.
4. Ted Lindback and Ken Partridge, both FF1C, will be "grandfathered"
into the program and will receive the additional forty-nine dol-
lars ($49.00) per month although they do not hold EMT cards.
They shall , however, maintain an American Red Gross Advanced
• First Aid Card, or its equivalent, per the requirements of the
applicable county and state regulatory agencies.
