ARTICLE I - RECOGWITION SECTION 1: The City recognizes the Union as the sole and exclusive argaining agent for the purpose of establishing wages, hours and other conditions of employment for all of its full-time department members employed in the following work classifications: Fire Fighter, Fire Fighter Specialist, Lieutenant, Assistant Fire Marshal, Battalion Chief and Fire Marshal. SECTION 2: The probationar,y period for a new employee shall be in accor- ance wit Civil Service Rules and Regulations. ARTICIE II - UWION SECURITY AND DEDUCTION OF DUES SECTION-1: Each member covered by this agreement who is a member of the Unio on or after the effective date of this agreement, shall as a con- dition of continued employment, remain a member of the Union during the term of this agreement. Each member hired after the effective date of the agreement shall , within a period of thirty-one days commencing from the first date of employment, as a. condition of employment, make applicatio,n to and become a member of the Union; or, in the case of employees with a bona fide religious objection to joining the Union contribute an amount equal to the periodic dues and initiation fees uniformly required as a condition of acquiring or retaining membership to a mutually agreed upon cliaritable organization as provided for in R.C.W. Chapter 41.56. SECTION-2: The City agrees to deduct each month Union dues equal to one and one-quarter percent (1#%) of a Firefighter First Class' s base wage and assessments from the member' s wages in the manner prescribed by law. The amount so deducteG shall be sent each payday to the Union. - 1 - % • . *• 1988 CONTRACT FIRE FIGIiTERS LOCAL �11352 ARTICLE III ARTICLE III - UNION ACTIVITY The Gity agrees not to discriminate against any member for lawful activity in behalf of or membership in the Union. The Union also agrees not to discriminate against an employee of the City for their failure to join the Union. ARTICIE IV - HOURS OF WORK AND OVERTIME SECTION 1. WORKWEEK, SH,IFTS: For members having twenty-four (24) hour duty shifts, shifts shall begin at 7:00 a.m. and expire the following day at 1:00 a.m. , . providing that shifts occurring on Sundays and holidays established by City Ordinance shall commence at 8:00 a,m. This normal workweek shall not exceed an average of forty-seven point four (41.4) hours or 2466 (four year average) annually exclusive of the additional one hour incurred relative to the special Sunday and holiday shifts. This shall be accomplished by the use of credit shifts (24 hours off-duty) to be sche- duled evenly throughout the year by the Fire Chief or his/her designee and by one administrative debit shift to be scheduled per the 1987 debiE shift rules. SECTION 2. WORKWEEK, OAYS: The normal workweek for day shift members shaT�ot exceed forty (40) hours per workweek. As mutually agreed, the member may work five (5) eight (8) hour day_s (Monday through Friday) or four (4j ten (10) hour days (Monday through Thursday) or (Tuesday through Friday). SECTION 3. OFFSHIFT WORK, MINIMl�1 CALLBACK:. Effective July 1, 1988, all off-shift members will be paid at their overtime rate when called back to duty when off shift. Members held over on their normal shift because of an emergency call occurring at shift change shall be paid for one hour or for the actual time wbrked, rounded off to the next higher hour. Members called back to duty for less than one and one-half (1}) hours shall be guaranteed a minimum of two hours at their overtime rate and members called back to duty for more than one and one-half (1}) hours shall be guaranteed a minimum of four hours at their overtime rate. All members called back to dut,y for an emergency situation shall be released as soon as the emergenc,y is over and the equipment that was used is put back in service. SECTION 4. OVERTIME RATE: Effective July 1, 1988, members shall be paid for overtime at the rate of time and one-half based upon the current rate of pay for his/her individual classification. The overtime rate of pay shall be determined by multiplying the individual ' s ourrent rate of pay (stated, in Appendix "A") by twelve (12) and dividing that amount by the individual 's annual scheduled hours of work (2080 or 2466) and multiplying the result by 1.5. - 2 - I/ , �'• ' 1988 CONTRACT FIRE FIGHTERS LOCAL N1352 ARTICLE IV (CONT'D) SECTION 5. ADDITIONAL MANPOWER: With the exception of the use of mutual or automatic aid and whenever possible, any additional manpower require- ments of the Fire Department shall be met by first affording the oppor- tunity to work to full-time paid members of the Fire Department. SECTION 6. CREDIT SHIFTS: Credit shifts (twenty-four (24) hours off duty) may be traded. between members, or moved with the approval of the Fire Chief or his/her designee as long as there remains the minimum number of members on duty. SECTION 7. PAYMENT FOR NON-EMERGENCY OR NON-MANNING OVERTIME: Overtime pay or cbmpensatory time shall be earned at the rate of one and one-half (1}) hours for eacti overtime hour worked. This shall be the member's choice �rov_ided that choice is made clear to the supervisor prior to the overtime eib 'ng incurred. No member may accumulate more than ninety six (96) hours of compensatory time. Effective July 1, 1988 up to a maximum of 48 hours of compensatory time accumulated by a member as of the first of June each year, may be paid at the member� s current rate of pay by separate check on or before June lOth of each year. No member may carry more than forty- eight (48) hours of compensatory time past the first of June. Compensatory time off may be used in any amount; however, it must be used in whole work/duty shift increments in order to maintain priority status. Regular periods of vacation shall have priority over compensatory time off when scheduling with thirty (30) or more days' notice. SECTION 8. LUNCH PERIOD: The lunch period for members regardless of shift schedu�shall be of one hour duration. ARTICLE V - WAGES SECTION 1. COMPENSATION: Members covered by this Agreement shall , com- mencin9 January 1, 1988, be compensated in accordance with the wage sche- dule attached to this Agreement and marked Appendix "A". Base wages for 1989 shall be open for negotiation. SECTION 2. SPECIAIIST PAY: Effective January 1, 1988 the classifica- tion of FF Specialist is identified for those firefighters who are assigned by the Chief or his/her designee to special teams or assign- ments per the M.O.U. dated June 9, 1988 attached. Base pay for this classification is 2% higher than the FF1C base pay. SECTION 3. EDUCATIONAL INCENTIVE: Effective January 1, 1988 members in the bargaining unit that have completed courses applicable to a fire science degree shall be paid an educational incenti4e based on the following percentages of a fire Fighter First Class base salary regardless of rank as set forth in Appendix "A'' for credits completed: - 3 - � , �• 1988 CONTRACT FIRE FIGHTERS LOCAL #1352 ARTICIE V (CONT'D) PERCENTAGE OF FIREFIGHTER CREDITS 15T CLASS SALARY 1. ) 30 college cred_its 2% of base salary 2. ) 60 colle9e credits 4X of base salary 3. ) AA Degree (90 credits in 6% of base salary fire science) SECTION 4. LONGEVITY: Longevity pay shall be paid regardless of rank to members upon completion of years of service in accordance with the following schedule: MONTHS OF SERVICE AMOUNT . 1. ) Upon completion of 54 months S 50.00 per month 2. ) Upon completion of 66 months 5100.00 per month 3. ) Upon completion of 78 months 5150.00 per month SECT.ION 5. TEMPORARY ASSIGNMENT: EffectiVe July 1, 1988, any member tem- porari� assigned by the Chief of the Depertment to work in a higher classi,fi.cation shall be paid at the established rate of pay for such classification while performing such duties with payment to be made com- mencing with the first shift. SECT.ION 6. COURT TESTIMONY: A member required to appear in court during off-duty hours as a witness on behalf of the employer relative to a duty- related incident shall be eompensated for a minimum of two (2) hours at time and one-half for actual attendance at the court heari.ng per calendar day. SECTION 7. BASE HOURLY RATE CALCULATION: The base hourly rate of pay, excep or calculating overtime pay actually worked, shall be equal to the (monthly base X twelve) divided by (regul.ar workweek X fifty-two). SECTION._ 8. CURRENT PAY RATE CALCULATION : The members' current rate of pay shall be equal to the (monthly base "rate of pay pl "us incentives, including longevity X 12) divided by (the workweek X fifty-two). SECTION 9r PAY DATES: Pay days shall be on or before the fifth and twen- tieth of each month, unless the subject days fall on a Sunday or a Monday holiday, in which case pay checks will be issued on the first working day after the Sunday or Monday holiday. SECTION 10. PAY DIFFERENTIAL: Effective January 1, 1988, the following pay differential is hereby established: A) Between Fire Fighter First Class and Fire Fighter Specialist; 102% of FF1C base wage; B) Between Fire Fighter Specialist and Lieutenant, 110� of Fire Fighter Spec,ialist base wage; C) Between Fire Fighter Specialist and Battalion Chief, 120% of Fire Fighter Specialist base wage. - 4 - • , '' • 1988 CONTRACT FIRE FIGHTERS LOCAL �1352 ARTICLE V (CONT'D) SECTION 11. TUITION REIMBURSEMENT: The City agrees to reimburse members for�ional expenses including tuition and books for courses applicable to a Fire Science degree or for other courses with, pri.or approval of the Fire Chief or his/her designee. City paid books will become the prop.erty of the Fire Department and be placed 'in the department library. The amount of tuition reimbursement shall be limited to the current rate schedule at the Uniyersity of Washington for the same number of credits earned. In order to be eligible for reimbursement, the member must receive a grade of "C" or better, or "Pass" in a pass/fail system. SEGTION 12. STANDBY TIME-DUTY CHIEF: Effective July 1, 1988, the City and the Union agree that the. use of stand-by time shall be consi,st.ent with sound fire fighting practices and with the maintenance of public safety. Battalion Chiefs formally placed on stand-by status shall remain within fifteen (15) minutes of the fi.re department response area and shall receive six (6) hours of compensatory time for each twenty-four (24) hour period, or pro-rated for portions thereof. If a Battalion Chi.ef is actually called back to duty while on stand-by status, then normal overtime provisions shall apply and shall be in addition to stand-by compensation. ARTICLE VI - HOLIDAYS SEGTION 1. For the purposes of this Agreement holidays shall start at the eginning of a members' normal shift of the day itself and continue for the next twenty-four hours. SECTION 2. All shift members shall be allowed five shifts leave annually rega—„�e s of shift assignment in lieu of holidays. Holidays m8y be sched- uled any time with the approval of the Shift Officer as long as there remains the required minimum number of inembers on duty. Holidays may be taken with the approval of the Shift Officer in half-day sh,ift increments (12 hours) commencing at 7:00 a.m. or 7:00 p.m. Holidays shall not be con- secutiv_ely granted to any member of the Fire Department unless the Fire Chief finds that there are special circumstances justifying the same and that the extended absence of such member shall not impair the efficiency of the Department. SECTION 3. At the discretion of the employee, upon written request to the Fire Chief no later than November 30, the City agrees to pay at the member' s current rate of pay a maximum of two unused shifts of holiday leave. Payment shall be made by separate check on or before December lOth of each ,year. SECTION 4. Effective July 1, 1988, members called back to work on sche- dul�shifts off that fall on the following holidays established by City Ordinance shall be paid two times their hourly rate of pay in accordance with the overtime formula in addition to normal compensation. 1. ) December 25 (Christmas Day) 2. ) Fourth Thursday in November (Thanksgiving Day) 3. ) July 4 (Independence Day) - 5 - � , ° • 1988 CONTRACT FIRE FIGHTERS LOCAL �1352 ARTICLE VI (CONT'D) SECTION 5. Holidays taken in any amount shall be subject to being bumped y regular periods of vacation with 30 or more days notice. SECTION 6. Effective July 1, 1988, members scheduled to work on shifts that fall on the following holidays shall receive time and one-half for hours worked between 0800 and 2000 hours: A. New Year� s Day B. The Fourth of July C. Thanksgiving Day D. Christmds Day ARTICLE VII - VACATION SECTION 1. Each member of the bargaining unit shall be granted a vaca- tio—�ach calendar year without loss of pay. Such Vacations shall be computed in accordance with Section 4 and 5 of this Article and under the direction and supervision of the Chief of the Fire Department or his/her designee. SECTION 2. Vacation shall be chosen by individual member per Department Rules and Regulations as stated below: Vacation may be taken in one shift increments by twenty-four hour shift members but will be subject to being bumped by a vacation period of two (2) or more shifts with thirty (30) days notice during the months of January, Februa�y, March, April , May, September, October, November and December. During the months of June, July, and August, vacation must be taken in the arnount of three (3) or mbre consecuti4e shifts to hold vacation privileges. If less than three (3) shifts of vacation are taken during this period, they shall have the same riqhts as a holiday and be sub- ject to being bumped by regular vacation periods of three (3) or more shifts. No mbre than two (2) periods of three (3) or mbre shifts with 30 or more days' notice shall be scheduled by any member during June, July or August prior to March 1. Seniority shall determine the vaca- t`ion scheduling prior to March 1. - 6 - • , • 1988 CONTRACT FIRE FIGHTERS LOCAL /1352 ARTICLE YII (CONT'D) SECTION_3. At the member� s discretion, upon w�itten request to the fire Chi� later than November 30, all remaining vacation over six shifts which have been earned that year but not taken in accordance with the existing policy, shall be paid by separate check on or before December 10 of each year at the member's current rate of pay. SECTION 4. Each full-time member of the Auburn Fire Department shall be entitled to accrue annual vacation leave for each month of continuous ser- vice commencing from the date of their initial emploqment in the Auburn Fire Department. Fire Department members working shift work shall be entitled vacation in accordance with the following schedule: 1 through 5 years service Accrue 1 shifts/year or 14 hours/month 6 through 10 years service Accrue 9 shifts/year or 18 hours/month 11 through 15 years service Accrue 10 shifts/year or 20 hours/month 16 through 20 years service Accrue 11 shifts/year or 22 hours/month 21 0� more years ser4ice Accrue 12 shifts/year or 24 hours/month SECTION 5. fire Department members working day shift shall be granted vacafion in accordance with the following schedule: 1 thru 5 years serVice Accrue 14 days/year or 9.3 hours/month 6 thru 10 years service Accrue 18 days/year or 12.0 hours/month 11 thru 15 years service Accrue 20 days/year or 13.3 hours/month 16 thru 20 years service Accrue 22 days/year or 14.7 hours/month 21 or more years service Accrue 24 days/year or 16.0 hours/month SECTION 6. The maximum accumulation of Vacation hours shall be determined y�ltiplying the members monthly accrual rate times 23 unless the member has approval of the Chief or his/her designee to exceed this maximum. ARTICLE VIII - SICK LEAVE I SECTION 1. All full-time members shall be entitled to utilize sick leave I when they are incapacitated for the performance of their duties by reason of sickness or injury or when through family illness their presence is required. The presence of a full-time member shall be deemed as required � for medically documentable illness or injury inyolving the employee' s imme- diate family who are residing with the employee or for other family members with prior approval of the Fire Chief or his/her designee. Sick leave (for shift members) shall accrue on the basis of one shift (24 hours) per calen- dar month to a maximum of 1,300 hours at which time Ehe accrual and usage rate shall change to ten (10) hours per month until the sick leave accrued drops below 1300 hours at which time the accrual and usage rate will return to twenty-four (24) hours per month until accruals again exceed 1300 hours. - � - • , • 1988 CONTRACT FIRE FIGHTERS LOCAL #1352 ARTICLE VIII (CONT'D) Sick leave accruals for day shift members shall accrue on the basis of eight hou"rs (S) per calendar mbnth to a maicimum of 960 hours. When sick leave is taken by a day shift member, it shall be deducted on the basis of one hour of sick leave accrual for each one hour of sick leave used. Conversion of accrued sick leave shall be accomplished for shift members scheduled to days and day members scheduled to shift by using the ratio of 1300 to 960 by multiplying day to shift accrued hours by 135.4% arid shift to day accrued hours by 73.9%. SECTION 2. Sickness shall be reported at the beginning of any period of illness to the Fire Chief or his%her designee, and within three (3) days after returning to work, the member shall give a written statement including a doctor' s certificate when requested, explaining the nature of his/her illness and submit a formal request for approval of leave so taken. Such request, when approved by the Fire Chief or his/her designee, shall be filed in the Department sick leave file. Family sick leave shall be reported at the beginning of any period of illness to the duty Battalion Chief. The member will explain the nature of the family illness or emergency. The duty Battalion Chief may reguest a doctor' s certificate for periods of family sick leave use lasting 25 hours or less. A doctor' s certificate will be required when a member uses more than 25 hours of family sick leave, for the same illness or injury, unless prior arrangements are made with the Chief or his/her designee. SECTION 3. Upon certification of disability retirement by the Department of Retirement Systems, retirement, death or' termination in good standing (not termination for cause) the member shall be reimbursed at his/her current rate of pay for unused accrued sick leave up to a maximum of 1300 hours in accordance with the following schedule based on. continuous years of service: Upon Campletion of P.ercent of Accrued Unused Years of Service �c Leave 0 though 4 years 0� -- unless in the event of death occurring in the line of duty, 25% of such member accrued unused sick leave would be paid to the mem- ber' s beneficiary. 5 through 14 years 25% 15 through 24 years 50% 25 years and over 100% SECTION 4. When a LEOFF II member sustains an on-the-job injury or ill- ness as covered by Washington State Workers' Compensation, he/she shall receive his/her current rate of pay for a period not to exceed six months, provided he/she signs all Workers' Compensation checks over to the City. The member will continue to receive all employer fully funded benefits afforded active members. - 8 - • , • 1988 CONTRACT FIRE FIGHTERS LOCAL A1352 ARTICLE VIII (CONT'D) SECTION 5. When a shift member has accumulated 1300 hours of sick leave, or when a day member has accumulated 960 hours of sick leave, his/her sick leave shall continue to accumulate at the appropriate rate per month, as defined in Section 1 above, until the end of the year, at which time all sick leave accumulated in excess of the maximum shall be paid at twenty- five percent (25%) of the member's current rate of pay by separate check on or before January lOth each year. ARTICLE IX - BEREIIVEMENT LEAVE Members shall be allowed up to three calendar days off for day members or one 24-hour s,hift off for shift members without loss of pay for death in his/her irtunediate family requiriqg his/her presence, upon approval of the Fire Chief. Irtmediate family shall include under this caption only grandparents, father, mother, father-in-law, mbther-in-law, spouse, brother, sister or children of the member. ARTICLE R - JURY PAY SECTION 1. A member servin9 on a jury will be excused from work with pay prov��that the City salary paid to the member for the period of jury service shall be reduced by the amount of money he/she receives for that service. SECTION 2. Appearances before a court, legislative cortonittee, or quasi- I judicial body as a witness in response to a subpoena or other directive, shall be approved as authorized leaves w.ith pay: However, the city salary shall be reduced by the amount paid for such an appearance. ARTICLE XI - HEALTH INSURANCE SECTION 1. Effective January 1, 1988 a dental care, prescription, vision., LEOFF II disability insurance, and life insurance program shall be granted to eligible member"s and their dependents, the cost to be paid by the Citq. The plan includes: 1. ) Washington Dental Service Dental Plan "A" 2. ) Great West Prescriptions 3. ) Western Vision Eye Care 4. ) Association of Washington Cities' Life Insurance 5. ) LEOFF II Disability Insurance of $18.00 per month - 9 - • • 1988 CONTRACT FIRE FIGHTERS LOCAL #1352 ARTICLE XI (CONT' D) SECTION 2. Any changes in uniforms shall be made through mutual consent of the Chie� of the Department and tHe Union Uniform Committee. ARTICLE XIII/- GRIEVANCE, CONCILIATION AND._ARBITRATION..PROCEDURE For purposes of this Agreement, the term grievance means any dispute bet- ween the Emplo,yer and the. Union concerning al,leged breach or Violation of this Agreement. Any alleged grievance sFiall be taken up by the memtier with his/her supervisor within ten_ shift days of the occurrence. The above parties agree to make every effort to sett_le the grievance promptly at this stage. If no satisfactory settlement is reached, the following proeedure shall apply: Step 1• The grievance shail be reduced to written form by the aggrieved member stating the section of the Agreement yiolated and explaining the grievance in detail . The Union representative I shall present the written grieva.nce to the As.sistant Fire Chief within five (5) days after the alleged grievance is taken up with his/her supervisor. The Assistant Chief shall commence a meeting within five (5) working days after receipt of the written gr"ievance between the member, supervisor and the Union representative. Five (5) days after such meeting, the Assistant Chief shall transmit a copy of his%her decision to the aggrieved member and the Chief of the department. ec�Ste 2. Should the grievance remain unresolved after the written n is delivered in Step 1 to the Ghief of the Department, a meeting shall be held by Chief of the Department with the member, Union representative and the Assistant Chief within ten (10) work,ing days from receipt of the written decision relative to Step 1. The Mayor shall render a decision in writing within three (3) working days of such hearing. Step 4• If the grievance is not settled in Step 3, the grievance may be submi.tted to an arbitrator as hereinafter proyided. The parties shall select within ten (10) days, a disinterested party to serve as arbitrator. In the event the Employer and the Union are unable to agree upon an arbitrator, the arbitrator shall be selected by the process of elimination f.rom a panel of eleven arbitrators furnished by the American Arbitration Association. The a"rbitrator shall render a decision as promptly as possi6le. The Arbitrator shall haVe jurisdiction and autho►'it;y only to interpret, apply or determine compliance with the specific terms of the Agreement and shall not have jurisdiction to add to, detract from or alter in any way the provision of this Agreement. Any decision within the jurisdiction of the Arbitrator shall be final and binding upon the parties. The ezpenses and fees incumbent to the services of the arbitraor shall be equally shared by the Employer and the Union. Any time limits stipulated in the grievance procedure may be extended for stated periods of time by the appropriate parties by mutual agreement in writing. Pending final decision of ariy grievance by any of the above procedure, work shall continue without interruption and under conditions prevailing prior to the time the dispute started. ARTICLE XIV - MANAGEMENT'S RIGHTS The Union recognizes the prerogative of the City to operate and manage its affairs in all respects in accordance with its responsibilities, and the powers or authority which the City possesses. These include, but are not limited to, the following: a) The Union recognizes the exclusive right of the City to establish reasonable work rules. b) The City has the right to schedule overtime work as required and consistent with the requirements of munioipal employment and the public interest. c) It is understbod by the parties that every incidental duty con- nected with operations enumerated in job descriptions is not always specifically described. Nevertheless, it is intended that all sueh duties shall be performed b,y members. - il - , � • 1988 CONTRACT FIREFIGHTERS LOCAL i1352 ARTICLE XIV (CONT'D) d) The City reserves the right to discipline members or discharge members for cause. The City reserves the right to lay off members for lack of work or funds, or for the occurrence of conditions beyond the control of the City or where such cori- tinuation of work would be wasteful or unproductive. The City shall have the right to determine required schedules of work and to establish the methods and processes by which such work is to be performed. e) The City agrees to maintain a standard of work scheduling con- sistent with other cities in the area whose members work a similar tour of duty. ARTICLE XV - BULIETIN_ BOARD A bulletin board shall be provided by the Gity in each fire station and located in a mutually satisfactory place for posting by the Union of notices of ineetings, union elections and results of union elections. ARTICLE XVI - NO STRIKE The Union agrees that there shall be no strikes, slowdowns, stoppages of wbrk, or any interference with the efficient management of the Fire Department during the term of this Agreement. ARTIGLE XVII - UNION REPRESENTATIUE SECTION_1. The business representative or other duly authorized Union representative shall be permitted to visit the department during operating hours for purposes consistent with the Agreement, providing he/she does not interfere with working members. SECTION 2. The Union ag�ees not to conduct Union business on the City' s time and agrees that no Union meetings will be held during regular established operating hours on City premises. To enable full represen- tation at meetin9s by members of the bargaining unit, the established operating hours for this purpose shall be deemed to be between 7:00 a.m. and 5:00 p.m. Monthly meetings may be held on a re9ular basis in Fire Station 31' s Training Room. Additional meetings �equiring the use of the Training Room will require prior approval of the Fire Chief or his/her designee. SECTION 3. The parties having a labor Agreement hereby agree that such members of the Union (three maximum) as may be designated by the Union with prior notification for the purposes of direct participation as members of the Union negotiating team in labor negotiations with the City of Auburn, shall he granted leave from duty without loss of pay for such negotiations. - 12 - • . • 1988 CONTRACT FIREFIGHTERS LOCAL #1352 ARTICLE XVIII ARTICLE XVIII -_ NONDISCRIMINATION The Union and the City agree to promote and afford equal employment oppor- tunities to all persons regardless of race, creed, color, ethnicity, national origin, sex, age or marital status or the presence of any non-job- related physical, sensory or mental handicap. ARTICLE XIX - RETENTION OF BENEFITS All wages, hours and working conditions held by members at the present time and those in accordance with City Ordinances as well as those specifi- cally mentioned in this Agreement shall remain in full force, unless changed by mutual agreement during the term of this agreement. ARTICLE XX - SAVINGS CLAUSE Should any Article, Section or portion thereof of this Agreement be held unlawful and unenforceable by any Court of competent �urisdiction, such decision of the Court shall apply only to the specific Article, Section or portion thereof, directly specified in the decision. ARTICLE XXI - FOOD ALLOWANCE The City shall pay all bargai.ning unit members working 24-hour shifts an allowance of one dollar ($1.00) per shift actually worked in lieu of sub- sistence. The job descriptions for each of the Specialist posi- tions shall be included in the Civil Service Class Specifications Rule 22. The performance standards for each Specialist class are contained in a three-ring binder and because of their bulk, they will stand alone, but carry the same weight as the Department rules and regulations. Both parties agree that until such time the Civil Service Commission recognizes the rank of FF1G-Specialist those members filling the positions will receive proficiency pay in the amount of 2% over the base wage of FF1C retroactive to January 1, 1988. Proficiency pay will remain in effect until the Civil Service Cormnission adopts the Specialist classification et which time it will become part of the civil service classification base pay. It is in the best interests of both parties to govern the day-to-day imple- mentation of the activities of FF1C-Specialists. In addition to the job descriptions and the performance standards, the following guidelines wi.11 serve this purpose: 1. Members shall be appointed as FF1C-Specialist Trainee by the Chief or his/her designee in accordance with the proposed Civil Service rules. 2. Members may be removed from the fF1C-Specialist class by the Chief or his/her designee for cause which may include but not be limited to: a) Inability to meet performance standards b) Failure to respond with. statistic.al regularity c) Inability to achieve tYaining gbals 3. All current members that are filling the Specialist positions, upon the approval of the Fire Chief or his/her designee, shall be grand- fathered into those positions without having to serve a trainee peribd. It is ezpected that those so grandfathered will diligently work towards achieving compliance with all performance standards and training goals. 4. Members who are appointed to a FF1C-Specialist position following the effective date of this agreement will be expected to serve as a FF1C-Specialist Trainee until training objectives and performance standards are achieved. At the end of the first six (6) month period, the Chief or his/her designee shall evaluate the progress of the trainee towards accomplishment of training goals and profi- ciency standards. It is the intent to encourage the member to serve on the team/assignment long enough to be of Value as an effective operating member of the team.
