ARTICLE I - RECOGNITION Section 1. The City recognizes the Union as the sole and exclusive bargaining agent for the purpose of establishing wages, hours and other con- ditions of employment for all of its full-time department employees employed in work classifications set forth in Appendix "A". Section 2. The probationary period for a new employee shall be in accor- dance with Civil Service Rules and Regulations. ARTICLE II - UNION SECURITY AND DEDUCTION OF DUES Section 1. Each employee covered by this Agreement who is a member of the Union on or after the effective date of *,his Agreement, shall as a condition of continued employment, remain a member of the Union during the term of this Agreement. Each employee hired after the effective date of the Agreement shall within a period of thirty-one days cortmencing from the first date of . 1 employment as a condition of continued employment make application to and become a member of the Union; or, in the case of employees with a bona fide religious objection to �oining the Union� contribute an ambunt equal to the. periodic dues and initiation fees uniformly required as a condition of acquiring or retaining membership to a mutually agreed upon charitable organi- zation as provided for in RCW Chapter 41.56. Section 2. The City agrees to deduct each month Union dues equal to one percent (1%) of a First Class Firefighter's base wage and assessments from the employee's wages in the manner prescribed by law. The amount so deducted shall be mailed each payday to the Union. Article III - Union Activity The City agrees not to discriminete against any employee for lawful acti- vity in behalf of or membership in the Union. The Union also agrees not to discriminate against an employee of the City for his/her failure to join the Union. ARTICLE IV - HOURS OF WORK AND OVERTiME Section 1. For employees having twenty-four (24) hour duty shifts, shifts shall begin at 7:00 a.m. and expire the following day at 7:00 a.m., providing that shifts occurring on Sundays and holidays established by City Ordinance shall cortrnence at 8:00 a.m. This regular workweek shall not exceed an average of forty-eight point three (48.�) hou�s or 2511.60 annually exclusive of the additional one hour incurred relative to the special Sunday and holiday shifts. This shall be accomplished by the use of credit sh�.'ts (24 hours) to be scheduled evenly throughout the year. 2 , , Section 2. The normat workweek for day shift personnel shall not exceed forty (40) hours per workweek. As mutually agreed, the employee may work five (5) eight (8) hour days (Monday through Friday) or four (4) ten (10) hour days (Monday through Thursday) or (Tuesday through Friday). Section 3. All off-shift personnel will be paid a minimum of two hours pay at his/her overtime rate when called back to duty when off shift. All personnel called back to duty for an emergency situation shall be released as soon as the emergency is over and the equipment that was used is put back in service. Section 4. An employee shall be paid for overtime at the rate of time and one-half the straight time hourly rate for his/her individual classification. For overtime purposes only the straight time hourly rate shall be determined by multiplying monthly rates (stated in Appendiz "A") by twelve and dividing that amount by 2080. Section 5. Whenever possible, additional manpower requirement of the Fire Department shall be met by first affording the opportunity to work to full- paid members of the Fire Department. ARTICLE V - WAGES Section 1. Employees covered by this Agreement shall be compensated in accordance with the wage schedule attached to this Agreeme.nt and marked Appendix "A". This wage schedule shall be considered a part of this Agreement. Section 2. Proficiency pay in the amount of two percent (2%) of a Firefighter First Class base salary regardless of rank as set forth in 3 Appendix "A" shall be applied to the base salary for each bargaining unSt member holding a valid Emergency Medical Technician (EMT) Certificate from the State of Washington. ' Section 3. Employees in the bargaining unit that have completed courses applicable to a fire science degree shall be paid an educational incentive based on the following percentages of a First Class Firefighter's base salary regardless of rank as listed in Appendix "A" for credits completed: PERCENTAGE OF FIREFIGHTER CREDITS 1ST CLASS SALARY 30 college credits 2% of base salary 60 college credits 4% of base salary AA Degree (90 credits in 6% of base salary fire science) Section 4. Longevity pay shall be paid regardless of rank to job classi- fications of Firefighter, Lieutenant and Captain upon completion of years of service in accordance with the following schedule: MONTHS OF SERVICE AMOUNT a) Upon completion of 54 months $ 50.00 per month b) Upon completion of 66 months $100.00 per month c) Upon completion of 78 months 5150.00 per month Section 5. Any employee temporarily assigned by the Chief of the Department to work in a higher :.lassification shall be paid at the established rate of pay for such classification while performing such duties with payment 4 to be mad? comnencing with the first shift. Section 6. An employee required to appear in court during off-duty hours as a witness on behalf of the employer relative to a duty-related incident shall be compensated for a minimum of two (2) hours to a mazimum of four (4) hours at time and one-half for actual attendance at the court hearing per calendar day. Section 7. The base hourly rate of pay, except of calculating overtime pay actually worked, shall be equal to the (monthly base times twelve) divided by (regular workweek times fifty-two) . Article VI - Holidays Section 1. For purposes of this Agreement holidays sha11 start at the beginning of his/her normal shift of the day itself and continue for the next twenty-four hours. Section 2. All shift personnel sha11 be allowed five shifts leave annually regardless of shift assignment in lieu of holidays. Holidays may be scheduled any time with the approval of the Shift Officer as long as there remains the required minimum number of personnel on duty. Holidays may be taken with the approval of the Shift Officer in half-day shift increments (12 hours) commencing at 7:00 a.m. or 7:00 p.m. Holidays shall not be con- secutively granted to any employee in the Fire Department unless the Fire Chief finds that there are special circumstances justifying the same and that the extended absence of such errNloyee shall not impair the efficiency of the Department. Section 3. At the discretion of the firefighter, upon v:ritten request to 5 the Department Head no later than November 30, the City agrees to pay at firefi_ghter's current rate of pay a maximum of two unused shifts of holiday leaVe. Payment shall be made by separate check on or before December 20 of each year. Section 4. Employees called back to work on schedule shifts off that fall on the following holidays established by City Ordinance shall be paid two times their hourly rate of pay in accordance with the overtime formula in addition to normal compensation. a) December 25 (Chrisfmas Day) b) Fourth Thursday in November (Thanksgiving Day) c) July 4 (Independence Day) Section 5. Holidays taken in any amount shall be subject to being bumped by regular pe"riods of vacation with 30 or more days notice, Section 6. Day personnel sha11 be entitled to holiday leave in accordance with Auburn City Code. Article VII - Vacation Section 1. Each member of the Fire Department shall be granted a vacation in each calendar year without loss of pay. Such vacations shall be computed in accordance with Section 4 and 5 of this Article and under the direction and supervision of the Chief of the Fire Department. Section 2. Vacation shall be chosen by individual firefighter per Department Rules and Regulations as stated below: Vacation may be taken in one shift increments by tw�nty-four hour 6 shift employees but will be subject to being bumped by a vacation period of two (2) or more shifts with•thirty (30) days notice during the months of January, February, March, April , May, September, October, November and December. During the months of June, July and August, vacation must be taken in amount of three (3) or more consecutive shifts to hold vacation privi- leges. If only one shift of vacation is. taken during this period, it shall have the same rights as a holiday and be subject to being bumped by regular vacation periods of three (3) or more shifts. No more than two (2) periods of three (3) or more shifts shall be scheduled by any employee during June, July or August prior to March 1. Seniority shall determine the vacation scheduling prior to March 1. Section 3. At the discretion of the firefighter, upon written request to the Department Head no later than November 30, all remaining vacation over six shifts which have been earned but not taken in accordance with the existing policy, shall be paid by separate check on or before December 20 of each year at firefighter's current rate of pay. Section 4. Each full-time member of the Auburn Fire Department shall be entitled to accrue annual vacation leave for each month of continuous service commencing from the date of their initial employment in the Fire Department of the City of Auburn. Fire Department personnel working shift work s.hall be entitled vacation in accordance with the following schedule: 7 , 1 through 5 years service accrue 7 shifts 6 through 10 years service accrue 9 shifts 11 through 15 years service accrue 10 shifts 16 through 20 years service accrue 11 shifts �, 21 or more years service accrue 12 shifts �, Section 5. Fire Department employees working day. shift shall be granted I vacation in accordance with the following schedule: Completion of: D�s 1 - 5 years service 14 days 6 - 10 years service 18 days 11 - 15 years service 20 days 16 - 20 years service 22 days 21 or more years service 24 days Section 6. Employees may have no more than 23 months times their monthly accumulation of vacation hours on the books unless they have carry over approved by the Chief per this Article. Article VIII - Sick Leave Section 1. A77 full-time employees shall be entitled to sick leave when they are incapacitated for the performance of their duties by reason of sickness or injury or when through family illness their presence is required. Sick leave sha11 accrue on the basis of one shift (24 hours) per calendar month to a maximum of 1,300 hours or eight hours (8) per ca�^_ndar month to a 8 maximum of 960 hours for day shift personnel . When sick leave is taken by an employee, it shall be deducted on the basis of one hour of sick leave accrual for each one hour of sick leave used. Conversion of accrued sick leave shall be accomplished for shift employee scheduled to days and day employees sche- duled to shift by using the ratio of 1300 to 960 by dividing day to shift accrued hours by 135.4% and shift to day accrued hours by 73.9�. I Section 2. Sickness shall be reported at the beginning of any period of illness to the Department Head, and, within three days after returning to work, the employee shall give a written statement including a doctor's cer- tificate-when requested, ezplaining the nature of his/her illness and shall submit a formal request for approval of leave so taken. Such request, when approved by the Department Head. shall be filed in the department sick leave file. Section 3. Upon certification of disability retirement by the LEfF Board, retirement, death or termination in good standing (not termination for cause) the employee shall be reimbursed at current rate of pay for unused accrued sick leave up to a maximum of 1300 hours in accordance with the following schedule based on continuous years of serVice: Upon Completion of Years of Service: Percent of-Accrued Unusued Sick Leave 0 through 4 years -0- unless in the event of death occurring in the line of duty, 25% of such employee accrued unused sick leave would be paid to the employee's beneficiary. 5 through 14 years 25% 15 through 24 years 50% 9 25 years and over 100% Section 4. Effective January 1, 1983, all p"resent LEOFF II employees, as well as LEOFF II employees hired after that date, shall receive 350 hours of disability leave which will be exclusive of normal accrued sick leave and will be used for duty related injuries or illness only and shall be used to supple- ment workmen's compensation. if used, the disability leave pool will accumu- late back up to 350 hours at a rate of 24 ho.urs per month and cannot be sold back to the City as with regular sick leave. Article IX - Bereavement Leave Employees shall be allowed up to three calendar days off for day personnel or one 24-hour shift for shift personnet without loss of pay for death in his/her imnediate family requiring his/her presence, upon approval of the Department Head. Irtmed.iate family shall include under this caption only grandparents, father, mother, father-in-law, mother-in-law, spouse, brother, sister or children of employee. Article X - Jury Pay Section l. An employee serving on a jury will be ezcused from work with pay provided that the City salary paid to the employee for the period of jury service shall be reduced by the amount of money he receives for that service. Section 2. Appearances before a court, legislatiVe committee, or a quasi- judicial body as a witness in response to a subpoena or other directive, shall be approved as authorized leaves with pay. However, the city salary shall be reduced by the amount paid for such an appearance. ARTICLE XI - HEALTH INSURANCE 10 , . Section 1. Health .care, dental care and life insurance program shall be granted to eligible employees and their dependents, the cost to be paid by the City. The plan includes: a) Association of Washington Gities' Medical Plan b) Washington Dental Service Dental Plan "A" c) Great West Prescriptions d) Western Vision Eye Care e) First Farwest Life Insurance Section 2. The City agrees to deduct from emPloyee's wages the monthly premium for the disabil"ity policy provided by Western -Life Insurance Company for eligible emptoyees (LEOfF II). Article XII - Uniform Allowance Section 1. Uniforms and protective devices shall be furnished by the City. Section 2. Any changes in uniforms shall be made through mutual consent of the Chief of the Department and the Union Uniform Cortunittee with prior approval of the Mayor. Article XIII - GRIEVANCE, CONCILIATION AND ARBITRATION PROCEDURE For purpose of this Agreement, the term grievance means any dispute bet- weeen the Employer and the Union concernir.g alleged breach or violation of this Agreement. Any alleged grievance shall be taken up by the employee with 11 � � his/her supervisor within ten shift days of the occurrence. The above parties agree to make every effort to settle the grievance promptly at this stage. tf no satisfactory settlement is reached, the following procedure shall apply: Step 1• The grievance shall be reduced to written form by the aggrieved. employee stating the section of the Agreement violated and explaining the grievance in detail . The Union representative shall present the written grievance to the Battalion Chief within five working days after the alleged grievance is taken up by the employee with his/her supervisor. The Battalion Chief shall cortpnence a meeting within five working days after receipt of the written grievance between the employee, Supervisor and the Union represen- tative. Five days after such meeting, the Battalion Chief shall transmit a copy of his/her decision to the aggrieved employee and. the Chief of the Department. Step 2• Should the grievance remain unresolved after the written deci- sion is delivered in Step 1 to the Chief of the Department, a meeting shall be held by Chief of the Department with the employee, Union representative and Battalioh Chief within ten working days from receipt of the written decision relative to Step 1. The Chief of the Department shall make a decision on the matter in writing within ten working days from such 'meeting. Copies of the Chief's decision will be furnished the aggrieved and the Union representative. Step 3• Any grievance remaining unresolved after the decision has been rendered in Step 2 shall be transmitted to the Mayor in writing whereupon the Mayor shall conduct an investigatory hearing within five working days of receipt of the written grieVance. The May,or shall render a decision in writing within three days of such hearing, l2 , . Step. 4. If the grievance is not settled in Step 3, the grievance may be submitted to an arbitrator as hereinafter provided. The parties shall select within ten days a disinterested party to serve as arbitrator. In the event the Employer and the Union are unable to agree upon an arbitrator, the arbitrator shall be selected by the process of elimination from a panel of eleven arbitrators furnished by the American Arbitration Association. The arbitrator shall render a decision as promptly as possible. The Arbitrator shall have jurisdiction and authority only to interpret, appiy or determine compliance with the specific terms of the Agreement and shall not have juris- diction to add to, detract from or alter in any way the provision of this Agreement. Any decision within the jurisdiction of the Arbitrator shall be final and binding upon the parties. The expenses and fees incumbent to the services of the arbitnator shall be equally shared by the Employer and the. Union. Any time limits stipulated in the grievance procedure may be extended for stated periods of time by the appropriate parties by mutual agreement in writing. Pending final decision of any grievance by any of the above proce- dure, work shall continue without interruption and under conditions p.reVailing prior to the time the di.spute started. Article XIV - MANAGEMENT'S RIGHTS The Un9on recognizes the prerogatSve of the City. to operate and manage its affairs in all respects in accordance wit,h its responsibilities, and the powers or authority which the City possesses. These include, but are not limited to, the following: 13 a) The Union recognizes the exclusive right of the City to establish reasonable work rules. b) The City has the right to schedule overtime work as required and con- sistent with the requirements of municipal employment and the public interest. c) It, is understood by the parties that every incidental duty connected with operations enumerated in job descriptions is not always specifically described. Nevertheless, it is intended that all such duties shall be per- formed by employees.. d) The City reserves the right to discipline employees or discharge employees for cause. The City reserves the right to lay off personnel for lack of work or funds, or for the occurrence of conditions beyond the control of the City or where such continuation of work would be wasteful or unproduc- tive. The City sha11 have the right to determine required schedules of work and to establish the methods and processes by which such work is performed. e) The City agrees to maintain a standard of work scheduling consistent with other cities in the area whose firefighters work a similar tour of duty. Article XV - Bulletin Board A bulletin board shall be provided by the City and located in a mutually satisfactory place for posting by the Union of union notices of ineetings, union elections and results of union elections. Article XVI - No Strike The Union agrees that there shall be no strikes, slowdowns, stoppages of work, or any interference with the efficient management of the Fire Department 14 during the term of this Agreement. Article XVII - Union Representative Section 1. The business representative or other duly authorized Union representatiVe shall be permitted to visit the department during operating hours for purposes consistent with the Agreement, providing he/she does not interfere with working employees. Section 2. The Union agrees not to conduct Union business on the City's time and agrees that no Union meetings will be held during regular established operating hours on City premises. To enable full representation at meetings by members of the bargaining unit, the established operating hours for this purpose shall be deemed to be between 7:00 a.m. and 5:00 p.m. Monthly meetings may be held on a regular basis at the Fire Station. Additional meetings wi11 require prior approval . Section 3. The parties having a .labor Agreement hereby agree that such members of the Union, (three) as may be designated by the Union with prior notification for the purposes of direct participation as members of the Union negotiating team in labor negotiations with the Gity of Auburn, shall be granted leave from duty without loss of pay for such negotiations. ARTICLE XVIII - NONDISCRIMINATION The Union and the City agree not to discriminate because of race, color, creed, sex, national origin, age, in ac�or�ance with State and Federal laws regarding discrimination. 15 . • ARTICLE XIX - RETENTION OF BENEFITS All rights, privileges and benefits pertaining to Firefighter personnel held by employees at the present time in accordance with City Ordinances and those specifically mentioned in this Agreement shall remain in full force, unless changed by mutual agreement, during the term of the Agreement. Article XX - Savings Clause Should any Article, Section or portion thereof of this Agreement be held unlawful. and unenforceable by any Court of competent jurisdiction, such deci- sion of the Court shall apply only to the specific Article, Section .or portion thereof, directly specified in the decision. ARTICLE XXI - FOOD ALLOWANCE The City shall pay a11 bargaining unit personnel working 24-hour shifts an allowance of one dollar ($1.00) per shift actually worked in lieu of sub- sistence. This ambunt shall be computed annually and paid by separate check on or before December 20 of each year. 16 Article XXII - Duration Section 1. This Agreement is effective January 1, 1983, and shall remain in full force and effect through December 31, 1983. DATED AND SIGNED THIS �_ DAY OF L'��/d�� , 1982.
